INDUSTRY COMMITTEE’S REPORT ON THE
“ENERGY ROADMAP 2050”.
REPORT STRESSES KEY ISSUE OF MARKET DESIGN.

The European Parliament has approved a report on the EU
Commission’s “Energy Roadmap 2050”, written by the
Committee on Industry, Research and Energy (ITRE). The
report from mid-March defines the Parliament’s view on
the main issues that must be tackled in order to reach the
EU goal of 80% reduction of CO2 by 2050, and promotes
new forms of energy production.
Based on an amendment by the Committee on Foreign
Affairs, the report now calls on the EU Commission to
“foster cooperation on energy policies and strengthen
research collaboration” with the United States. The energy
relationship with Russia, however, should not be deepend
further.
The EU Parliament also plans to strengthen its energy ties
with non-EU Member States. The report states “there is a
need to pursue closer integration with neighbouring
countries and regions such as Norway, Switzerland and the
southern Mediterranean”. It also addresses the inter-
connection cable between Norway and Germany as a
means to integrate the market between Norway, a non-EU
Member State, and Germany.
One other key issue is the energy market design. The
Roadmap emphasizes the need for flexibility and
technology–driven energy transformation and trans-
mission.
Furthermore, the report stresses the importance of a new
financing mechanism to increase the energy efficiency of
buildings. According to the report, the Cohesion Policy of
the European Union, namely structural funds, should not
serve “as a replacement for such funding”. One objective

EUROPÄISCHES PARLAMENT VERABSCHIEDET BERICHT
ZUM “ENERGIEFAHRPLAN 2050”.

Das Europäische Parlament hat einen Bericht des
Ausschusses für Industrie, Forschung und Energie (ITRE)
zum „Energiefahrplan 2050“ der Europäischen Kommission
verabschiedet. Der Bericht von Mitte März legt die
Ansichten des Parlamentes zu den Eckpunkten fest, die
erfüllt werden müssen, um das Ziel einer 80%-igen CO2-
Reduktion bis 2050 zu erreichen. Er schreibt weiterhin die
Förderung neuer Formen der Energieproduktion fest.
Aufgrund eines Änderungsantrages des Ausschusses für
Auswärtige Angelegenheiten, ruft der Bericht die
Europäische Kommission dazu auf, „strategische
Prioritäten für die externe Energiepolitik festzulegen“. Dies
soll insbesondere mit den Vereinigten Staaten geschehen.
Das Europäische Parlament plant zudem seine
Energiebeziehungen mit Nichtmitgliedstaaten zu ver-
stärken. Laut Aussage des Berichtes, bedarf es „einer
engeren Zusammenarbeit mit Nachbarländern und –
regionen, wie Norwegen, der Schweiz und dem südlichen
Mittelmeerraum“. Hierzu wird explizit das Unterseekabel
zu Norwegen erwähnt, das „Zugang zu den bedeutenden
Stromspeichern der norwegischen Wasserkraftwerke“
ermögliche.
Weiterhin betont der Bericht die Rolle neuer Finanzierungs-
mechanismen zur Verbesserung der Energieeffizienz von
Gebäuden. Laut des Berichts soll die Kohäsionspolitik der
Europäischen Union, also die Strukturfonds, „nicht als ein
Ersatz für die Mittelausstattung“ für Programme zur
Energetischen Gebäudesanierung dienen. Ziel der EU bleibt
es, einen Mix aus Finanzierungsprogrammen zur Verfügung
zu stellen.
Während sich ein Großteil des „Energiefahrplans 2050“ auf
die Energieeffizienz von Gebäuden fokussiert, widmet sich
ein Teil ebenfalls der „gesamten Versorgungs- und
Nachfragekette“ auf dem Energiemarkt. Dies schließt die
Umwandlung und Übertragung von Strom ein und ist ein
klares Bekenntnis hin zu einer flexiblen und technologie-
offenen Entwicklung des Energiemarktdesigns.
Der Bericht des Europäischen Parlaments wird nun von der
Kommission zur Kenntnis genommen und in die weitere
Ausgestaltung zur Realisierung der Energieeinsparziele bis
2050 einfließen.

AGREEMENT ON CONSTRUCTION OF SUB

and the transmission system operator TenneT TSO GmbH
have decided on a framework agreement for the
construction of a new sub sea-level interconnector cable.
The purpose of the cable is to enable electricity exchange
between the two countries. The investment will total
approximately 1.5-2 billion EUR and the cable should be
operating by the end of 2018.

VEREINBARUNG ZUM BAU EINES UNTERSEEKABELS
ZWISCHEN NORWEGEN UND DEUTSCHLAND.

Die Tochtergesellschaft der Kreditanstalt für Wieder-
aufbau, KfW IPEX-Bank, der Stromnetzbetreiber Statnett
und der Übertragungsnetzbetreiber TenneT TSO GmbH
haben eine Rahmenvereinbarung zum Bau eines Unter-
seekabels getroffen. Das Hochspannungsübertrag-
ungskabel soll die Integration der Strommärkte zwischen
dem Nicht-EU-Land Norwegen und Deutschland
ermöglichen. Das Investitionsvolumen beträgt rund 1,5 bis
2 Milliarden EUR. Ende 2018 soll das Kabel in Betrieb
genommen werden.

SECRETARY AND HEAD OF EPA.
POSITIONS WILL ADDRESS ENERGY AND ENVIRONMENTAL
LEGISLATION WITH CONGRESS.

On 4 March 2013 President Obama nominated the
physicist Ernest Moniz as his next Energy Secretary and
Gina McCarthy as head of the Environmental Protection
Agency (EPA). If approved by the US Senate, Moniz and
McCarthy will be responsible for implementing Obama’s
pledge for increased climate protection. Both positions are
important for Obama, as they will need to tackle potential
opposition from Congress in regard to energy legislation.
McCarthy is currently the EPA’s Assistant Administrator for
the Office of Air and Radiation. In this capacity, she has
played a leading part in creating air pollution regulation,
including a new rule that restricts toxic air pollution from
coal-fired power plants.
Moniz is a known supporter of a diverse energy mix,
including the use of natural gas and fracking. Thus, his
views on energy policy mirror those of Obama. Moniz is
currently a physicist at the Massachusetts Institute of
Technology (MIT) and director of the MIT Energy Initiative.
In the past he served as Associate Director of the White
House Office of Science and Technology Policy as well as
Undersecretary of Energy during the Clinton
Administration.

Am 04. März 2013 hat Präsident Obama den Physiker
Ernest Moniz für das Amt des Energieministers nominiert.
Für die Leitung der Umweltbehörde Environmental
Protection Agency (EPA) nominierte Obama die Leiterin der
EPA Abteilung „Luft und Strahlung“, Gina McCarthy. Beide
Positionen gelten als Schlüsselrollen, da sie für die
Umsetzung der klimapolitischen Ziele Obamas verantwort-
lich sind. Des Weiteren müssen sie mit dem US-Kongress
verhandeln, sollte dieser sich gegen Gesetzesvorhaben
stellen.
In ihrer Rolle als Leiterin der Abteilung „Luft und
Strahlung“ hat McCarthy federführend an der Erarbeitung
von Richtlinien für eine bessere Luftqualität mitgewirkt. So
setzte sie sich beispielsweise für striktere Auflagen für
Emissionen von Kohlekraftwerken ein.
Moniz gilt als Befürworter eines offenen Energiemixes
sowie des Frackings. Somit spiegelt er im Wesentlichen die
Linie von Präsident Obama wider. Derzeit ist Moniz
Physiker am Massachusetts Institute of Technology (MIT)
und Direktor der MIT Energie-Initiative. Während der
Clinton-Administration war er stellvertretender Direktor
des Büros für Wissenschaft und Technologie im Weißen
Haus.

A dual picture in the European data protection discussion
is emerging. According to an article in one of Germany´s

leading newspapers, the Frankfurter Allgemeine Zeitung
(FAZ), German campaign managers are now discussing the
use of personal data. While most of the German parties
demand higher data regulation standards from companies,
the use of personal data for party election campaigns is
viewed as crucial to win the forthcoming elections.
Julius van de Laar, a former campaign manager for the
Obama campaign of 2008, stated, “the first party which
begins to use personal data in a strategic way in its
election campaign will be ten years ahead of the others.
There is still much potential to be used.”
The use of personal data is still viewed very critically in
Germany, while campaigns in the UK and the US are more
disposed to use such data. In the US for example, it is
possible to use mobile apps to identify which party one’s
neighbours belong to. This allows campaigners to easily
target party and non-party members directly on their
doorstep.
In 2009 through the use of e-mail, the Free Democratic
Party (FDP) became the first German party to use personal
data in a campaign. Although this did not violate data
protection laws, the FDP was heavily criticised. More
recently, the blog peerblog.de, supporting the German
Social Democratic (SPD) Party candidate for Chancellor,
Peer Steinbrück, was taken off the internet after receiving
a great deal of negative media attention.
While the SPD and the Greens are still pushing for higher
data protection standards in the wake of the proposed
Data Protection Regulation on the EU level, they appear
keen to use tailor-made elections campaigns. “We want to
develop a mobile app which makes it possible to recruit
party members even in a pub”, Robert Heinrich, the
campaign manager of the Greens stated.

In der europäischen Datenschutzdebatte öffnet sich eine
neue Konfliktlinie. Laut von einem Artikel von Sebastian
Eder in der Frankfurter Allgemeinen Zeitung (FAZ) von
Anfang Februar befürwortet die Mehrheit der deutschen
Parteien die Nutzung personenbezogener Daten in ihren
Wahlkampagnen. Im Gegenzug fordern die Parteien
allerdings stärkere Datenschutzregelungen für Unter-
nehmen im Rahmen der Datenschutzgrundverordnung im
Europäischen Parlament. Julius van de Laar, ehemaliger
Kampagnenmanager der Obama-Kampagne im Jahr 2008,
sagte hierzu gegenüber der FAZ: „Die Partei, die als Erstes
anfängt, Daten für den Wahlkampf strategisch zu nutzen,
wird einen Vorsprung von zehn Jahren haben. Die
deutschen Parteien lassen noch viel Potential ungenutzt.“
Der Gebrauch von personenbezogenen Daten wird in
Deutschland kritisch gesehen, während Großbritannien und
die USA offener für die Verwendung solcher Daten sind. In
den USA ist es beispielweise möglich über mobile
Applikationen zu sehen, wer in einer bestimmten Straße
Anhänger der Demokraten oder der Republikaner ist. So
können die potentiellen Wähler gezielt auf ihrer
Türschwelle angesprochen werden.
Im Bundestagswahlkampf 2009 hatte die FDP als erste
deutsche Partei gekaufte Daten für den Versand von E-
Mails verwendet. Dafür wurde sie stark kritisiert, obwohl
dies nicht gegen geltendes Datenschutzrecht verstößt.
Kürzlich erst wurde zudem das Blog des SPD-
Kanzlerkandidaten Peer Steinbrück (www.peerblog.de)
nach heftiger medialer Kritik abgeschaltet. Während SPD
und Bündnis 90/Die Grünen sich bei der Novellierung der
Datenschutzgrundverordnung des Europäischen
Parlaments weiterhin für höhere Datenschutzstandards
einsetzen, möchten sie personenbezogene Daten für ihre
Wahlkampagnen nutzen. „Wir wollen eine mobile
Anwendung entwickeln, mit der man auch in der Kneipe
Mitglieder werben kann.“, so Robert Heinrich,
Wahlkampfmanager von Bündnis 90/Die Grünen.

CONTROVERSY OVER EU DATA PROTECTION
REFORM CONTINUES.
MEMBER STATES VOICE CONCERN.
–
The EU has been facing continuous opposition to its
proposed EU Data Protection Regulation from its Member
States as well as from the private sector. The EU
Commission’s proposal seeks to create harmonised privacy
standards among the EU’s Member States and to offer
users more control over their personal data. However, the
main issues of contention appear to be the extent of the
reform, i.e. what the minimum standard of data protection
should be across Europe.
Member States (through the Council of Ministers) such as
Belgium, Germany or the UK have voiced their concern
that the scope of the proposed legislation may burden
data-related companies. The German Federal Interior
Minister, Hans-Peter Friedrich, stated in a meeting with EU
Commissioner Viviane Reding earlier this month, that the
legislation should take a “risk-based approach”. Such an
approach, would place focus mainly on instances where a
substantial threat to personal privacy exists, such as the
use of medical information. Furthermore, Friedrich
repeated his view that a framework for self-regulatory
procedure is needed.
In light of the large number of US technology firms that
would be affected by the regulation, the US Government
has also voiced concerns. More specifically over a
proposed rule that would fine companies up to 2 % of their
global turnover for serious violations, such as processing
sensitive data. The US business community is largely in
favour of a more risk-based approach.
The Commission’s proposal is currently being debated in
the European Parliament within the respective
committees. To date, the European Parliament’s
Committees on Industry (ITRE), Internal Market (IMCO)
and Employment (EMPL) have given their positions on the
proposal. On 19 March 2013 the Committee on Legal
Affairs (JURI) also voted on the draft legislation. The
outcomes of the votes show different levels of support for
the legislation.
The lead committee on the proposal, The Committee on
Civil Liberties, Justice and Home Affairs (LIBE), headed by
the Rapporteur Jan Phillipp Albrecht (Greens-European
Free Alliance), presented a draft report that calls for the
extension of the territorial scope of the proposed
regulation, as well as for the establishment of an EU Data
Protection Agency. The Shadow Rapporteur from the
conservative European People´s Party (EPP) on the LIBE
Committee, Axel Voss, in turn told Deutsche Welle in an
interview that “too much data protection policy is bad for
innovation and growth.” In Voss` view it is crucial to find
the right balance between consumer and business
interests.
LIBE will vote next on the proposal and the recommended
changes. LIBE is crucial in the process, as it is responsible
for consolidating all amendments proposed by the other
committees.

Der Vorschlag der EU-Kommission zur geplanten
Datenschutzreform stößt derzeit auf Widerstand einiger
EU-Mitgliedstaaten sowie von Vertretern der Wirtschaft.
Der Vorschlag zielt darauf ab, einheitliche Datenschutz-
Standards innerhalb der EU zu schaffen. Des Weiteren soll
Nutzern mehr Kontrolle über die Verwendung ihrer
persönlichen Daten ermöglicht werden. Zentraler
Streitpunkt ist jedoch der Umfang der Reform, so zum
Beispiel was der Mindeststandard des Datenschutzes in
Europa sein sollte.
Mitgliedstaaten wie Belgien, Deutschland oder
Großbritannien äußerten ihre Besorgnis, dass der

Geltungsbereich der vorgeschlagenen Rechtsvorschriften
mögliche Belastungen für Unternehmen im IT-Sektor
umfasse. Bundesinnenminister Hans-Peter Friedrich sprach
sich in einem Treffen mit EU-Kommissarin Viviane Reding
im März 2013 für einen „risikobasierten Ansatz“ aus. So
müssten beispielsweise strengere Auflagen für
Gesundheitsdaten gelten. Darüber hinaus machte Friedrich
deutlich, dass ein rechtlicher Rahmen für die
Selbstregulierung benötigt wird.
In Anbetracht der großen Zahl von amerikanischen IT-
Unternehmen, die von der Verordnung betroffen wären,
hat die US-Regierung ebenfalls Kritik geäußert. Besonders
hob sie die vorgeschlagene Regelung hervor, bei der
Unternehmen Geldstrafen bis zu 2 Prozent ihres Umsatzes
für schwere Verstöße, wie die Verarbeitung von sensiblen
Daten, zahlen müssten. Die Amerikanischen Wirtschafts-
vertreter, wie die American Chamber of Commerce,
befürworten einen risikobasierten Ansatz.
Der Vorschlag der Kommission wird derzeit im
Europäischen Parlament in den jeweiligen Gremien
diskutiert. Bisher haben die Ausschüsse für Industrie (ITRE),
Binnenmarkt (IMCO) und Beschäftigung (EMPL) im
Europäischen Parlament ihre Positionen abgegeben. Am
19. März 2013 stimmte der Ausschuss für Recht (JURI) über
seine Stellungnahme zu dem Gesetzentwurf ab. Die
Ergebnisse der Abstimmung zeigen verschiedene Ebenen
der Unterstützung für die Gesetzgebung. So stellte der
Berichterstatter des Ausschusses für Bürgerliche Freiheiten,
Justiz und Inneres (LIBE), Jan Phillipp Albrecht (Die Grünen-
Freie Europäische Allianz), im Januar 2013 einen
Berichtsentwurf vor. Dieser sieht die Erweiterung des
Geltungsbereiches sowie die Einrichtung einer EU-
Datenschutzbehörde vor. LIBE ist der federführende
Ausschuss im Europäischen Parlament.
Der Schattenberichterstatter für die konservative
Europäische Volkspartei (EVP) im LIBE-Ausschuss, Axel
Voss, gab wiederum gegenüber Deutsche Welle zu
bedenken, „dass eine zu weitreichende
Datenschutzverordnung nachteilig für Innovation und
Wachstum“ etwa im Bereich des E-Commerce sei. Es
komme darauf an, einen „Kompromiss“ zwischen den
Interessen der Verbraucher und der Industrie zu finden, so
Voss.

A request was submitted two weeks ago in Brussels by the
EU Parliament to move next year’s elections, scheduled for
5-8 June 2014 to 22-25 May 2014. The reason for moving
the election: the current election date falls on the Christian
holiday of Pentecost. Although a further EU Council
decision and Parliament approval is required, it is likely
that the vote will pass and that the election for the 571
Parliament seats will take place two weeks ahead of
schedule.

Zeitraum vom 22. bis 25. Mai 2014 um zwei Wochen
vorgezogen. Ursprünglich geplant war, dass die Wahlen
vom 05. bis 08. Juli 2014 stattfinden sollten. Die Wahlen
wurden auf Wunsch des Europäischen Parlamentes
vorgezogen, um zu verhindern, dass der Wahltermin auf
Pfingsten fällt.

Andreas Eisele was re-elected as the President of the
Bavarian division of the Association of German Private
Housing and Real Estate Companies at its first meeting on
7 March 2013. The Bavarian division is the umbrella
organisation for all private real estate companies in

Germany. It represents 180 enterprises that manage a
housing stock of more than 430,000 apartments.
In a statement provided to nuances public affairs, Eisele
stated that “only if we create better incentives to build
apartments, can we tackle the issue of limited living space.
The BFW does not want symbolic politics, especially not in
an election year. What we need is practical politics.“

Im Rahmen des Ersten Bayerischen Immobilientages am
07. März 2013 wurde Andreas Eisele als Präsident des
bayerischen Landesverbandes des Bundesverband Freier
Immobilien- und Wohnungsunternehmen (BFW)
wiedergewählt. Andreas Eisele ist Geschäftsführender
Gesellschafter der EGCP Projektentwicklungs- und
Verwaltungs GmbH. Der BFW Landesverband Bayern ist
der Spitzenverband der privaten Immobilienwirtschaft in
Bayern. Dem Verband gehören rund 180 Unternehmen an,
die einen Wohnungsbestand von mehr als 430.000
Wohnungen verwalten.
Gegenüber nuances public affairs sagte Herr Eisele: „Nur,
wenn wir mehr Anreize schaffen, Wohnungen zu bauen,
können wir das Problem der fehlenden Wohnungen an der
Ursache packen. Wir vom BFW wollen keine

US CARDINALS URGED VATICAN TO RELEASE VATILEAKS

After only two days of the Conclave, Cardinal Jorge
Bergoglio was elected Pope last week. After years of
scandals plaguing the church, this election became a highly
covered press event.
During the weeks prior to the election, the Italian as well
as international press were busy covering the new and
popular daily press conferences of the US Cardinals. It
quickly became apparent that the US Catholic leaders were
employing classic political and PR campaign strategies in
order to address pressing issues; in particular, the release
of the Vatileaks Dossier, before the Conclave.
Through the use of these press conferences, US Cardinals
for one of the first times ever, utilised a common PR tactic
to draw global attention to a vital issue for fellow voters:
the release of the “Vatileaks” dossier. This report,
commissioned by the now Emeritus Pope Benedict XVI,
reveals the results of an investigation made by three
Vatican Cardinals regarding the 2012 scandal. The Vatican
has confirmed the existence of the report, but will not
release the document to the press or any other members
of the Church except for the newly elected Pope
Francesco.
The media statements made clear that the US Cardinals
were calling for more information before they entered the
conclave and elected the new pope; the Cardinals wanted
all possible information before making their decision.
Cardinal Francis Eugene George, Archbishop of Chicago,
went further in a press conference in Rome demanding the
opportunity to ask “relevant Cardinals” questions on the
Vatileaks Dossier. Many US Cardinals didn’t want to go
ahead with the vote until questions were answered. "We
need to give it the time that's necessary," Cardinal Sean
O'Malley of Boston stated at a packed press conference at
the North American College in Rome. According to press
reports, on 6 March 2013, the Vatican called for a so called
“media blackout”, which pressured Cardinals to end the
American daily press conferences; however some
American cardinals did continue with the briefings.
International media sources additionally reported on the
existence of, and fierce competition between, “Vatican

are divided over different issues facing the church and
over which candidate should have won the election. The
Roman Curia, a group developed under John Paul II and
Benedict XVI, is the most influential factor in Church
administration and was one of the main lobbying groups
within the conclave.

ERZWINGEN.

Letzte Woche wurde nach nur 2 Tagen des Konklaves
Kardinal Jorge Bergoglio zum neuen Papst Franziskus I.
gewählt. Nach krisenträchtigen Jahren der
Berichterstattung über die Kirche stand dieses Konklave im
Zentrum des Medieninteresses.
In den Wochen vor dem Konklave waren die
internationalen und besonders die italienischen Medien
damit beschäftigt über die neuen Pressekonferenzen der
US-amerikanischen Kardinäle zu berichten. Dies zeigt, dass
die Führer des US-amerikanischen Teils der katholischen
Kirche mittlerweile klassische Public Affairs und PR-
Strategien anwenden, um öffentlichen Druck für die
Veröffentlichung des Vatileaks Dossiers zu erzeugen.
Dieser Bericht, der noch von Papst Benedikt XVI. in Auftrag
gegeben wurde, enthält die Ergebnisse einer Untersuchung
von drei Kardinälen des Vatikans zum Skandal um den
Kammerdiener des Papstes vergangenes Jahr. Der Vatikan
hat die Existenz dieses Berichtes bestätigt, will ihn aber
nicht der Presse oder Mitgliedern der Kirche zur Verfügung
stellen. Lediglich der neue Papst Franziskus I. erhält Einblick
in diesen Bericht.
Die Aussagen US-amerikanischer Kardinäle gegenüber der
Presse machten deutlich, dass diese mehr Informationen
verlangten bevor sie in das Konklave einziehen. Sie
forderten, ihnen jedwede Information zur Verfügung zu
stellen. Kardinal Francis Eugene George, Erzbischof von
Chicago, verlangte, „relevanten Kardinälen“ Fragen zum
Vatileaks Dossier stellen zu dürfen. „Wir müssen der
Aufklärung die notwendige Zeit geben.“, sagte Kardinal
Sean O’Mally aus Boston auf einer überfüllten
Pressekonferenz im Nord-Amerika-College in Rom.
Presseberichten zufolge forderte der Vatikan am 06. März
2013 anschließend eine interne „Nachrichtensperre“, die
die Kardinäle dazu zwang die täglichen Pressekonferenzen
zu beenden.
Internationale Medienquellen berichteten zusätzlich von
der Existenz eines starken Wettbewerbs zwischen
verschiedenen vatikanischen “Lobbies“. Diese Gruppen,
vergleichbar mit politischen Lobbygruppen, seien über den
zukünftigen Kurs der katholischen Kirche und der
Papstwahl schwer zerstritten. Die „Römische Kurie“, eine
Gruppe die in den Amtszeiten von Papst Johannes Paul II.
und Benedikt XVI. gegründet wurde, war die
Einflussreichste in der Kirchenadministration. Gleichzeitig
galt sie als eine der Hauptlobbygruppen innerhalb des
Konklaves. Durch den Einsatz von politischen
Kampagnenstrategien und verschiedener Lobbygruppen
erscheint das Konklave im Rückblick mehr und mehr wie
eine gewöhnliche politische Wahl.
