EU - Financing Energy Efficient Retrofit - nuances public affairs analysis 2013nuances
Buildings account for over 40% of EU energy consumption, with heating making up 85% of building energy use. The EU has set targets to reduce greenhouse gas emissions 20%, increase renewable energy 20%, and improve energy efficiency 20% by 2020. To achieve efficiency goals, EU members must submit plans to reduce energy sales 1.5% annually, and the EU will provide €17 billion from 2014-2020 for efficiency projects through the European Regional Development Fund. Additionally, €6.5 billion will fund efficiency research. Germany and the UK offer models through subsidies and loans to increase private investment in efficiency measures like building insulation, which typically have long payback periods.
The April edition of our nuances public affairs newsletter focuses on energy efficiency, including both a new study by the Intergovernmental Panel on Climate Change (IPCC) on mitigation climate change and an update on EU developments regarding the Energy Efficiency Directive and the process of implementation in the 28 EU Member States.
We are also looking at the developments in the smart metering field, particularly German-Irish relations in the industry. New EU legislation affecting the Telecoms industry and financing road infrastructure in Germany are also under the microscope in our April volume.

This month’s nuances public affairs newsletter examines

DIE EU VOR SCHWIERIGEN VERHANDLUN-
GEN IN DER ENERGIE- UND KLIMAPOLITIK –
AUCH FÜR DIE DEUTSCHE ENERGIEWENDE
STEHT DABEI EINIGES AUF DEM SPIEL
Mit der Vorlage ihres Entwurfs für einen neuen Rahmen in
der Energie- und Klimapolitik hat die EU-Kommission im
Januar 2014 die Diskussion über die Gestaltung der Ziele
und Instrumente für den Zeitraum 2020 bis 2030 losgetre-
ten. Die Mitgliedstaaten sind nun gefragt, sich in den
kommenden Monaten auf ein Konzept zu einigen, mit dem
die Weichen für die Weiterentwicklung des Politikfelds auf
EU-Ebene gestellt werden. Im Mittelpunkt stehen dabei
die Nachhaltigkeitsziele in den Bereichen Klimaschutz,
erneuerbare Energien und Energieeffizienz. Zunehmend
wird jedoch von Regierungen auch ein stärkerer Fokus auf
Fragen der industriellen Wettbewerbsfähigkeit und der
Versorgungssicherheit eingefordert.
Für die deutsche Energiewende-Politik sind die Zielsetzun-
gen in der EU von vitalem Interesse. Im Mittelpunkt stehen
dabei das Emissionsminderungsziel und die Zukunft des
Emissionshandels. Nur durch eine strukturelle Reform des
Emissionshandels lassen sich auch in Zukunft deutsche
Klimaziele erreichen. Bereits in der Phase bis 2020 zeigt
sich, dass die nationale Zielsetzung einer Emissionsminde-
rung in Höhe von 40 Prozent gegenüber 1990 nicht ohne
eine Reform des Emissionshandels zu erreichen ist. Sollte
sich Deutschland auch ein Klimaziel für 2030 setzen wol-
len, müsste dies mit dem EU-weiten Ziel abgestimmt sein.
Auch beim Ausbau der erneuerbaren Energien wird die EU-
Ebene zunehmend relevant. Einerseits über den Strombin-
nenmarkt, in dem wachsende Lastflüsse zwischen den
Marktgebieten augenfällig werden. Die Entwicklung in
einem Mitgliedstaat betrifft zunehmend die Marktstruktu-
ren in anderen Mitgliedstaaten. Dies erfordert ein höheres
Maß an Koordinierung und ruft neue Fragen hinsichtlich
der Versorgungssicherheit hervor. Andererseits geraten
die Fördersysteme der Mitgliedstaaten aus wettbewerbs-
politischen Gesichtspunkten zunehmend unter Druck. Das
Beihilfeverfahren zur Überprüfung der Ausnahmeregelun-
gen im EEG dürfte ein Vorgeschmack auf künftige Ausei-
nandersetzungen mit der Kommission gewesen sein.
Schließlich – und dies ist für den Verhandlungsprozess
bedeutsam – haben einige Mitgliedstaaten ihre Ablehnung
einer gezielten Erneuerbare-Energien-Politik in der EU zum
Ausdruck gebracht. Die entsprechenden Regierungen von
der Notwendigkeit und Sinnhaftigkeit eines technologie-
spezifischen Ansatzes zu überzeugen, dürfte ein weiterer
wichtiger Bestandteil deutscher Energiewende-
Europapolitik sein.
Noch deutlicher schlechter sehen die Aussichten für ein
weiteres Energieeffizienzziel aus. Auf eine verbindliche
Zusage wollen sich nur die wenigsten Regierungen einlas-
sen. Zwar wird die Kommission weiterhin Regulierungsvor-
schriften für Teilbereiche vorschlagen (z.B. Ökodesign)
können. Ein kohärentes Oberziel für den Energieverbrauch
erscheint aus heutiger Perspektive jedoch unwahrschein-
lich.
Die Vorzeichen für ehrgeizige Beschlüsse in Brüssel stehen
derzeit nicht zum Besten. Auch die Tatsache, dass ein Kon-
sens unter den 28 Staats- und Regierungschefs im Europäi-
schen Rat erreicht werden muss, erleichtert die Entschei-
dungsfindung nicht. Die Wahlen zum Europäischen Parla-
ment werden diesen Prozess hingegen kaum beeinflussen.
Die Abgeordneten kommen erst bei der Ausgestaltung der
Zielsetzungen im Rahmen des Gesetzgebungsprozesses ins
Spiel. Auch die Neubesetzung der Kommission und die
Nominierung für das Energiedossier werden für diesen
Prozess nicht entscheidend sein. Die Kommission wird sich
erst wieder mit der Ausarbeitung der Beschlüsse des Euro-
päischen Rates beschäftigen. Derzeit liegt der Ball klar im
Spielfeld der Mitgliedstaaten. Ob tatsächlich, wie geplant,
bereits im Oktober 2014 neue Zielsetzungen gefasst wer-
den können, erscheint aufgrund der noch weit voneinan-
der entfernten Positionen derzeit keineswegs sicher. Für
die Bundesregierung stellt sich nun die Aufgabe, ihr diplo-
matisches Verhandlungsgeschick auf europäischem Parkett
zu beweisen.

DIFFICULT NEGOTIATIONS IN THE EU ON ENERGY AND
CLIMATE POLICY – IMPLICATIONS FOR THE GERMAN ‘EN-
ERGIEWENDE’
With the presentation of its draft for a new framework on
energy and climate policy in January 2014, the EU Commis-
sion has kicked off the debate on the layout of objectives
and instruments for the period 2020-2030. Member States
are now being asked to agree in the coming months on a
concept, which will pave the way for the development of
policy at the EU level. The focus is on the sustainability
goals in the areas of climate change, renewable energy and
energy efficiency. Increasingly, however, governments are
coming under pressure to place a stronger focus on issues
relating to industrial competitiveness and security of sup-
ply.
For the German Energiewende policy, the objectives in the
EU are of extreme significance. The focus is on the emis-
sions reduction target and the future of emissions trading.
Only through a structural reform of emissions trading can
the German climate targets be reached. It is clear from the
period leading up to 2020 that the national objective of
reducing emissions by 40 percent compared to 1990 can-
not be achieved without a reform of emissions trading.
Should Germany also want to set a climate target for 2030,
this would have to be aligned with the EU-wide target.
For the development of renewable energy, developments
on EU level will also be increasingly relevant. In the inter-
nal electricity market, the growing load flows between the
market areas are becoming more evident. Developments
in one Member State has an increasingly effect on market
structures in other Member States. This requires a higher
level of coordination between Member States and raises
new questions about security of supply. On the other
hand, the support systems of the Member States are com-
ing under increasing pressure from a competition law
standpoint. The state aid procedure taken by the Commis-
sion to review the exemptions in the German Renewable
Energy Act could be a preview of future disputes with the
Commission. Finally - and this is relevant to the negotiation
process – a number of Member States have expressed
their opposition of a specific renewable energy policy in
the EU. Convincing the respective governments of the
necessity and usefulness of a technology- specific ap-
proach is likely to be another important component in the
development of European policy for the German Ener-
giewende.
Even worse are the prospects for a further energy efficien-
cy target. Only a handful of governments want a binding
commitment. While the Commission continues to propose
regulatory provisions for specific areas e.g. eco-design, for
the time being a coherent overall objective for energy
consumption seems unlikely.
There are no positive signs that ambitious decisions are
being taken in Brussels. Also, the fact that a consensus
among the 28 heads of state and government must be
reached in the European Council, does not help in reaching
a decision. Elections to the European Parliament will not
have much bearing on this process. MEPs only play a role
at the design of the objectives in the legislative process.
The replacement of the Commission and the nomination
tion for the energy dossier will not be critical for this pro-
cess. The Commission will deal again only with the drafting
of the decisions of the European Council. Currently, the
ball is clearly in the court of the Member States. Whether
in fact, new objectives can be taken in October 2014 as
planned, is by no means certain due to the varying posi-
tions being taken. The German Federal Government’s task
now is to prove its diplomatic negotiation skills in the Eu-
ropean arena.

Europa muss dafür sorgen, dass in der Energieversorgung
die Balance zwischen einer sicheren Versorgung, bezahlba-
ren Preisen und Klimaschutz gegeben ist. Das war ich der
Vergangenheit nicht immer der Fall, aber zuletzt sind Ver-
sorgungssicherheit und wettbewerbsfähige Preise wieder
stärker in den Fokus gerückt. Das bleibt weiterhin eine
große Herausforderung.
2. Welche Rolle sollte Deutschland in der Gestaltung
einer europäischen Energiepolitik spielen?
Es wäre gut, wenn Deutschland den Energiebinnenmarkt
auch für die Erneuerbaren Energien endlich vorantreiben
würde. Hier liegen unheimliche Chancen, die genutzt wer-
den sollten.
3. Was möchten Sie in den nächsten fünf Jahren im Be-
reich Energiepolitik erreichen?
Ich werde mich weiterhin für eine bezahlbare und sichere
Energieversorgung ein, damit unsere Wirtschaft und In-
dustrie in der Welt wettbewerbsfähig sind.

1. What are the challenges facing Europe over the next
five years in relation to energy supply and affordability?
Europe must ensure that in the energy supply, the balance
between a secure supply, reasonable prices and climate
change is given. In the past that was not always the case
but recently security of supply and competitive prices are
again more sharply in focus. This remains a major chal-
lenge.
2. What role should Germany play in forging future Euro-
pean energy policy?
It would be good if Germany would finally drive the inter-
nal energy market for renewable energy. There are incred-
ible opportunities that should be used.
3. What do you want to achieve in the area of energy if
reelected to the European Parliament?
I will continue to work for an affordable and secure energy
supply, so that our businesses and industry remain com-
petitive in the world market.

lich Energieeffizienz in den nächsten fünf Jahren stellen?
Die Steigerung unserer Energieeffizienz ist eine Quer-
schnittsaufgabe der Energiewende, die noch stärker in den
Mittelpunkt unserer Energie- und Klimapolitik gerückt
werden muss.
Die Ziele der 2020 Strategie zur Energieeffizienz werden
nicht erreicht, dabei steckt im Einsparen von Energie ein
großes Potential. Die Mitgliedstaaten müssen daher mehr
zur Erfüllung der Vorgaben der EU Energieeffizienzrichtli-
nie tun.
Darüber hinaus ist die EU ist zu mehr als 50 Prozent von
Energieimporten abhängig. Eine Möglichkeit, diese Abhän-
gigkeit zu vermindern, ist die Einsparung von Energie und
der damit verbundenen Kosten durch die Erhöhung der
Energieeffizienz.
2. Welche Rolle sollte Deutschland in der Gestaltung
einer europäischen Energieeffizienzpolitik spielen?
Deutschland und insbesondere die deutsche Bundesregie-
rung sollte sich für ein verbindliches Energieeffizienzziel
von mindestens 40 Prozent bis 2030 auf europäischer
Ebene einsetzen. Die auf europäischer Ebene formulierten
Zielvorgaben in den Bereichen Energieeffizienz und Öko-
Design müssen nicht nur national (etwa im Rahmen eines
Nationalen Aktionsplans Energieeffizienz) definiert wer-
den, sondern systematisch in die regionale und lokale
Planung und Umsetzung von Energie- und Klimamaßnah-
men integriert werden. Dies kann nur sektorenübergrei-
fend und mit einer möglichst breiten Beteiligung von Bür-
gerinnen und Bürgern, Akteuren der Industrie und Versor-
gervertretern gelingen.
3. Was möchten Sie in den nächsten fünf Jahren im Be-
reich Energieeffizienz erreichen?
Die billigste Energie ist die, die nicht verbraucht wird. Da-
her setze ich mich für die Steigerung der Energieeffizienz
ein und fordere ein verbindliches Ziel von mindestens 40%
bis 2030. Großes Einsparpotenzial liegt dabei im Gebäude-
sektor: In vielen Mitgliedstaaten könnte ein wesentlicher
Teil des Energiebedarfs von Haushalten durch die Sanie-
rung alter Häuser erreicht werden. Dazu fordere ich die
konsequente Nutzung europäischer Fonds. Zudem könnten
dadurch bis 2030 ca. 2,5 Millionen Menschen im Bausektor
eine Beschäftigung finden.

1. What are the challenges facing Europe over the next
five years in relation to energy efficiency?
Increasing energy efficiency is a cross-cutting issue of the
energy transition that needs to be brought more into focus
in our energy and climate policy.
The objectives of the 2020 strategy for energy efficiency
are not being achieved; however it is the saving of energy
that has great potential. The Member States therefore
need to do more to meet the requirements of the EU En-
ergy Efficiency Directive.

In addition, the EU is dependent on more than 50 per cent
of energy imports. One way to reduce this dependence is
through energy efficiency, saving energy consumed and
the associated costs.
2. What role should Germany play in forging future Euro-
pean energy efficiency policy?
Germany and especially the German federal government
should advocate for a binding energy efficiency target of at
least 40 per cent by 2030 at the European level. The tar-
gets formulated at European level in the areas of energy
efficiency and eco-design must be defined not only nation-
ally (e.g. in the context of a National Energy Efficiency
Action Plan), but systematically integrated into the region-
al and local planning and implementation of energy and
climate measures. This can only be achieved if implement-
ed cross-sector and with the widest possible participation
of citizens, industry players and utilities representatives.
3. What do you want to achieve in the area of energy
efficiency if reelected to the European Parliament?
The cheapest energy is the energy that is not consumed.
Therefore, I am committed to increasing energy efficiency
and demand a binding target of at least 40 per cent by
2030. There is a big savings potential in the buildings sec-
tor: in many Member States savings could be achieved
through the renovation of old houses, which account for a
substantial part of energy demand. To this end, I urge the
consistent use of European funds. Furthermore, by 2030
an increase of 2.5 million people could find employment in
the construction sector.

Bei Energieeffizienz und Einsparung ist noch viel zu tun.
Obwohl Energieeffizienz als entscheidendes Mittel gegen
Klimawandel und für Energiesicherheit gilt, wird sie in der
EU stiefkindlich behandelt. Das Effizienzziel ist das einzige
der drei Energie- und Klima-Ziele für 2020 (Emissionsmin-
derung, Erneuerbare, Effizienz), das nicht verbindlich fest-
gelegt wurde. Und es ist voraussichtlich auch das einzige
Ziel, das die EU verfehlen wird. Auch in der Debatte über
die Klima- und Energieziele für 2030 ist von einem verbind-
lichen Effizienzziel kaum die Rede. Effizienz muss zum
Zentrum der europäischen Energiestrategie werden. Das
Potential ist enorm!
2. Welche Rolle sollte Deutschland in der Gestaltung
einer europäischen Energieeffizienzpolitik spielen?
Deutschland muss als Energiewendeland eine treibende
Rolle bei der Senkung des Energieverbrauchs spielen. Die
schwarz-gelbe Bundesregierung stand aber bei den Ver-
handlungen zur Energieeffizienzrichtlinie auf der Bremse
und sorgte maßgeblich dafür, dass die Vorschläge von EU-
Kommission und Europaparlament verwässert wurden. Der
neue Wirtschaftsminister Sigmar Gabriel muss nun bewei-
sen, dass Deutschland gegen die Energieverschwendung

vorgehen will. Als erstes muss er sich für ein verbindliches
Effizienzziel für 2030 einsetzen und dabei das gesamte
Verhandlungsgewicht Deutschlands auf die Waage brin-
gen.
3. Was möchten Sie in den nächsten fünf Jahren im Be-
reich Energieeffizienz erreichen?
Wir Grüne fordern, dass sich die EU für 2030 auf ein 40-
Prozent-Ziel für Energieeinsparung verbindlich festlegt.
Daraus ergeben sich zahlreiche Maßnahmen, um das Ziel
auch erreichen zu können. Das betrifft alle Bereiche, in
denen Energie verbraucht wird. Der Gebäudebestand muss
energetisch verbessert werden. Elektrische Geräte müssen
durch ehrgeizige Standards effizienter werden und die
Kennzeichnung muss verbessert und ausgeweitet werden,
um Verbrauchern die Möglichkeit zu geben, die sparsams-
ten Geräte leicht zu identifizieren. Smart Metering und
andere Maßnahmen zum Verbrauchsmanagement können
einen Beitrag zur Energieeinsparung leisten. Auch im
Transportbereich sind Effizienzsteigerungen möglich und
dringend notwendig. Dass das nicht einfach ist, haben wir
bei den Verhandlungen über die CO2-Grenzwerte für Autos
gesehen. Aber wir müssen hartnäckig bleiben.

1. What are the challenges facing Europe over the next

There is still so much to do on energy efficiency and con-
servation. Although energy efficiency is considered as a
crucial means against climate change and energy security,
it is treated like an optional extra in the EU. The efficiency
target is the only one of the three energy and climate tar-
gets for 2020 (emission reduction, renewable, efficiency),
which was not set as binding. It is probably also the only
goal that the EU will miss. Also in the debate on climate
change and energy objectives for 2030 there is hardly talk
of a binding efficiency target. Efficiency must become the
center of European energy strategy. The potential is enor-
mous!
2. What role should Germany play in forging future Euro-
pean energy efficiency policy?
Germany, as an energy transition country, needs to play a
driving role in the reduction of energy consumption. How-
ever, during the negotiations on the Energy Efficiency
Directive, the black-yellow put on the brakes and played a
decisive role in the EU Commission and the European Par-
liament watering down their proposals. The new Economic
Minister Sigmar Gabriel must now prove that Germany
wants to take action against the waste of energy. First, he
must work for a binding efficiency target for 2030 and
thereby use the entire bargaining power of Germany.
3. What do you want to achieve in the area of energy
efficiency if reelected to the European Parliament?
We Greens demand that an EU 2030 target of 40 per cent
target for energy conservation becomes binding. There are
numerous measures that can be taken in order to achieve
the objective. This applies to all areas where energy is
consumed. The building stock’s energy efficiency needs to
be improved. Electrical equipment must be efficient
through ambitious standards and labeling needs to be
improved and expanded in order to give consumers the
ability to easily identify the most efficient appliances.
Smart metering and other measures for consumption
management can contribute to energy saving. Also in the
transport sector efficiency gains are possible and urgently
needed. That this is not easy, we have seen this in the
negotiations on the CO2 emission limits for cars. But we
must persevere.
