3 Tips for Commercial
Landscaping Contracts

When it comes to contracts, each one has to
follow and meet a certain set of criteria. Writing
     a commercial landscaping contract isn’t
something that should be done on a whim or in
a rush. It’s important that the drafted contract is
     well-written, understandable, and most
 importantly, agreeable. A contract will act as a
    formal and legal binding between parties.
Most importantly is the fact that the contract is
  signed by two capable parties, that each party
    agrees to the provided terms, and that the
landscape company will provide services to you in
        exchange for monetary payment.

Though it may seem difficult, when done correctly,
  writing a contract isn’t such a daunting task as
 many think it will be. In order to make the task of
 writing commercial landscaping contracts much
   easier for even the most novice landscaping
 company, consider some of the tips and tricks in
                 this presentation.
All Parties Need to be in Agreement
• While it has been previously mentioned, one of the
  most important parts of contract building is ensuring
  that each party completely agrees 100% to the terms
  of the contract.
• The contract by all means should be fair to each client
  who is involved and within the contract there should
  be favorable terms for each side.
• Nowadays a lot of clients like to have wiggle room and
  you may run into some that can get their way out of
  contracts that become unfavorable to them. But,
  generally in this case, it’s your commercial landscaping
  business that takes the hit.
Have Set Contract Terms
• No matter what you include or don’t include in your
  contract, be sure that each of the terms is clearly
  defined.
• For example, some commercial landscaping companies
  will decide to include a term regarding non-refundable
  deposits. Things happen in life and not every contract
  job will go smoothly. However, with a term including
  information regarding non-refundable deposits, in the
  event that a job doesn’t go as planned, depending on
  the terms you have set in the commercial landscaping
  contract, your company may decide to protect any
  payments that have been made to you, which means
  that no money will be lost on your part.
• If for some reason a client experiences a
  random crisis in his/her life and cannot
  commit to paying the rest of the fees, the fees
  associated with ordering and gathering
  materials, per your contract, cannot be given
  back to the client.
• Remember, time is money, and any time that
  your company puts into starting a job for a
  client should be paid for. Be sure to include
  such clauses in your contract.
• Companies may also want to consider adding
  terms regarding when payment is due, ie. no later
  than 30 days of the beginning of the landscaping
  job or you may want to say that after 30 days
  interest fees will be added to any payment due.
• Commercial landscaping companies should also
  include terms that involve any type of warranties
  on plants and trees planted during the job.
  Clients want to know that the flowers, trees,
  shrubs, bushes, etc. that you provide to them will
  last.
• No one wants to spend thousands on a new
  landscape that doesn’t last from year to year.
Remember, Plans can Change
• You may find that a lot of clients have an “idea”
  of what type of landscaping job they want done,
  but in the end this idea is generally manipulated
  with certain details added and sometimes details
  are taken out.
• In your contract make sure you include a term
  that involves change orders and any type of
  administrative fees associated with them.
• This becomes extremely important when clients
  decide they no longer want a certain part of the
  original design as before.
• For instance, a client may say that he wants
  three flower beds planted outside of his
  business but a few days later decides that only
  two flower beds are needed, but you have
  already ordered enough flowers and plants for
  three flower beds, not just two.
• In the end it’s safest to work with clients who
  have a clear idea of the landscaping job they
  want done, but since minds can change
  frequently, change order fees are wise when
  creating commercial landscaping contracts.
