Constitutional Provision

• The Constitution of Nepal 2072 has stipulated the
powers of Federal, States and Local level governments
with regard to the responsibilities for DRR in Schedules
5, 7, 8 and 9 which have further been elaborated
through un-bundling report prepared by OPMCM.
• Federal Police and Federal Armed Police forces will help
the provincial government and local bodies in the event
of disasters for response task and coordination work.
• Some of the powers are concurrent between federation
and state, and federation, state and local levels.

• Formulation of national policy, laws, standards, planning,
implementation and regulation for disaster preparedness, rescue
and relief, recovery
• Establishment and operation of National Disaster Relief Fund.
• Support to the provincial and local Disaster Relief Fund

• Mapping and disaster mitigation at national level

Local Government Operation Act 2074
• Section 3 Article 11 of the Act has stipulated the task,
responsibility and power of municipalities and rural
municipalities pertaining to DRR.

Recent Endevours towards DRR
 Disaster Risk Reduction and Management Act 2074 has been
promulgated.
 Disaster Risk Reduction & Management National Council under
the chairmanship of right honorable prime minister, Executive
Committee chaired by honorable minister of Home Affairs and
Formation of Disaster Risk Mitigation & Management Authority
with CEO will be formed.
 At the State level, State Disaster Management Committee chaired
by the Chief Minister and at district level, District Disaster
Management Committee chaired by the CDO will be constituted.
 At local level, Local Disaster Management Committee chaired by
the Chairperson in Rural Municipalities or by the Mayor in
Municipalities will be constituted.

Recent Endevours towards DRR
 Ministry of Home Affairs has prepared the draft Disaster Risk
Reduction National Policy.
 Similarly, MoHA has also prepared draft Disaster Risk Reduction
National Strategic Action Plan 2017- 2030 which is under
discussion with the stakeholders. It has been prepared under the
framework of Sendai Framework for Disaster Risk Reduction
including other guiding documents. Goals in six areas for DRR
have been proposed for short, medium and long terms keeping in
view Sustainable Development Goals and School Sector
Development Plans.
 The draft Strategic Action Plan also specifies strategic actions
along with the timeline, responsible agency, supporting agency
and expected outcomes in priority areas. Financing mechanisms
for the implementation of the action plan has also been
proposed.

Priority Areas for DRR
In order to concretely reduce natural disaster risk, Sendai
Framework (2015-2030) advocates four priorities for
action:
• Priority 1: Understanding disaster risk
• Priority 2: Strengthening disaster risk governance to
manage disaster risk
• Priority 3: Investing in disaster risk reduction for
resilience
• Priority 4: Enhancing disaster preparedness for effective
response and to “Build Back Better” in recovery,
rehabilitation and reconstruction

Constitutional Provision 3 • The Constitution of Nepal 2072 has stipulated the powers of Federal, States and Local level governments with regard to the responsibilities for DRR in Schedules 5, 7, 8 and 9 which have further been elaborated through un-bundling report prepared by OPMCM. • Federal Police and Federal Armed Police forces will help the provincial government and local bodies in the event of disasters for response task and coordination work. • Some of the powers are concurrent between federation and state, and federation, state and local levels.

List of Powers of Federation pertaining to DRR • Formulation of national policy, laws, standards, planning, implementation and regulation for disaster preparedness, rescue and relief, recovery • Establishment and operation of National Disaster Relief Fund. • Support to the provincial and local Disaster Relief Fund • Disaster Preparedness at National Level • National Emergency Operation System • Mapping and disaster mitigation at national level • Support and coordination to provinces and local levels on DRR • Rehabilitation and reconstruction work of national level • National level database management on DRR • Seismological studies and research, monitoring of earthquakes, operation of seismological stations • Policy formulation on early warning system for DRR 4

List of Powers of States pertaining to DRR • Protection of disaster affected person, site and assets. • Coordination in disaster management • Formulation of provincial policy, laws, standards related to disaster preparedness, rescue & relief, recovery, planning, implementation and regulation • Preparedness, search & rescue, storage of relief materials and management • Mapping of disaster risk areas, identification of risky settlements and relocation to safer areas • Establishment of Province level disaster relief fund and operation, support to the local level disaster relief fund • Province level DRR projects, implementation and regulation • Rehabilitation and reconstruction at provincial level after disaster • Support and coordination to the local level for DRR activities • Study & research, database management of province level disasters • Coordination and mobilization 5

List of Powers of Local Level pertaining to DRR • Formulation of Local policy, laws, standards at local level, planning, implementation and regulation • Assistance in disaster management • Disaster preparedness and response plan at local level • Rescue & relief at local level, pre-storage of relief materials, distribution & coordination • Mapping of disaster risk areas, identification of risky settlements and their relocation • Support, coordination and collaborative work with federal and provincial governments, local community, NGOs and other institutions for disaster management. • Establishment of Disaster relief fund, its operation, mobilization • Formulation of local level disaster risk mitigation projects, implementation and regulation • Rehabilitation and reconstruction at local level after disasters • Study and research, database management of local level disasters • Emergency Operation Management system at local level 6
  • 7. Local Government Operation Act 2074 • Section 3 Article 11 of the Act has stipulated the task, responsibility and power of municipalities and rural municipalities pertaining to DRR. 7
  • 8. Recent Endevours towards DRR  Disaster Risk Reduction and Management Act 2074 has been promulgated.  Disaster Risk Reduction & Management National Council under the chairmanship of right honorable prime minister, Executive Committee chaired by honorable minister of Home Affairs and Formation of Disaster Risk Mitigation & Management Authority with CEO will be formed.  At the State level, State Disaster Management Committee chaired by the Chief Minister and at district level, District Disaster Management Committee chaired by the CDO will be constituted.  At local level, Local Disaster Management Committee chaired by the Chairperson in Rural Municipalities or by the Mayor in Municipalities will be constituted. 8

Recent Endevours towards DRR  Ministry of Home Affairs has prepared the draft Disaster Risk Reduction National Policy.  Similarly, MoHA has also prepared draft Disaster Risk Reduction National Strategic Action Plan 2017- 2030 which is under discussion with the stakeholders. It has been prepared under the framework of Sendai Framework for Disaster Risk Reduction including other guiding documents. Goals in six areas for DRR have been proposed for short, medium and long terms keeping in view Sustainable Development Goals and School Sector Development Plans.  The draft Strategic Action Plan also specifies strategic actions along with the timeline, responsible agency, supporting agency and expected outcomes in priority areas. Financing mechanisms for the implementation of the action plan has also been proposed. 9

Priority Areas for DRR In order to concretely reduce natural disaster risk, Sendai Framework (2015-2030) advocates four priorities for action: • Priority 1: Understanding disaster risk • Priority 2: Strengthening disaster risk governance to manage disaster risk • Priority 3: Investing in disaster risk reduction for resilience • Priority 4: Enhancing disaster preparedness for effective response and to “Build Back Better” in recovery, rehabilitation and reconstruction 10
