The study aims to determine the extent to which electronic signature can perform traditional signature functions in electronic banking transactions, in addition to its role in authenticating electronic banking transactions. As a result of the technological development in ICT, banks have tended to offer banking services via electronic media and have used electronic documents and signatures instead of traditional ones, which influenced the e-banking laws. The study used the comparative, descriptive and analytical method reached to conclusions and recommendations. One of the most important findings, is that the electronic signature and its reliability varies depending on the type of technology used in its authentication, and the degree of trust and security that the signature achieves. One of the most important recommendations of the study, is the need to amend Sudanese electronic transactions law for the year 2007 so that the law gives the electronic signature a different legal authority that ranges from recognition, non-denial and equality with the traditional signature, to full legal authenticity if it is associated with a digital certificate issued by the certification service provider Licensed by the National Authority for Electronic Authentication.
