2. The HITECH Act and Meaningful Use
Sweeping healthcare reform measures of the Stimulus Act created programs under the Centers for Medicare and
Medicaid (CMS) that provide for incentive payments to eligible professionals who are meaningful users of certified
EHR technology. On July 13, 2010, CMS announced its final rule on the EHR Incentive Program defining how incentive
payments will be disbursed. Physicians must choose to participate in either the Medicare (up to $44,000) or Medicaid
(up to $63,750) program and cannot receive payments from both.
To qualify for incentives, eligible professionals must:
• Adopt EHR Technology: Beginning in 2011, adopt a qualified EHR as certified by an ONC authorized testing
and certification body (ONC-ATCB).
• Demonstrate meaningful use of EHR technology: Use the EHR in a meaningful manner; exchange information
with another EHR system; and use the EHR system to submit clinical quality measures to the Secretary of the ONC.
How does the Medicare Fee for Service (FFS) Incentive Program work?
Through Medicare, each eligible physician may earn up to $44,000 over a five-year period. These cash incentives are paid
out directly to EPs or to their employers. Practices with multiple physicians will be eligible to receive incentive payments
for each provider. CMS will disburse Medicare EHR bonus payments once a year, from 2011-2015, according to the
following schedule and for meeting the appropriate stages of meaningful use.

For the first adoption year, physicians are eligible for up to 75% of allowable Medicare charges, subject to a maximum of
$15,000. In addition, the first-year payment is increased to $18,000 if adoption occurs in 2011 or 2012. To qualify for the
maximum payment of $18,000 in the first year, each provider must bill Medicare a minimum of $24,000.
Incentive payments are reduced for each subsequent year within the five year period: $12,000 for year two, $8,000 for year
three, $4,000 for year four, and $2,000 for year five. No incentive payments will be offered to physicians who first become
eligible after 2014. The program pays out lower incentives for late adopters, so there are added bonuses for adopting early!
