1. What are the functions of Laws.
Laws are put in place as a justice system. They also provide structure.
2. What are the sources of laws in the United States?
Laws must be constitutional. They go through the bill process in order to become an actual law.
3. In detail describe the differences of Criminal and civil law.(detail of crimes agains
property,torts and civil law.)
Criminal Law is when a person commits a crime based on the state’s penal code or systems of
laws and punishments. These can go through the five different courts: Magistrate, District,
Superior, Appeals, and Supreme Court. All twelve must have a unanimous decision to convict the
person as guilty. Civil Law is a disagreement between two parties based on liability of
negligence. This goes through three courts: Divorce, Small Claims, and Superior. A majority
rules vote is needed for a person to be found guilty.
4. Describe in detail 3 other types of US law.(Constitutional,Statutory and Administrative Law).
Constitutional- this is law that occurs with the use of the branches legislative, executive, and
judiciary
Statutory- based on statutes which are subordinate to the higher constitutional laws
Administrative- law that governs the administrative agencies within the government
5. Describe in detail the legal rights of an accused person and list the amendments and sections
of the constitution that guarantees those rights.
Cannot have unwarranted search and seizure - 4th amendment
Counsel must be provided to defendants unable to afford one - 14th amendment
Right to due process - 5th amendment
Right to speedy trial and jury - 6th amendment
Jury required for civil cases - 7th amendments
6. List and describe the steps in a criminal and civil case.
Civil:
Divorce Court
Small Claims Court
Superior Court
Criminal:
Magistrate (local)
District (minor cases - small claims under $5,000)
Superior (felonies)
State Court of Appeals (appealed due to unfair trial)
Supreme Court

- Jail time
- Community service
- Death penalty
8. Begin the process of learning the 36 court cases. We will review and take quizzes and test on
the court cases.
