The state of American federalism in 2017^2018 is characterized by federal policy reversals, as the
Trump administration and congressional Republicans continue to undo many of the Obama
administration’s policies. Two themes are highlighted in this essay. First, major policy changes
continue to be undertaken primarily through unilateral executive action, even with Republicans
holding the presidency and both the House and Senate. Ideological divisions within the
Republican Party prevented Congress from enacting major legislation, save for a tax reform
measure, and resulted in policy changes on health care, immigration, and the environment being
made through executive and administrative action. Another prominent feature of governance in
the early part of theTrump administration has been state resistance to federal directives, taking the
form primarily but not exclusively of state attorney general (AG) lawsuits. Democratic AGs filed
lawsuits challengingTrump administration actions on immigration and clean energy in particular.
Democratic governors and state legislators also took a variety of other actions to resist Trump
administration policies. The federal courts also continue to play an active role in shaping and
adjudicating controversies impacting federalism.
The state of American federalism in 2017–2018 is characterized by federal policy
reversals, as the Trump administration and congressional Republicans continue to
undo many of the Obama administration’s major policies ranging from the
Affordable Care Act (ACA) to the Clean Power Plan. This development reflects the
continuation of trends that emerged in the first few months of the Trump
administration, when “the arrival of a new administration with radically different
priorities” ushered in “broad policy reversals in arenas such as health care,
immigration, and the environment, with potentially important implications for
federalism and intergovernmental relations” (Goelzhauser and Rose 2017).
Two additional themes emerged in 2017–2018. First, unilateral executive action
continued to play a prominent role in policymaking at the federal level despite
unified Republican control of the federal government. With the exception of the

Tax Cuts and Jobs Act that passed in December 2017, widening ideological
division.
The health care bill taking shape in the House carries a price tag of at least $1 trillion over 10 years, higher than President Obama's target of $900 billion. While Democrats cite a CBO estimate of $871 billion, officials acknowledge the true cost is over $150 billion more. The bill would reduce deficits by at least $50 billion according to CBO estimates. Both the House and Senate are struggling with the contentious issue of a public health insurance option, with the House uncertain if it can pass the liberal preferred nationwide government-run plan and the Senate assessing support for a national option that allows states to opt out.
- Privacy issues will continue to be a major concern for Congress and the upcoming elections, fueled by increased computer and internet usage. While industry self-regulation was previously preferred, there is now support for more aggressive privacy regulation, especially around financial and medical information.
- The FTC now supports new regulatory powers over companies collecting personal data online, while the Administration focuses on financial and medical privacy. Congress remains reluctant to pass comprehensive privacy laws.
- Several bills have been introduced to address privacy, including establishing a commission to study existing laws and make recommendations, and strengthening protections for financial and medical privacy data. However, opponents argue these approaches could delay needed legislation.
- Privacy issues will continue to be a major concern for Congress and the upcoming elections in the fall. Both the widespread use of computers and the internet have fueled these privacy concerns.
- While Congress is unlikely to pass comprehensive privacy legislation this year, some lawmakers may try to attach privacy provisions to other bills moving through Congress.
- The Federal Trade Commission now supports new regulations for companies collecting personal data online, reversing its previous support for industry self-regulation. However, the Administration and Congress have been reluctant to embrace comprehensive privacy legislation.
1) Several state attorneys general, led by New York's Schneiderman, oppose an HHS rule expanding religious exemptions to contraceptive coverage, arguing it violates civil rights laws and will burden states financially.
2) Republican governors met with Pence to express concerns over proposed NAFTA changes that could affect manufacturing jobs in their states.
3) States are looking for ways to address workforce skills gaps and the lack of qualified job applicants, such as through apprenticeship programs and improving K-12 education.
American politics scholars study various aspects of the US political system including institutions, public opinion, and connections between politics and behavior. Currently, the US is facing a significant debt crisis as government spending exceeds tax revenue, requiring borrowing. Failure to raise the debt ceiling could result in default, which would have catastrophic economic effects in the US and globally. While politicians frequently debate solutions, effectively addressing the debt crisis requires both spending cuts and tax increases. The 2020 presidential election revealed deep divisions among Americans on many issues, and the emergence of "woke" politics has added further divisiveness.

3. With 15 candidates on the debate stage Sept. 16, divergent views
exceeded harmonious ones and kept businesses uncertain about
the implications of a Republican White House in 2017.
A few areas of consensus define the most likely policy shifts,
including increased defense and border spending, environmental
de-regulation, Obamacare repeal and, by the fact it wasn’t
debated, more limited financial reform. Still, the candidates differ
on approaches to taxation, China, the Iran Nuclear deal and
marijuana legalization.
5. Oil, natural gas and coal producers may see a more favorable
political climate under a Republican president.
Whether considering climate-change rules, the Keystone pipeline or
oil exports, the field of Republican candidates say they would reverse
course on many policies supported by President Barack Obama.
Other than a brief discussion of climate-change regulations toward
the end of the Sept. 16 Republican presidential debate, U.S. energy
and environmental policies were barely discussed.
6. Iran deal as target of GOP presidential hopefuls highlights risk
7. The second Republican presidential debate showed the
political risks companies face if they become early entrants in
a post-nuclear-deal Iran. With the exception of Ohio Governor
John Kasich, the party’s leading contenders said they would exit
the deal and reimpose sanctions if elected.
Renewing U.S. sanctions waived under the deal would raise the
specter of punitive fines and restricted access to the U.S. banking
system for global energy and financial-services companies that
have invested in Iran.
9. Private-equity and hedge-fund managers may face a $17.7 billion
tax increase over 10 years on their carried interest income whether
a Democrat or a Republican becomes president in 2017.
Donald Trump, currently the leading Republican presidential
candidate, repeated his support for raising taxes on carried
interest during the Sept. 16 Republican debate.
Republican candidate Jeb Bush and three out of five Democratic
candidates, including Hillary Clinton, have also said they support
such a tax increase.
12. Dodd-Frank repeal remains an important topic for Republican
presidential candidates despite limited mentions in the party’s second
debate.
Several candidates, including Senators Marco Rubio and Lindsey
Graham, have said they would repeal or tweak the financial regulation.
Candidates are concerned with the rule’s impact on small community
banks and access for small business capital.
While no one pushed a proposal during the Sept. 16 debate,
candidates may announce more specific policies as campaigns
progress.
14. The 11 candidates in the second major Republican presidential debate
have expressed support for repealing the Affordable Care Act in its
entirety, though only a few have offered specific replacement plans.
An issue that wasn’t discussed in the Sept. 16 debate -- prescription
drug prices -- could very well surface as a topic in the first Democratic
debate on Oct. 13, as candidate Bernie Sanders supports legislation
giving the federal government price-negotiation authority for
Medicare’s prescription drug program.
16. Republican presidential candidates continued emphasizing the need
for increased spending on border security, drones and fingerprinting
technology during their Sept. 16 debate.
The high cost of deporting undocumented immigrants and building
a wall would likely temper proposals for a large influx of spending on
a border wall or high-tech surveillance.
Contractors with existing border-surveillance and electronic-
verification projects could gain incremental revenue from a
Republican White House win in 2016.
