Mandatory Arrests for Domestic Violence Do More Harm than Good
Domestic violence, or intimate partner violence, is a common problem. As a result, the criminal justice
adapted to demands, especially from feminists, who bemoaned the poor response of police, and in
turn, the justice system by instituting mandatory arrests. However, mandatory arrests have proven that
just like protection or restraining orders, they are not effective in deterring domestic violence (Davis,
2008). Similarly, the arrests do not have a substantial effect on recidivism and create undue procedural
complications for the criminal system (Zelcer, 2014). On the contrary, proponents of the approach,
argue that it has a deterrent effect on the perpetrators and that it can even protect offer immediate
protection for the victims (Clark, 2010). Nonetheless, using statistical evidence and arguments from
scholarly sources, this position paper will expose the inefficiencies and constitutional inconsistencies

My entire baseball career I had dreamed of playing for my high school, but now that dream was in
jeopardy. I had been playing baseball since I was eligible back in 1st grade. I was never a spectacular
talent, I didn t hit home runs, I wasn t an ace pitcher, and I wasn t particularly fit. I was just average,
and I knew that. So when it came to trying out for the high school baseball team, I almost decided not
to. I wasn t worthy of being on that team. I had expressed this opinion to my friends and family, and
they didn t approve. However, eventually, they wore me down and convinced me to at least try out.
Reluctantly, I obliged, and when the time came, I signed up for tryouts and prepared myself for what I
expected to be the greatest disappointment of my life.
It was a three day tryout. Three days of grueling work on both the fundamentals and technicalities of
the game. Three days of knowing that they were going to cut me. 40 other young men surrounded me,
and they all wanted the same thing I did. People who I had played with my whole life. People who I

This stereotype generally depicts Native Americans as inherently violent and warlike people, who go

British soldiers were taking the women through the woods and the Huron war party viciously started

when the Hurons sentenced Major Hayward to be burned alive.4 This is an example of a human
sacrifice. Lastly, this stereotype is evident in the film when Magua rips out Grey Hair s, Captain
Munro s heart as revenge for the pain and suffering he caused him years before, when he was taken as
a slave by the Mohawks, lost his wife to another man, and his daughters being killed. Magua not only
wanted to rip out Captain Munro s heart as his was metaphorically, but he also want him to know that
he was planning on killing his daughters as well so his seed would forever be wiped from the earth.7 It

Harriet Beecher Stowe wrote Uncle Tom s Cabin in 1851 specifically to illustrate and highlight the
evils and inhumanity of slavery to American readers. Slavery, at the time, was a heated political issue

were revealed in the novel, Uncle Tom s Cabin, as she depicted the immoralities of slavery, the
suffering of slaves, and the destruction of the family unit. Stowe, through her writing, wanted to open
the eyes of southerners and gain their support for the abolishment of slavery in the South.
Many Americans objected to slavery and brought about efforts to put an end to it. In 1817 the
American Colonization Society was founded for the purpose of raising money to buy slaves from the
South and send them back to Africa. In 1833 William Lloyd Garrison and Arthur Tappan formed the
American Anti Slavery Society. (Carlson 1) Lyman Beecher, Harriet Beecher Stowe s father, was the
head teacher at Lane Seminary and supported colonization as a means to end slavery. Upon sharing his
thoughts opposing slavery with his students, they all dropped out and went to Oberlin College in a

influencing her life. His influence and strong views brought about her strong faith in christianity and

such as justice and praise. The word choice is direct and unambiguous. In my opinion Gorgias

transcend time. John Keegan s The Face of Battle, detailed the experiences of both battles from a
British perspective. Within that one hundred year span many facets of war changed, the tactics, the
machinery, the tools, the soldiers and the very cause of the battle itself. Despite the stark contrasts of
each, it was the similarities in experience and tactics that were truly striking. When analyzing both
battles careful, it became apparent the parallels of war despite time, location and societal factors.
