Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

3. § 1 Definition
Die Legaldefinition völkerrechtlicher Abkommen richtet sich in beiden Staaten nach dem
Wiener Übereinkommen über das Recht der Verträge (WÜV) vom 23. Mai 1969. Ein1
Vertrag ist demnach eine internationale Vereinbarung, grundsätzlich abgeschlossen in
Schriftform, zwischen zwei oder mehreren Völkerrechtssubjekten, durch welche diese
ihren übereinstimmenden Willen ausdrücken, dem Völkerrecht unterworfene
Verpflichtungen einzuhalten oder auf entsprechende Rechte zu verzichten. Nach2
herrschender Meinung ist hierbei die Formfreiheit ein charakteristisches Merkmal.3
Solche Vereinbarungen können folglich in einer oder mehreren zusammengehörigen
Urkunden enthalten sein und verschiedene Bezeichnungen haben.
Völkerrechtliche Verträge sind zu unterscheiden in bilaterale und multilaterale. Im
Völkerrecht spricht man von einem bilateralen Vertrag, wenn zwei Staaten involviert
sind. Folglich handelt es sich bei völkerrechtlichen Verträgen mit mehreren Parteien um
einen multilateralen Vertrag.
§ 2 Der Abschluss
Der Abschluss von völkerrechtlichen Verträgen ist ein Verfahren, in denen beide
Vertragsparteien einheitlich involviert sind. Diesen Prozess kann man nach
herrschender Meinung in Vertragsverhandlungen, Paraphierung und Unterzeichnung
untergliedern.
Die Aufnahme der Vertragsverhandlungen ist zugleich der Beginn des
Vertragsschlussverfahrens. In diesem Rahmen tauschen sich die Staaten entweder4
schriftlich mittels niedergelassenen Positionen, mündlich mit Hilfe von mit üblicherweise
von fachlichen Experten ausgestatteten Delegationen oder kurzfristig ad hoc

4. vereinbarten Treffen aus. In diesem Austausch wird die Ausformulierungen von
Themengebieten wie z. B. die Kompatibilität der Rechtssysteme der Länder mit
vertragsspezifischen Normen oder die optimale Form, mit der die Vereinbarung
festgehalten wird (Vertrag,etc.), besprochen. Organisationstechnische Gebiete wie5
beispielsweise der Umsetzungszeitplan werden auch behandelt. Die Berechtigung der
Teilnahme an Vertragsverhandlungen hat in der Türkei das Außenministerium (Dışişleri
Bakanlığı), mit der Voraussetzung, dass andere Ministerien, in deren Kompetenzgebiet
die Thematik der Verhandlungen einschlägig ist, gemäß Art. 65 der türkischen
Verfassung miteinbezogen werden und die Hoheitsrechte des Präsidenten unberührt
bleiben. In dem Fall, dass ein anderes Ministerium die Führung der Delegation ausübt,6
wird vorgesehen, dass das Außenministerium den Vertrag auf mögliche Verstöße
gegen die Verfassung oder sonstige Gesetze überprüft und sicherstellt, dass der
jeweilige Vertrag von völkerrechtlicher Bedeutung ist. Hierfür ist die juristische7
Abteilung (türk.: Hukuk Musavirligi) des Außenministeriums verantwortlich. Das
deutsche Grundgesetz sieht gemäß Art. 59 Abs. 1 S. 1 GG vor, dass der
Bundespräsident den Bund in völkerrechtlichen Angelegenheiten vertritt. Bei Verträgen,
die nicht an oberster Priorität stehen (z.B. Regierungsabkommen oder
Verwaltungsabkommen) können aber sachlich zuständige Ministerien mit der
Verantwortung beauftragt werden.
Bei der Paraphierung wird der Vertragstext durch verhandlungsbefugte Organe
vorläufig festgelegt. Dazu gehören die Ausformulierung der Übersetzungen und die8
Festlegung der Initialen. Es könnte nämlich abhängig von dem Recht in anderen
Ländern zu juristischen Konflikten kommen, z.B. ob im Namen des Landes mit oder
ohne den eigenen Namen unterschrieben wird. In der Türkei ist der Präsident für die
Praphierung verantwortlich. Er bevollmächtigt verantwortliche Individuen. Seine

Deutschland mit dem Bundespräsidenten.
Die Unterzeichnung der Verträge ist der finale Akt im Abschlussverfahren. Mit der
Unterzeichnung verkündet ein Staat sein Interesse an dem Vertrag und betont
konkludent seine Absicht Vertragspartei zu werden. Allein die Unterzeichnung ist noch9
nicht bindend. Mit ihr verpflichtet sich jedoch die Vertragspartei, dem Sinn und Zweck
des Vertrags nicht zuwiderzuhandeln (sog. Vereitelungsverbot), solange er nicht
ausdrücklich erklärt hat, doch nicht Vertragspartei werden zu wollen. In der Türkei10
vertritt der Präsident das Land als Oberbefehlshaber. Ausschließlich er besitzt die11
hoheitliche Berechtigung einzelne Individuen für die Unterzeichnung von
völkerrechtlichen Verträgen zu bevollmächtigen (sog. Abschlussvollmacht). Diese12
Bevollmächtigung muss nicht im Amtsblatt, der T.C. Resmî Gazete, veröffentlicht
werden. Oft wird die Vollmacht durch eine Vollmachtsurkunde mit13
Ratifikationsvorbehalt erteilt. Bei völkerrechtlichen Verträgen wird üblicherweise das
Außenministerium bevollmächtigt. In Frage kommende Individuen sind meistens14
gemäß Art. 7 Abs. 2 lit. b des WÜV Botschafter, welche wiederum auch durch den
Präsidenten ernannt werden. Die Verfassung der Türkei selbst sieht keine Bestimmung
zur Bevollmächtigung von bestimmten Personen für bestimmte Verträge vor. Jedoch15
bestraft das Gesetz diejenigen, die ohne eine Bevollmächtigung im Namen des
Präsidenten völkerrechtliche Verträge unterzeichnen. Für die Minister ohne
Bevollmächtigung werden in diesem Rahmen juristische, strafrechtliche und politische
Strafen vorgesehen.16
In Deutschland wird gem. Art. 59 Abs. 1 S. 2 GG der Bundespräsident vorrangig
beauftragt im Namen des Bundes Verträge mit auswärtigen Staaten zu Unterschreiben.

6. Jedoch auch in Deutschland ist die völkerrechtliche Abschlussbevollmächtigung die
übliche Art und Weise der Unterzeichnung. Üblicherweise dienen Diplomaten oder
sonstige hochrangige Beamten als sog. Unterhändler. Die Abschlussvollmacht wird
nicht im Amtsblatt veröffentlicht.
§ 3 Umsetzung in der Türkei
Der Prozess der Umsetzung völkerrechtlicher Verträge in der Türkei beginnt damit,
dass das Außenministerium den jeweiligen ausformulierten Vertrag dem Präsidenten
weiterleitet. Ohne obligatorische Stellungnahme wird daraufhin das Parlament
benachrichtigt. Im Parlament wird auf Wunsch des Präsidenten ein Hauptausschuss17
(türk.: esas komisyon), üblicherweise der Ausschuss für das Auswärtige, und ein oder
mehreren Fachausschüssen (türk.: tali komisyon), welche den Hauptausschuss
vertragsspezifische fachliche Beratung anbietet, beauftragt ein Gutachten zu erstellen.18
Der Hauptausschuss kann jedoch, falls der Fachausschuss keine Stellungnahme
nimmt, das Gutachten selbstständig verfassen. Vor der Volksabstimmung am 16. April19
2017 und den darauf folgenden Verordnungen nahmen bei den hierbei durchgeführten
Besprechungen auch stellvertretende Staatssekretäre teil. Anschließend erreicht der20
Vertrag mit dem dazugehörigen Gutachten und dem Zustimmungsgesetz das Plenum,
wo die jeweiligen Ausschüsse durch ein oder mehrere Sprecher repräsentiert werden.21
Der Vertrag wird als ganzes besprochen, die Veränderung oder Besprechung einzelner
Teile ist zu unterlassen. Zustimmungsgesetze können entweder mit oder ohne
Bedingungen verabschiedet oder abgelehnt werden. Nach der Verabschiedung des22

Das Original des Vertrages wird dem Außenministerium anvertraut.
Verträge, welche die Wirtschafts-, Handels- und technischen Beziehungen regeln und
deren Geltungsdauer ein Jahr nicht überschreitet, können durch ihre Verkündung in
Kraft gesetzt werden, wenn sie hinsichtlich der Staatsfinanzen keine Belastungen mit
sich bringen und den Personenstand und , welches durch das Verfassungsgericht
restriktiv ausgelegt wird, die Eigentumsrechte von Türken im Ausland nicht antasten.23 24
In diesem Fall werden diese Verträge innerhalb von zwei Monaten seit ihrer
Verkündung dem Parlament der Türkei zur Kenntnisnahme vorgelegt.25
Durchführungsverträge, welche auf einem völkerrechtlichen Vertrag beruhen, und die
Wirtschafts-, Handels-, technischen und Verwaltungsverträge, welche aufgrund einer
durch Gesetz erteilten Kompetenz abgeschlossen werden, bedürfen auch nicht einer
Zustimmung des Parlaments. Erwähnenswert ist jedoch an dieser Stelle, dass in der26
Realität somit z.B. Verteidigungsverträge, die auch unter den Begriff der
Durchführungsverträge subsumiert werden, ohne Verkündung in Kraft gesetzt werden.27
Hierdurch wird die Zugänglichkeit militärischer Vereinbarungen verhindert. Außerdem28
wurde im Jahr 2003 durch das Gesetz Nr. 4969 die Verkündungspflicht zum
Inkrafttreten einiger Garantie-, Kredit- und Schenkungsverträgen aufgehoben.
§ 4 Umsetzung in Deutschland
Die Umsetzung völkerrechtlicher Verträge in Deutschland erfolgt zunächst mit der
Weiterleitung des Vertrages an den Bundesrat. Anschließend leitet der Bundesrat den
Vertrag mit der dazugehörigen obligatorischen Stellungnahme an den Bundestag. Diese

8. Verträge werden im Anschluss in grundsätzlich zwei, nur auf Beschluss des
Bundestages in drei, Beratungen behandelt.29
Die erste Lesung befasst sich mit der Einteilung eines jeweils dafür zuständigen
Ausschusses. In der Regel wird bei völkerrechtlichen Verträgen der Ausschuss für30
auswärtige Angelegenheiten berufen. Die Ausschüsse können auf Antrag einen31
Unterausschuss einsetzen. Bei umfangreichen Sachkomplexen kann eine32
Enquete-Kommission eingesetzt werden, falls sie nicht auf Antrag eines viertels der
Mitglieder dazu verpflichtet wird.33
In der zweiten Lesung wird an Hand der fachlichen Stellungnahme des Ausschusses
abgestimmt. Änderungsanträge für diese Verträge sind nicht zugelassen. Anträge zur34
Änderung von Zustimmungsgesetzen, welche die innerstaatliche Zustimmung für einen
völkerrechtlichen Vertrag erteilen, sind jedoch gültig. Völkerrechtliche Verträge, die von
der Bundesregierung ausgehandelt werden und politische Beziehungen regeln oder
sich auf Gegenstände der Bundesgesetzgebung beziehen, bedürfen der Zustimmung
oder der Mitwirkung der für die Bundesgesetzgebung zuständigen Körperschaften
sowie eines Gesetzes. Damit sind nach der Rechtsprechung die Fälle gemeint, in35
denen im konkreten Fall ein Vollzugsakt unter Mitwirkung der gesetzgebenden
Körperschaft erforderlich ist. Das ist immer dann der Fall, wenn die entsprechende36
Materie bereits durch Gesetz geregelt ist, Rechte und Pflichten für den Einzelnen
begründet oder Bestimmungen enthält , deren Durchführung die Mitwirkung des37
formellen Bundes- oder Landesgesetzgebers erforderlich macht oder finanzielle
Verpflichtungen – über bloße haushaltsmäßige Auswirkungen hinaus – enthält, die nach
den finanzverfassungsrechtlichen Regelungen des Grundgesetzes eine gesetzliche
Regelung erfordern (vgl. Artikel 115 GG) oder einen bestehenden Vertrag, der

9. Gegenstand eines Vertragsgesetzes war, ändert oder ergänzt. Ein Zustimmungsgesetz
kann nur dann zustandekommen, wenn Bundesrat und Bundestag sich einig sind.
Gem. Art. 82 I GG wird dann das Zustimmungsgesetz vom Bundespräsidenten
ausgefertigt und mit dem dazugehörigen völkerrechtlichen Vertrag im
Bundesgesetzblatt Teil II verkündet.
§ 5 Gerichtliche Überprüfung von völkerrechtlichen Verträgen
in der Türkei
Art. 90 der TV ist der Grundbaustein der demokratischen Legitimation
vertragsrechtlicher Außenpolitik. Aus Abs. 5 S. 2 Art. 90 TV ergibt sich, dass gegen
völkerrechtliche Verträge das Verfassungsgericht mit der Behauptung der
Verfassungswidrigkeit nicht angerufen werden kann. Dieser Artikel hat zur Folge, dass
das Parlament im Rahmen der Ratifizierung eine sehr bedeutsame Position erlangt und
sowohl konkrete als auch abstrakte Normenkontrollverfahren durch das
Verfassungsgericht ausgeschlossen werden. Zurückzuführen ist diese Entscheidung
zur Verfassung von 1961, wo der Ausschuss der Nationalen Einheit (türk.: Milli Birlik
Komitesi) diese Änderung, obwohl die damalige Verfassungskommission ihre Bedenken
äußerte, als Art. 65 der Verfassung festhielt. Dieses Überprüfungsverbot wurde von der
Verfassung von 1982 folglich als Art. 90 Abs. 1 S. 1 TV übernommen.38
§ 6 Gerichtliche Überprüfung von völkerrechtlichen Verträgen
in Deutschland
Dem Überprüfen von völkerrechtliche Verträgen auf ihre verfassungsmäßigkeit in
Deutschland hindern keine gesetzlichen Vorschriften. Das Verfassungsgericht kann

10. von den beteiligten Staatsorganen, u.U. aber auch von einzelnen Bürgern angerufen
werden. Falls z.B. ein Bundesland sich weigert Vorschriften völkerrechtlicher Verträge
in Landesrecht umzusetzen, können in Bezug auf die Frage der Umsetzungspflicht
mittels des Bundesverfassungsgerichts (BVerfG) verfassungsprozessuale Verfahren
eingeleitet werden. Dieses Verfahren, auch Bund-Länder-Streit genannt, richtet sich
nach den Art. 93 Abs. 1 Nr. 3 GG und den §§ 13 Nr. 7, 68 ff. BVerfGG. Der Antrag des
Bundeslandes muss sowohl Zulässig als auch Begründet sein, um Aussicht auf Erfolg
zu haben. Hinsichtlich einer spezifischen Norm in einem völkerrechtlichen Vertrag39
besteht die Möglichkeit der abstrakten Normenkontrolle gemäß Art. 93 Abs. 1 Nr. 2 bzw.
2a GG.40

11. § 7 Vergleichendes Endergebnis
Der Abschluss von Verträgen in beiden Ländern richtet sich sekundär nach dem WÜV
und primär nach den innerstaatlichen gesetzlichen Vorgaben hinsichtlich der
Berechtigung von Individuen oder Institutionen. Es ist festzuhalten, dass in beiden
Ländern die Staatsoberhäupter von der Verfassung legitimiert sind völkerrechtliche
Verträge sowohl eigenhändig abzuschließen als auch für sämtliche Prozesse im
Abschlussverfahren die benötigte Vollmacht zu erteilen.41
Sowohl Deutschland als auch die Türkei haben eine in der Verfassung verankerte
Zustimmungspflichtigkeit hinsichtlich bestimmter Verträge. Diese
Zustimmungspflichtigkeit gehört zum Konzept der demokratisch-legitimierten,
parlamentarischen Kontrolle der Regierung (sog. Kontrollfunktion) und zur erkennbar
intendierten Einordnung eines Landes als vertragstreuer Akteur im internationalen
Kontext (sog. Vollzugssicherungsfunktion).42
Das Normenkontrollverfahren in beiden Ländern ist zu unterscheiden. In Deutschland
finden sowohl konkrete als auch abstrakte Normenkontrollverfahren Anwendung. In der
Türkei verbietet jedoch der Art. 90 Abs. 5 S. 1 TV die Überprüfung völkerrechtlicher
Verträge auf die Konformität mit der Verfassung.
