3. WHAT IS HIPAA?
HIPAA is the Health Insurance Information Portability and Accountability
Act, and was signed into law by President Clinton in 1996.
HIPAA was enacted in order to provide protection for electronic patient health
information stored by covered entities.
A covered entity can be:
-A healthcareprovider: Physician, Podiatrist, Chiropractor, Psychologist, etc.
- A health plan: Insurance companies, HMOs, Corporate Health
Plans, Medicare & Medicaid.
- A Healthcare clearinghouse that handles electronic medical records

4. Privacy Rule vs. Security Rule
There are two chief regulations that stem from the HIPAA Act: the Privacy Rule
and the Security Rule.
The Privacy Rule safeguards patient information while permitting “the
disclosure of personal health information [to the appropriate parties] needed for
patient care” (Center for Medicare and Medicaid Services „CMS‟).
The Security Rule dictates “administrative, physical and technical safeguards”
that must be put into place by „covered entities‟ to ensure the
confidentiality, integrity, and prompt availability of electronically stored patient
health information (CMS).
The Privacy and Security Rules apply to ALL COVERED ENTITIES.
