Objective
● Duty exemption schemes enable duty free import of inputs required for export
production. An Advance License is issued as a duty exemption scheme. A Duty
Remission Scheme enables post export replenishment/ remission of duty on
inputs used in the export product.
Schemes
Duty remission schemes consist of
(a) DFIA (Duty Free Import Authorisation Scheme)
(b) DEPB ( Duty Entitlement Passbook Scheme)
● DFIA permits duty free replenishment of inputs used in the export product.
● DEPB allows drawback of import charges on inputs used in the export product.

Advance Authorisation
● Duty Free import of inputs allowed for exports.
● Minimum 15% value addition to be achieved.
● Exports/Imports to be completed in 24 months.
● Bond / BG / LUT to be given to the Custom Authorities.

Advance Authorisation
● Advance License indicates description of export items, quantity of export item,
FOB value of exports, description of import items, quantity of import items and
CIF value of imports.
● Import of inputs exempted from Basic Customs duty, Additional Customs duty
and Safeguard/Anti-dumping duty.

Annual Advance
Authorisation
● Available only to status holders and exporters with 2 years exports.
● Entitlement equivalent to 300% of the FOB value or Rs 1 crore ,whichever more
in preceding year.
● Authorisation valid for 24 months imp/ exports.

● Licence only mentions the export product group, CIF value and FOB value.
● Licence holder can export any product falling under the product group including
items for which norms do not exist.
● Only one licence for one product group or port of registration.

Export obligation
Export obligation
● Period for fulfillment of export obligation under Advance Authorisation shall be 18
months from the date of issue of Authorisation. Period of EO fulfillment under an Advance
Authorisation shall commence from date of issue of Authorisation, unless otherwise
specified.
● In cases of supplies to projects in India under Chapter-7 of FTP or projects abroad, the
Export Obligation period shall be coterminous with contracted duration of the project
execution or 18 months whichever is more.
● Export Obligation for items falling in categories of defence, military store, aerospace and
nuclear energy shall be 24 months from the date of issue of authorization or co-terminus
with contracted durationofthe export orderwhichever is more.
DUTY FREE IMPORT
AUTHORISATION
DUTY FREE REPLENISHMENT
CERTIFICATE
Duty Free Replenishment Certificate (DFRC) is issued to a merchant-exporter
or manufacturer-exporter for the import of inputs used in the manufacture of
goods without payment of Basic Customs Duty and Special Additional Duty.
However, such inputs shall be subject to the payment of Additional Customs
Duty equal to the Excise Duty at the time of import.
Duty Free Import
Authorisation
● New Scheme effective from 1st May,2006
● Duty Free Import Authorisation or DFIA in short is issued to allow duty free
import of inputs which are used in the manufacture of the export product
(making normal allowance for wastage), and fuel, energy, catalyst etc. which are
consumed or utilised in the course of their use to obtain the export product.
● Exporter allowed to import inputs free of Basic Customs and or Additional /SAD
duty.
● DFIA indicates names and quantity of the raw-material to be allowed duty free.
Duty Free Import
Authorisation
● DFIA and/or material imported under it transferable after completing EO.
● Minimum value addition of 20% required.
● Scheme covers only products for which Standard Input Output Norms exist.
● Additional Customs duty is refunded through CENVAT or drawback in case of
transferability.
● CENVAT permitted under the scheme.
Eligibility
● Duty Free Import Authorisation shall be issued on post export basis for
products for which Standard Input Output Norms(SION) have been notified.
● Merchant Exporter shall be required to mention name and address of
supporting manufacturer of the export product on the export document viz.
Shipping Bill / Airway Bill / Bill of Export / ARE-1 / ARE-3.
● Application is to be filed with concerned Regional Authority before effecting
export under Duty Free Import Authorisation.
Validity & Transferability of DFIA
● Applicant shall file online application to Regional Authority concerned before
starting export under DFIA.
● Export shall be completed within 12 months from the date of online filing of
application and generation of file number.
● Separate DFIA shall be issued for each SION and each port.
● Exports under DFIA shall be made from a single port .

Meaning of DEPS
● It is an export incentive scheme of Indian Government provided to exporters in
India.
● It is issued after export, at a predetermined credit on the FOB value.
● It came into existence on 01/04/1997, then it had both pre-export and post-
export DEPB. The latter is abolished on 01/04/2000.

Scheme Overview
● DEPB scheme comprised two parts namely the post-export and pre-export of
DEPB. However, pre-export was eliminated from 01.04.2000.
● Post-export is issued after the exports, where the exporter is given a duty
entitlement Pass Book Scheme at a predetermined credit on the FOB value.
● The DEPB rates permit the import of any items except the items that are
prohibited from importing. Items like Gold Nibs, Gold Pen, Gold watches etc.

DEPB Rates
● The DEPB rates are applicable based on FOB value or the value cap, whichever
is the least. If an item’s FOB value is Rs. 700, and the cap value is Rs. 500, the
DEPB rate shall be applied on Rs. 500.
Benefits of DEPB Rates
● The benefit of the DEPB scheme shall be available on the exported products that
are having an extraneous material up to 5% by weight.

Review of DEPB Rates
● The Government of India reviews the DEPB
rates after receiving the appropriate export
import data on the FOB value of exports and
the CIF value of inputs that are used in the
export product as per SION. This data and
information have to be obtained from the
concerned Export Promotion Councils.

Implementation of DEPB Rates
● DEPB rates are rationalized to the account for
the changes in the customs duties.
● The caps are fixed on certain items but there
would be no verification of Present Market
Value(PMV) on these items.
● A number of ports have been added in order to
avail the facilities under the Duty
Exemption Scheme, including the DEPB.
● The threshold limit of Rs. 200 million to fix new
DEPB rates have been removed.

Provisional DEPB Rate
● The purpose of provisional DEPB rates is to encourage the diversification and to
promote the export of new products. However, the provisional DEPB rates are
valid only for a limited period of time when the exporter has to furnish data on
export and import for regular fixation of rates.

The credit under DEPB and Present Market Value
● For products that have a rate of credit entitlement under DEPB
scheme comes to 10% or more, the amount of credit against
each such export product does not exceed 50% of the present
Market Value (PMV) of the export product. At the time of
export, the exporter declares a shipping bill that benefits under
the DEPB scheme that does not exceed 50% of PMV of the
export product. Nevertheless, the PMV declaration will not be
applicable to products that have value cap irrespective of DEPB
rate of the product.
Utilization of DEPB Credit
● The credit given under the DEPB scheme is utilized for payment
of Indian customs duty including the capital goods that are free
to import.

Re-export of Goods Imported under DEPB Scheme
● As per the Exim guidelines by the Department of Revenue, exported goods that
are returned and are found to be defective or unfit for use shall again be
exported. In cases like this, 98% of the credit amount that is debited against
DEPB for the export of goods. This is generated by the concerned Commissioner
of Customs in the form of a certificate that contains the amount generated and
the details of the original DEPB. A new DEPB is issued by the concerned DGFT
Regional Authority. The issued DEPB has to have the same port of registration
and should be valid for a period that is equivalent to the balance period that is
available on the date of import of the defective or unfit goods.

ADVANCE PROCUREMENT/
REPLENISHMENT OF PRECIOUS METALS
FROM NOMINATED AGENCIES
● Exporter of gold / silver / platinum jewellery and
articles thereof including mountings and findings may
obtain gold / silver / platinum as an input for export
product from Nominated Agency, in advance or as
replenishment after export in accordance with the
procedure specified in this behalf.
REPLENISHMENT
AUTHORISATION
FOR GEMS
● Exporter may obtain Replenishment Authorisation for
Gems from Regional Authority in accordance with
procedure specified in Handbook of Procedures.
● Replenishment Authorisation for Gems may be issued
against export including that made against supply by
Nominated Agency and against supply by foreign buyer.
● In case of plain or studded gold / silver / platinum
jewellery and articles, value of such Authorisation
shall be determined with reference to realisation
in excess of prescribed minimum value addition.
● The nominated agencies are MMTC Ltd, Handicraft
and Handloom Export Corporation (HHEC), State
Trading Corporation (STC), the Project and
Equipment Corporation of India Ltd (PEC) , and any
agency or Five Star Export House authorised by
Reserve Bank of India (RBI).
REPLENISHMENT
AUTHORISATION FOR
CONSUMABLES
● Replenishment authorization for duty free import of Consumables,
Tools and other items namely, Tags and labels, Security sensor on
card, Staple wire, Poly bag (as notified by Customs) for Jewellery
made out of precious metals (other than Gold & Platinum) equal to
2% and for Cut and Polished Diamonds and Jewellery made out of
Gold and Platinum equal to 1% of FOB value of exports of the
preceding year, may be issued on production of Chartered
Accountant Certificate indicating the export performance.
● However, in case of Rhodium finished
Silver jewellery, entitlement will be 3% of
FOB value of exports of such jewellery.
This Authorisation shall be non-
transferable and subject to actual user
condition.
ADVANCE AUTHORISATION
FOR PRECIOUS METALS.
Advance Authorisation shall be granted on pre- import basis with ‘Actual
User’ condition for duty free import of:-
1.Gold of fineness not less than 0.995 and mountings, sockets, frames and
findings of 8 carats and above.
2.Silver of fineness not less than 0.995 and mountings, sockets, frames and
findings containing more than 50% silver by weight.
3.Platinum of fineness not less than 0.900 and mountings, sockets, frames and
findings containing more than 50% platinum by weight.
IMPORTANT POINTS
● Duty Free Import Authorisation scheme shall not be available for
Gems and Jewellery sector.
● Exporters may obtain gold / silver / platinum from Nominated
Agency.
● Exporter in EOU and units in SEZ would be governed by the
respective provisions of Chapter-6 of FTP / SEZ Rules, respectively.
● Nominated Agencies are MMTC Ltd, The Handicraft and
Handlooms Exports Corporation of India Ltd, The State Trading
Corporation of India Ltd, PEC Ltd, STCL Ltd, MSTC Ltd, and
Diamond India Limited.
● Four Star Export House from Gems & Jewellery sector and Five
Star Export House from any sector may be recognized as
Nominated Agency by Regional Authority.
● Reserve Bank of India can authorize any bank as Nominated
Agency.
● Procedure for import of precious metal by Nominated Agency
(other than those authorized by Reserve Bank of India and the
Gems & Jewellery units operating under EOU and SEZ schemes)
and the monitoring mechanism thereof shall be as per the
provisions laid down in Handbook of Procedures.
● A bank authorised by Reserve Bank of India is allowed export of
gold scrap for refining and import standard gold bars as per
Reserve Bank of India guidelines.
● An exporter (with annual export turnover of Rs 5 crores for each
of the last three years) may export cut & polished diamonds
(each of 0.25 carat or above) to any of the agencies/laboratories
mentioned under paragraph 4.74 of Handbook of Procedures
with re- import facility at zero duty within 3 months from the
date of export. Such facility of re-import at zero duty will be
subject to guidelines issued by Central Board of Customs &
Excise, Department of Revenue.
● Export of jewellery through Foreign Post Office including via
Speed Post is allowed. The jewellery parcel shall not exceed
20 kgs by weight.
● Private / Public Bonded Warehouses may be set up in
SEZ/DTA for import and re-export of cut and polished
diamonds, cut and polished coloured gemstones, uncut &
unset precious & semi-precious stones, subject to
achievement of minimum value addition of 5% by DTA units.

EPCG
Scheme
EPCG Scheme allows import of capital goods for
pre-production, production and post-production at
Zero customs duty. Alternatively, the Authorization
holder may also procure Capital Goods from
indigenous sources.
EPCG scheme shall include:
(i) Capital Goods including in CKD/SKD
condition
(ii) Computer software systems;
(iii) Spares, moulds, dies, jigs, fixtures,
tools & refractories for initial lining and spare
refractories and Catalysts for initial charge

▪ Import of capital goods for Project Imports notified by
Central Board of Excise and Customs is also permitted
under EPCG Scheme.
▪ Import under EPCG Scheme shall be subject to an export
obligation equivalent to 6 times of duty saved on capital
goods, to be fulfilled in 6 years reckoned from date of
issue of Authorization.
▪ Authorization shall be valid for import for 9 months from
the date of issue. Revalidation of EPCG Authorization
shall not be permitted.
▪ Second hand capital goods shall not be permitted to be
imported under EPCG Scheme.
▪ EPCG scheme covers manufacturer exporters with or
without supporting manufacturer , merchant exporters
tied to supporting manufacturer and service providers.
DEEMED EXPORTS
OBJECTIVE
To provide a level-playing field to domestic manufacturers in certain
specified cases, as may be decided by the Government from time to time.

EXPORTS
“Deemed Exports” refer to those
transactions in which goods
supplied do not leave country,
and payment for such supplies is
received either in Indian rupees
or in free foreign exchange.
CATEGORIES OF SUPPLY
Supply of goods under following categories (a) to (d) by a
manufacturer and under categories (e) to (h) by main /
sub-contractors shall be regarded as “Deemed Exports”
BENEFITS FOR
DEEMED EXPORTS
Deemed exports shall be eligible for any / all of following benefits in respect of
manufacture and supply of goods, qualifying as deemed exports,
1.Advance Authorisation / Advance Authorisation for annual requirement /
DFIA.
2.Deemed Export Drawback.
3.Refund of terminal excise duty, if exemption is not available.

  • 2. Content ● Objective ● Advance Authorization ● Export obligation ● Duty Free Import Authorization ● Schemes for exports of Gems & Jewellery ● EPCG 2
  • 3. Objective ● Duty exemption schemes enable duty free import of inputs required for export production. An Advance License is issued as a duty exemption scheme. A Duty Remission Scheme enables post export replenishment/ remission of duty on inputs used in the export product.
  • 4. Schemes Duty remission schemes consist of (a) DFIA (Duty Free Import Authorisation Scheme) (b) DEPB ( Duty Entitlement Passbook Scheme) ● DFIA permits duty free replenishment of inputs used in the export product. ● DEPB allows drawback of import charges on inputs used in the export product.
  • 6. Advance Authorisation ● Duty Free import of inputs allowed for exports. ● Minimum 15% value addition to be achieved. ● Exports/Imports to be completed in 24 months. ● Bond / BG / LUT to be given to the Custom Authorities. 6
  • 7. Advance Authorisation ● Advance License indicates description of export items, quantity of export item, FOB value of exports, description of import items, quantity of import items and CIF value of imports. ● Import of inputs exempted from Basic Customs duty, Additional Customs duty and Safeguard/Anti-dumping duty. 7
  • 8. Annual Advance Authorisation ● Available only to status holders and exporters with 2 years exports. ● Entitlement equivalent to 300% of the FOB value or Rs 1 crore ,whichever more in preceding year. ● Authorisation valid for 24 months imp/ exports. 8
  • 9. Annual Advance Authorisation ● Licence only mentions the export product group, CIF value and FOB value. ● Licence holder can export any product falling under the product group including items for which norms do not exist. ● Only one licence for one product group or port of registration. 9
  • 11. Export obligation ● Period for fulfillment of export obligation under Advance Authorisation shall be 18 months from the date of issue of Authorisation. Period of EO fulfillment under an Advance Authorisation shall commence from date of issue of Authorisation, unless otherwise specified. ● In cases of supplies to projects in India under Chapter-7 of FTP or projects abroad, the Export Obligation period shall be coterminous with contracted duration of the project execution or 18 months whichever is more. ● Export Obligation for items falling in categories of defence, military store, aerospace and nuclear energy shall be 24 months from the date of issue of authorization or co-terminus with contracted durationofthe export orderwhichever is more.
  • 13. DUTY FREE REPLENISHMENT CERTIFICATE Duty Free Replenishment Certificate (DFRC) is issued to a merchant-exporter or manufacturer-exporter for the import of inputs used in the manufacture of goods without payment of Basic Customs Duty and Special Additional Duty. However, such inputs shall be subject to the payment of Additional Customs Duty equal to the Excise Duty at the time of import.
  • 14. Duty Free Import Authorisation ● New Scheme effective from 1st May,2006 ● Duty Free Import Authorisation or DFIA in short is issued to allow duty free import of inputs which are used in the manufacture of the export product (making normal allowance for wastage), and fuel, energy, catalyst etc. which are consumed or utilised in the course of their use to obtain the export product. ● Exporter allowed to import inputs free of Basic Customs and or Additional /SAD duty. ● DFIA indicates names and quantity of the raw-material to be allowed duty free.
  • 15. Duty Free Import Authorisation ● DFIA and/or material imported under it transferable after completing EO. ● Minimum value addition of 20% required. ● Scheme covers only products for which Standard Input Output Norms exist. ● Additional Customs duty is refunded through CENVAT or drawback in case of transferability. ● CENVAT permitted under the scheme.
  • 16. Eligibility ● Duty Free Import Authorisation shall be issued on post export basis for products for which Standard Input Output Norms(SION) have been notified. ● Merchant Exporter shall be required to mention name and address of supporting manufacturer of the export product on the export document viz. Shipping Bill / Airway Bill / Bill of Export / ARE-1 / ARE-3. ● Application is to be filed with concerned Regional Authority before effecting export under Duty Free Import Authorisation.
  • 17. Validity & Transferability of DFIA ● Applicant shall file online application to Regional Authority concerned before starting export under DFIA. ● Export shall be completed within 12 months from the date of online filing of application and generation of file number. ● Separate DFIA shall be issued for each SION and each port. ● Exports under DFIA shall be made from a single port .
  • 19. Meaning of DEPS ● It is an export incentive scheme of Indian Government provided to exporters in India. ● It is issued after export, at a predetermined credit on the FOB value. ● It came into existence on 01/04/1997, then it had both pre-export and post- export DEPB. The latter is abolished on 01/04/2000.
  • 20. Duty Entitlement Passbook Scheme Scheme Overview ● DEPB scheme comprised two parts namely the post-export and pre-export of DEPB. However, pre-export was eliminated from 01.04.2000. ● Post-export is issued after the exports, where the exporter is given a duty entitlement Pass Book Scheme at a predetermined credit on the FOB value. ● The DEPB rates permit the import of any items except the items that are prohibited from importing. Items like Gold Nibs, Gold Pen, Gold watches etc.
  • 21. Duty Entitlement Passbook Scheme DEPB Rates ● The DEPB rates are applicable based on FOB value or the value cap, whichever is the least. If an item’s FOB value is Rs. 700, and the cap value is Rs. 500, the DEPB rate shall be applied on Rs. 500. Benefits of DEPB Rates ● The benefit of the DEPB scheme shall be available on the exported products that are having an extraneous material up to 5% by weight.
  • 22. Duty Entitlement Passbook Scheme Review of DEPB Rates ● The Government of India reviews the DEPB rates after receiving the appropriate export import data on the FOB value of exports and the CIF value of inputs that are used in the export product as per SION. This data and information have to be obtained from the concerned Export Promotion Councils.
  • 23. Duty Entitlement Passbook Scheme Implementation of DEPB Rates ● DEPB rates are rationalized to the account for the changes in the customs duties. ● The caps are fixed on certain items but there would be no verification of Present Market Value(PMV) on these items. ● A number of ports have been added in order to avail the facilities under the Duty Exemption Scheme, including the DEPB. ● The threshold limit of Rs. 200 million to fix new DEPB rates have been removed.
  • 24. Duty Entitlement Passbook Scheme Provisional DEPB Rate ● The purpose of provisional DEPB rates is to encourage the diversification and to promote the export of new products. However, the provisional DEPB rates are valid only for a limited period of time when the exporter has to furnish data on export and import for regular fixation of rates.

Duty Entitlement Passbook Scheme The credit under DEPB and Present Market Value ● For products that have a rate of credit entitlement under DEPB scheme comes to 10% or more, the amount of credit against each such export product does not exceed 50% of the present Market Value (PMV) of the export product. At the time of export, the exporter declares a shipping bill that benefits under the DEPB scheme that does not exceed 50% of PMV of the export product. Nevertheless, the PMV declaration will not be applicable to products that have value cap irrespective of DEPB rate of the product. Utilization of DEPB Credit ● The credit given under the DEPB scheme is utilized for payment of Indian customs duty including the capital goods that are free to import.

Duty Entitlement Passbook Scheme Re-export of Goods Imported under DEPB Scheme ● As per the Exim guidelines by the Department of Revenue, exported goods that are returned and are found to be defective or unfit for use shall again be exported. In cases like this, 98% of the credit amount that is debited against DEPB for the export of goods. This is generated by the concerned Commissioner of Customs in the form of a certificate that contains the amount generated and the details of the original DEPB. A new DEPB is issued by the concerned DGFT Regional Authority. The issued DEPB has to have the same port of registration and should be valid for a period that is equivalent to the balance period that is available on the date of import of the defective or unfit goods.

ADVANCE PROCUREMENT/ REPLENISHMENT OF PRECIOUS METALS FROM NOMINATED AGENCIES ● Exporter of gold / silver / platinum jewellery and articles thereof including mountings and findings may obtain gold / silver / platinum as an input for export product from Nominated Agency, in advance or as replenishment after export in accordance with the procedure specified in this behalf.

REPLENISHMENT AUTHORISATION FOR GEMS ● Exporter may obtain Replenishment Authorisation for Gems from Regional Authority in accordance with procedure specified in Handbook of Procedures. ● Replenishment Authorisation for Gems may be issued against export including that made against supply by Nominated Agency and against supply by foreign buyer.
  • 31. ● In case of plain or studded gold / silver / platinum jewellery and articles, value of such Authorisation shall be determined with reference to realisation in excess of prescribed minimum value addition. ● The nominated agencies are MMTC Ltd, Handicraft and Handloom Export Corporation (HHEC), State Trading Corporation (STC), the Project and Equipment Corporation of India Ltd (PEC) , and any agency or Five Star Export House authorised by Reserve Bank of India (RBI).

REPLENISHMENT AUTHORISATION FOR CONSUMABLES ● Replenishment authorization for duty free import of Consumables, Tools and other items namely, Tags and labels, Security sensor on card, Staple wire, Poly bag (as notified by Customs) for Jewellery made out of precious metals (other than Gold & Platinum) equal to 2% and for Cut and Polished Diamonds and Jewellery made out of Gold and Platinum equal to 1% of FOB value of exports of the preceding year, may be issued on production of Chartered Accountant Certificate indicating the export performance.
  • 33. ● However, in case of Rhodium finished Silver jewellery, entitlement will be 3% of FOB value of exports of such jewellery. This Authorisation shall be non- transferable and subject to actual user condition.
  • 34. ADVANCE AUTHORISATION FOR PRECIOUS METALS. Advance Authorisation shall be granted on pre- import basis with ‘Actual User’ condition for duty free import of:- 1.Gold of fineness not less than 0.995 and mountings, sockets, frames and findings of 8 carats and above. 2.Silver of fineness not less than 0.995 and mountings, sockets, frames and findings containing more than 50% silver by weight. 3.Platinum of fineness not less than 0.900 and mountings, sockets, frames and findings containing more than 50% platinum by weight.

IMPORTANT POINTS ● Duty Free Import Authorisation scheme shall not be available for Gems and Jewellery sector. ● Exporters may obtain gold / silver / platinum from Nominated Agency. ● Exporter in EOU and units in SEZ would be governed by the respective provisions of Chapter-6 of FTP / SEZ Rules, respectively. ● Nominated Agencies are MMTC Ltd, The Handicraft and Handlooms Exports Corporation of India Ltd, The State Trading Corporation of India Ltd, PEC Ltd, STCL Ltd, MSTC Ltd, and Diamond India Limited.
  • 36. ● Four Star Export House from Gems & Jewellery sector and Five Star Export House from any sector may be recognized as Nominated Agency by Regional Authority. ● Reserve Bank of India can authorize any bank as Nominated Agency. ● Procedure for import of precious metal by Nominated Agency (other than those authorized by Reserve Bank of India and the Gems & Jewellery units operating under EOU and SEZ schemes) and the monitoring mechanism thereof shall be as per the provisions laid down in Handbook of Procedures.
  • 37. ● A bank authorised by Reserve Bank of India is allowed export of gold scrap for refining and import standard gold bars as per Reserve Bank of India guidelines. ● An exporter (with annual export turnover of Rs 5 crores for each of the last three years) may export cut & polished diamonds (each of 0.25 carat or above) to any of the agencies/laboratories mentioned under paragraph 4.74 of Handbook of Procedures with re- import facility at zero duty within 3 months from the date of export. Such facility of re-import at zero duty will be subject to guidelines issued by Central Board of Customs & Excise, Department of Revenue.
  • 38. ● Export of jewellery through Foreign Post Office including via Speed Post is allowed. The jewellery parcel shall not exceed 20 kgs by weight. ● Private / Public Bonded Warehouses may be set up in SEZ/DTA for import and re-export of cut and polished diamonds, cut and polished coloured gemstones, uncut & unset precious & semi-precious stones, subject to achievement of minimum value addition of 5% by DTA units.
  • 40. EPCG Scheme EPCG Scheme allows import of capital goods for pre-production, production and post-production at Zero customs duty. Alternatively, the Authorization holder may also procure Capital Goods from indigenous sources. EPCG scheme shall include: (i) Capital Goods including in CKD/SKD condition (ii) Computer software systems; (iii) Spares, moulds, dies, jigs, fixtures, tools & refractories for initial lining and spare refractories and Catalysts for initial charge

Export Promotion Capital Goods ▪ Import of capital goods for Project Imports notified by Central Board of Excise and Customs is also permitted under EPCG Scheme. ▪ Import under EPCG Scheme shall be subject to an export obligation equivalent to 6 times of duty saved on capital goods, to be fulfilled in 6 years reckoned from date of issue of Authorization. ▪ Authorization shall be valid for import for 9 months from the date of issue. Revalidation of EPCG Authorization shall not be permitted. ▪ Second hand capital goods shall not be permitted to be imported under EPCG Scheme. ▪ EPCG scheme covers manufacturer exporters with or without supporting manufacturer , merchant exporters tied to supporting manufacturer and service providers.
  • 43. OBJECTIVE To provide a level-playing field to domestic manufacturers in certain specified cases, as may be decided by the Government from time to time.
  • 44. DEEMED EXPORTS “Deemed Exports” refer to those transactions in which goods supplied do not leave country, and payment for such supplies is received either in Indian rupees or in free foreign exchange.
  • 45. CATEGORIES OF SUPPLY Supply of goods under following categories (a) to (d) by a manufacturer and under categories (e) to (h) by main / sub-contractors shall be regarded as “Deemed Exports”

BENEFITS FOR DEEMED EXPORTS Deemed exports shall be eligible for any / all of following benefits in respect of manufacture and supply of goods, qualifying as deemed exports, 1.Advance Authorisation / Advance Authorisation for annual requirement / DFIA. 2.Deemed Export Drawback. 3.Refund of terminal excise duty, if exemption is not available.
