3. Introduction
•The drug and cosmetic Act and the rules there under provide
for the import of drug and cosmetics.
•IMPORT- Bring (goods or services) into a country from
abroad for sale.
DRUG- A medicine or other substance which has a
physiological effect when ingested or otherwise introduced
into the body.
•COSMETICS-A preparation applied to the body, especially
the face, to improve its appearance. The range covers
everything from the latest cosmetics to skin and hair care
•
4. Standard quality.
• Standard quality in relation to a drug means the drug
complies with the standard set, and in relation to a
cosmetic that the cosmetic complies with such standard
as may be prescribed.
5. Misbranded drugs.
1. If it is so coloured, coated powdered or polished that
damage is concealed.
2. If it is not labelled in the prescribed manner.
3. If its label or container.
6. Adulterated drugs.
A drug is deemed to be adulterated-
1. If it consist in whole or in part, of any decomposed
substance.
2. If it has been prepared, packed conditions where by it
may have been rendered injurious to health.
3. If the container is composed in part of any poisonous
substance.
4. If any has been mixed there with so as to reduce its
quality.
7. Spurious drugs.
1. If it is imported (manufactured in relation to
manufacture, sale and distribution of drugs)under a
name which belongs to another drugs,
2. if it limitation has been substituted in part by any
drugs or substance resemble another drugs.
3. if it purports to be the product of a manufacturer of
whom it is no truly a product.
8. Prohibition of import of certain
drugs or cosmetics.
From the date fixed by the central government. –
1. Any drug or cosmetic which is not of standard quality.
2. Any misbranded or spurious or adulterated drugs.
3. Any misbranded or spurious cosmetic.
4. Drug not labelled and packed in the prescribed
manner.
5. Any new drug except with express permission of the
licensing authority.
9. Import of drugs under license or
permit.
The following classes of drug imported under the license.
1. Drugs specified in schedule C and C1.
2. Drug specified in schedule X;
3. Small quantities of drugs imported for the purpose of
examination ,analysis .
4. Drug for personal use covered by prescription of
Registered Medical Practitioner.
