“RIGHT OF WAY POLICY” FOR DEPLOYMENT OF OPTIC FIBRE
CABLES IN ANDHRA PRADESH & TELANGANA

Guidelines for issuing permission to the agencies, especially telecom operators, desirous
of implementing optic fibre projects in the state.
- One may call this as a first Right of way policy of unified Andhra Pradesh.
- The policy takes the reference form GoI guideline (Ministry of surface transport Govt.
of India No RW/NH-12037/826/98-KNT dated 17.08.1999) on the subject of
permitting in laying optic fibre cables along the national highways. As per the GoI
policy the permission is to be given free of any charge subject to the licensee
producing a Bank Guarantee for an amount calculated at the rate of Rs 25 per RM.
- Permission are accorded through (roads belonging to) state authorities like R&B,
Panchayat raj, and Municipal Administration & Urban Development and Forest
departments.
- Under this RoW application by TSPs are addressed to Engineer-In-chief, R&B,
Principal chief Conserver of forest, Engineer-in-chief, Panchayat Raj and Engineer –in-
chief, Municipal Administration and Urban development.
- The policy provisions that within 2 weeks of application, subject to the applicant
executing the agreement (TSPs and respective permission authority) and provide the
Bank Guarantee as per GoI policy (Rs. 25 per RM)
- No sell, lease or trade of extra space available in the duct is permissible to TSPs
except they obtain specific prior permission of the Government.
- Restoration of the road to its original quality at TSPs cost and to the satisfaction of
authority given the permission.

Laying of optic fibre cable along the state properties- Encroachment fee of Rs. 50 /Rs. 200
for Rmt/Sqft for encroachment of road margins
- It has been brought to the notice of the government that some municipal
commissioners are demanding an encroachment fee of Rs. 50 per Rmt and Rs. 200
per sqmt for encroachment of road margin and construction of structures
respectively for one year.
- As per the G.O. Ms. 5, charging the licensed telecom operators for road margin
encroachment and laying of cable is not warranted. As per the order all municipal
3. commissioners were instructed to strictly implement and follow G.O. Ms. 5 without
deviation to avoid the delay in implementing the Telecom Infrastructure Projects.
G.O.Ms.No. 45, ITE&C department, dated 17.10.2001 (Govt. of Andhra
Pradesh)
- An amendment was issued to clause 5 (e) of the g.o.ms.no. 5, f&p (plg.it&c) dept.,
dated 11.02.2000, vide g.o.ms.no.45, ite&c department, dated 17.10.2001, in which
it was stated that if the service provider undertakes road cutting in any urban and
rural areas, the service provider shall pay the road cutting charges prescribed by the
department concerned or in the event no such charges are fixed, they shall restore
the road or the road margin, which has been dug, to its original quality at their own
cost and to the satisfaction of the department concerned.
G.O. Ms. No. 46, IT&C Department, dated 20.10.2001 (Govt. of Andhra
Pradesh)
- It was decided to accord permission to all licensed telecom operators laying optic
fibre cables to carry out ducting, cabling and equipment installation within the
premise of Government offices or premises occupied by the Government of Andhra
Pradesh on a non-exclusive basis.
- The building premise is defined as “from the compound/gate to the ground
floor/basement of the building and from the ground floor/basement of all floors and
terrace of the building.
- Some of the conditions to pursue above activities in Govt. premise are A) The
licensed company will reinstate at their cost, the premise used, to their near original
condition, on completion of all installation and related works. B) The licensed
company will bear the entire cost of duct, cables and equipment as well as
installation with in the premises on a non-exclusive basis.
- Respective authority to provide approval for large government complexes,
Secretariat, Other Government offices, collectorate, Govt. offices in private buildings
are defined in the policy.
- In case the permission is not issued to licensed service operator for laying optic fibre
cable within the premise of the Government buildings/Government occupied
building within 2 (two) weeks from the date of application to the competent
authority under proper acknowledgement, the permission to lay the cables is
deemed to have been issued.
4. G.O.Ms.No.12, ITE&C Department, dated 28.07.2014 (Govt. of Andhra
Pradesh)
- A meeting was called by the chief secretary on 03.07.2014 and 08.07.2014 regarding
4G communication expansion before this G.O. came into being.
- In this meeting once again the Govt. decided to follow the provisions enumerated in
G.O.Ms. No. 5 and it was reiterated that wherever the service provider lays the cable,
the first option should be given him to restore the road to its original level at his cost
and to the satisfaction of the concerned department.
- To facilitate 4G extension in the state upon the request placed by RJio with this
order; Govt. appointed Commissioner -MA&UD (Municipal Areas) and Commissioner-
Panchayat Raj (Panchayat areas) as nodal officers to facilitate laying of cables, setting
of towers and sort out any issues with the service provider.
- The Govt. from this order issued following terms and condition to service provider for
4G system expansion.
A) The service provider shall have to restore the road cut portions themselves in the
entire urban and rural areas subject to condition that the following securities be
kept by way of bank guarantee with the dept. concerned for the prescribed period
of one year and also to be responsible for restoration of road to the original
profile in accordance with the prescribed specification/conditions.

B) It Provisions to invoke performance bank gurantee if the service provider fails to
do the work as per the specification of the Quality control engineer towards
making good of the damage/defects in restoration.
C) If the service provider resorts to open trench cut method and desires that the
restoration of the road in the urban and rural areas shall be done by the
department, he shall be liable to pay the following charges;

D) The service provider were not allowed to take up partial restoration work and ask
the department concerned to do the remaining job on payment.
5. G.O. Ms. No. 20, ITE&C department, dated 26.09.2014 (Govt. of Andhra
Pradesh)
This order is an amendment to (G.O. Ms. No. 12, dated 28.07.2014) the clause related to
charges revised for open trench method in deploying optic fibre in the urban and rural
areas if the service provider resorts not to carry restoration on their own and asks the
department concerned to do so by paying the charges. The revised charge in this regard are
as follows: -

Memo No. 569/IT, E&C/Comm/2014, dated 15.12.2014 (Govt. of Andhra
Pradesh)
As both the G.O. Ms. No 12 and G.O.Ms. 20 dated 28.07,2014 and 26.09.2014 were
addressing the policy in regard to expansion of 4G communication in the state; Govt. with
this circular expressed that as there are no other guidelines for the road cutting and
restoration charges for laying of fibre for 2G and 3G services, both the order of ITE&C
department are equally applicable to any telecom service provider for laying the fibre for
2G and 3G services also as per the rates mentioned in G.O.Ms. 12 and G.O.Ms. 20.

Once again Govt. revised the charges for restoration which the service provider shall be
liable to pay to the department concerned when resorting to open trenching method. The
charges are valid even for the roads that belong to agencies like HMDA, TSIIC (IALAs) in
Urban areas.

This govt. order simplifies the process of Road cutting/Right of way permission through
online system for roads and properties belonging to Roads & building department only.
Soon after applicant files the required details online the executive engineer verifies the
details provided online and if s/he finds that the road pertains to R&B the application will be
cleared for inspection, else rejected.
With this order R&B department made it mandatory to receive application and document
related to Road cutting permission only in online format from 1st
August, 2017.

Permission will accorded online through executive engineer (of the concerned district).
Applicant can download the permission letter from the website soon the applicant pays the
fee amount through online payment gateway
Road cutting charges are same as per the G.O. Ms. 12 of ITE&C department dated
16.09.2015. Additional inclusion of road cutting fee under this G.O. are –

Timelines
Final permission letter will be issued within 7 days of the application provided all
application documents are in order and no delay in fee payment.
Note :- (Application scrutiny, Physical verification by the executive engineer, R&B and final
approval within 6 days after receiving the application. Moving forward, final permission
letter issued – 1 day after payment of fees)
