Philosophy of Accident Prevention
Society as a whole has a moral responsibility
to prevent needless destruction of life and
health, particularly in the workplace
The employer is primarily responsible for
ensuring a safe, healthy work environment
Employees are held accountable for following
prescribed safety standards and guidelines.

Rule 1001 – Purpose and Scope
– To protect every workingman against the
dangers of injury, sickness or death through
safe and healthful working conditions,
– thereby assuring the conservation of valuable
manpower resources and the prevention of
loss or damage to lives and properties,
– consistent with national development goals
and with the State’s commitment for the
total development of every worker as a
complete human being.

– A full-time safety officer must be a Safety
Practitioner duly accredited by the BWC.
OSH STANDARDS
Note: The employment of a full-time safety officer may not be
required if the employer enters into a written contract with a
qualified consultant or consulting organization whose duties
and responsibilities shall be the duties of a safety practitioner
as stated in these Rule. The employment of a consultant,
however, will not excuse the employer from the required
training of his supervisors or technical personnel. 31

maintaining the health of his workers
The employer shall carry out the Work Environment
Monitoring (WEM) where hazardous work is
performed and shall keep a record of such

enforcing authority
– WEM shall include temperature, humidity, pressure, illumination,
ventilation, concentration of substances in the air and noise levels

The occupational health personnel and the first-
aiders of every establishment shall undergo a
minimum of eight (8) hours refresher training in
their respective fields at least once a year.

Emergency Hospital – An employer need not put up
an emergency hospital or dental clinic if there is a
hospital or dental clinic which is not more than
five(5) kilometers away in urban areas and 25
minutes travel in rural areas provided contracts are
entered into with the said hospital or dental clinic and
that the employer provides transportation facilities.
PHYSICIAN/DENTIST shall be subject to call at any
time in other shifts during emergencies.

Frequency of Self-Assessment To be conducted at
least once a year within 1 month from the receipt of
the Checklist (from RO) Jointly by employer and
workers’ representative
(LMC, Health and Safety Committee and others)
Accomplishment of the Checklist - In triplicates (one
copy for R.O., one copy for workers/ union, one copy
for the employer)
Submission of the Checklist To be submitted by the
employer or his/ her duly authorized representative
within 5 days after the assessment either by personal
delivery of through registered mail.

PD 442 Chapter II, Article 165 – Administration and Enforcement: DOLE shall be solely responsible for the administration, enforcement of laws, policies and programs on occupational safety and health. Philosophy of Accident Prevention Society as a whole has a moral responsibility to prevent needless destruction of life and health, particularly in the workplace The employer is primarily responsible for ensuring a safe, healthy work environment Employees are held accountable for following prescribed safety standards and guidelines. OSH STANDARDS 14

Rule 1001 – Purpose and Scope – To protect every workingman against the dangers of injury, sickness or death through safe and healthful working conditions, – thereby assuring the conservation of valuable manpower resources and the prevention of loss or damage to lives and properties, – consistent with national development goals and with the State’s commitment for the total development of every worker as a complete human being. 15 OSH STANDARDS

Rule 1002 – Definitions – E________ is any person acting in the interest of an employer – W________ is any person hired to work – I__________ E_______ is any workplace to produce goods and services – H________ shall connote a sound state of the body and mind – S________ shall refer to the physical or environmental conditions of work which substantially comply with the Standards.   • 21. (1) An imminent danger is a condition or practice that could reasonably be expected to cause death or serious physical harm before abatement under the enforcement procedures can be accomplished. Rule 1012.02: Abatement of Imminent Danger: OSH STANDARDS 21
  • 22. a. the unavailability of professional or technical personnel or of materials and equipment needed to comply with the rule; b. necessary construction or alteration of the prescribed facilities cannot be completed on the effectivity date of the rule; c. the employer is participating in experiments or studies approved or conducted by the Bureau designed to demonstrate new techniques to safeguard the safety and health of workers.   • 23. OSH STANDARDS Where the workers use or are exposed to biologic agents such as bacteria, fungi, viruses, protozoa, nematodes, and other parasites. Where the nature of workers to dangerous environmental elements, contaminants or work conditions including ionizing radiation, chemicals, fire, flammable substances, noxious substances and the like; Where the workers are engaged in construction work, logging, firefighting, mining, quarrying, blasting, stevedoring, dock work, deep- sea fishing, and mechanized farming; Where the workers are engaged in the manufacture or handling of explosives and other pyrotechnic products; Where the workers use or are exposed to power driven or explosive powder actuated tools; 23 Rule 1013 – Hazardous Workplaces
  • 24. Every employer shall register his/her business with the Regional Labor Office or authorized representative to provide the DOLE with information as guide in its enforcement activities.   • 25. – The OSHC/BWC either directly or through accredited organizations, shall conduct continuing training programs to increase the supply and competence of personnel qualified to carry out the provision of this Standards. – Employer to appoint a safety officer on a full- time or part-time basis depending on the type of workplace (whether hazardous or non- hazardous) and number of workers in the workplace.   • 31. – A full-time safety officer must be a Safety Practitioner duly accredited by the BWC. OSH STANDARDS Note: The employment of a full-time safety officer may not be required if the employer enters into a written contract with a qualified consultant or consulting organization whose duties and responsibilities shall be the duties of a safety practitioner as stated in these Rule. OSH STANDARDS RULE 1045 – Duties of Employer 1) Establishes and adopts in writing administrative policies on safety and health 2) Report to DOLE the policies adopted and required report requirements 3) Reports to DOLE at least every 3 months activities including safety performance 4) Act on recommended measures of health and safety committee and in case of non- adoption, to inform the committee of the reason. 38

OSH STANDARDS RULE 1046 – Duties of Workers 1) Work in accordance with accepted safety principles 2) Reports unsafe conditions and practices to the Supervisor 3) Serves as member of the Health & Safety Committee 4) Cooperates actively with the Health & Safety Committee 5) Assist government agencies in the conduct of H&S inspections. 39

OSH STANDARDS RULE 1047 – Duties of Safety Officer 1) Serves as secretary of H&S Committee 2) Acts as adviser to employer and workers re H&S 3) Conducts accident investigations 4) Coordinates H&S trainings for employee/employer 5) Conducts H&S inspections as member of committee 6) Maintains H&S records 7) Provides assistance to government agencies in H&S inspections and accident investigations. 40
  • 41. 1053.01: Notification - All work accidents or occupational illnesses, resulting in disabling conditions or dangerous occurrences shall be reported by the employer to the Regional Labor Office If Major work accidents results in death or permanent total disability, employer shall initially notify the Regional Labor Office within 24 hours 1054: Keeping of Records - The employer shall maintain and keep an accident or illness record which shall be open at all times for inspection to authorized personnel. Shall have adequate fire, emergency or danger signs and safety instructions of standard colors and sizes, visible at all times Visible signs for driver of motorized vehicles such as “STOP”, “YIELD”, and “DO NOT ENTER” Facilities and convenient movement of handicapped employees Good housekeeping shall be maintained at all times Personal facilities: adequate comfort rooms and lavatories separate for male and female workers. Adequate dressing facilities for female workers and locker rooms for male workers shall be provided, in accordance with Article 132, Chapter 1, Title 111, Book 111 of the Labor Code. Rule 1070 - Occupational Health and Environmental Control The employer shall exert efforts to maintain and control the working environment in comfortable and healthy conditions for the purpose of promoting and maintaining the health of his workers The employer shall carry out the Work Environment Monitoring (WEM) where hazardous work is performed and shall keep a record of such measurement which shall be made available to the enforcing authority – WEM shall include temperature, humidity, pressure, illumination, ventilation, concentration of substances in the air and noise levels The WEM shall be performed periodically as may be necessary but not longer than annually.   • 51. RULE 1080 PERSONAL PROTECTIVE EQUIPMENT AND DEVICES Every employer shall at his own expense furnish his workers with personal protective equipment (PPE) . . . of approved design deductions for loss or damage should not exceed 20% of weekly wage.

OSH STANDARDS Rule 1080 - Personal Protective Equipment (PPE) and Devices 1081.01 - Every employer shall at his own expense furnish his workers with protective equipment and barriers whenever necessary 1081.04 - No person shall be subjected or exposed to a hazardous environmental condition without protection. OSH STANDARDS Rule 1940 - Fire Protection and Control Exits - At least two exits shall be provided in every floor and basement of every workplace capable of clearing the work area in five (5) minutes. Fire-Fighting Facilities - Approved fire extinguishers shall be used - To be installed 1M-1.5M above floor. OSH STANDARDS 53

OSH STANDARDS Emergency Hospital – An employer need not put up an emergency hospital or dental clinic if there is a hospital or dental clinic which is not more than five(5) kilometers away in urban areas and 25 minutes travel in rural areas provided contracts are entered into with the said hospital or dental clinic and that the employer provides transportation facilities.
