DON’T GET FOOLED BY INSURANCE ADJUSTERS
BE CAREFUL WHEN TALKING TO INSURANCE ADJUSTERS… Getting injured can happen in a lot of ways. From on the job risks to car accidents and product related injuries, Lowe Eklund Wakefield Co. has seen just about every type of injury anyone could imagine. However, when you or a loved one is injured, is it a good idea to talk to the insurance adjuster to get your information sent over for a claim? The answer is a bit more nuanced than you might think.
BEWARE THE REQUEST FOR RECORDED STATEMENTS! Insurance adjusters make requests for recorded statements because, quite simply, they are looking to build a case against you so that they do not have to pay out their claim. It is a natural part of the insurance business to find any reason possible to deny a claim and thus make more money. However, this is a huge conflict of interest for customers who need insurance when an accident happens. Does this mean you cannot trust your insurance company? It’s possible, but keep in mind that most insurance companies operate on this premise. As businesses, they need to be as profitable as possible, so denying claims might be necessary to keep their business afloat. Make absolutely sure you don’t make a recorded statement until you’ve gotten your facts straight. Here are some key points to make sure you have put together before talking to an insurance adjuster…
DON’T LET YOUR GUARD DOWN Even if you’ve been with your insurance company for years, you could get in tremendous trouble if you are too loose lipped around these folks. This means that you should never just agree to speak over the phone with someone recording an official statement until you’ve had time to get your facts straight and figure out what kind of claim you really need. Do not speak to the insurance company before then!

DON’T GET FOOLED BY INSURANCE ADJUSTERS
DON’T OFFER PERSONAL INFORMATION There is never a reason to give your social security number, previous employers or financial history to your insurance company. They do not have the legal right to this information. They are trying to build a case against you by digging into your personal history and finding any reason they can to deny your claim such as previous criminal history, financial problems or health problems in your past.
DON’T ANSWER ABOUT THE SEVERITY OF YOUR INJURIES Until you know and have spoken about these injuries with your doctor, you should never, at any point, make a recorded statement about your injuries. This will show a lack of credibility if the injuries end up being more or less severe and it also may become a means to deny your claim under the grounds of not being severe enough. Talk to your doctor and wait a few weeks before talking to your insurance company and recording an official statement. There is no way to be 100% sure they will not use some of this information against you, so don’t say anything you don’t have to and keep the facts straight! If you or a loved one have experienced health complications or personal injuries related to a car accident, contact the fracking lawyers at Cleveland, Ohio’s Lowe Eklund Wakefield Co., LPA to discuss your case.
