1. Plumbing problems result in lawsuit against former owners
of home - The Louisiana Record
GRETNA A couple is suing a group of people who sold them a home without allegedly disclosing a
serious plumbing problem.
Heather Schuler Molay and Nunzio J. Molay III filed suit against Julie Werling Robinson, Christi
Werling Cabos, Tricia Werling Della Valentina, Rhonda Werling Tortorich, Phyllis Werling Laverne,
Joseph C. Brocato, Donna C. Brocato and Hy-Tech Plumbing Inspections in the 24th Judicial District
Court on June 22.
The Molays contend they entered into an agreement to purchase a home located at 1609 Velma St.
in Metairie from the Werlings. The plaintiffs assert that under the contract the defendants did not
disclose problems with the plumbing system or water piping. However, the Molays claim that shortly
after moving into the home they found a toilet had backed up and upon inspection by a plumber a
blockage in the piping was discovered which had been in place for quite some time, but was not
disclosed prior to the sale of the home.
The plaintiffs allege that prior to purchasing the home the defendants, the Brocatos and Hy-Tech
Plumbing Inspections, did a video inspection of the area and failed to discover the defect. The
Molays contend the defendants breached the property disclosure form they signed prior to the sale
of the property.
The defendant is accused of breach of contract.
An unspecified amount in damages is sought for finical losses, cost of repair, loss of use, loss of
enjoyment of property, redhibitory damages, attorneys fees and litigation costs.
The plaintiff are represented by attorney Anthony L. Glorioso of Gretna.
The case has been assigned to Division H Judge Glenn B. Ansardi.
