                   “FAIR ELECTION ACT”

• DEFINITION
  It is an act that states election laws of the Philippines. It helps to have a
  systematic manipulation during the election process and enhances even the
  honesty and orderliness for an output of a peaceful election.

• RELATED ARTICLE

   Sec.1. Equal opportunity in the access of airtime shall be given to
   candidates and political parties.

      o Having an airtime is very vital in each candidate and parties because
        it will make them popular to the mass people, but the distribution of
        airtime must be equal for none of them will not be abusing it too
        much. Each advertisement shall be in the form of a maximum of 30
        seconds spot and a total of not more than 120 minutes of television
        and 180 minutes of radio advertisement for the entire duration of the
        campaign period.

   Sec.4. When a person employed or engaged in any capacity in a station
   becomes a candidate or is employed or retained in any capacity by a
   candidate or political party, he shall go on leave for the duration of the
   election period or his employment may be terminated by the station.

      o This section is a grave offense if it is being violated. And for the
        competitors not to have wrong thoughts about this situation, a
        candidate must leave his/her job on that particular station for it will
        not be result to some bias situation.


• IMPORTANCE
  Fair election Act leads citizens to have a successful result of honest process
  of election. This act also guides the holding of systematic and credible
  elections through practices of fair election.

• VIOLATIONS (for the following rules)

      o No movie, cinematography or documentary portraying the life or
        biography of a candidate shall be publicly exhibited in a theater,
        television station or any public forum during the campaign period.

      o If a person engaged in a station becomes a candidate or is employed
        by political party, he shall go on leave for the duration of the election

      o No movie, cinematography or documentary portrayed by an actor or
        media personality who is himself a candidate shall be publicly
        exhibited in a theater, television station or any public forum during
        the campaign period.

      o Equal opportunity in the access of airtime shall be given to
        candidates and political parties.

• PENALTIES
  These following penalties must be imposed for violation of rules:

      • For the first offense, a fine of P3,000.00 and/or written reprimand to
        individual employee/ blocktimer/announcer, and censure for the
        station;

      • For the second offense, a fine of P5,000.00 and/or three (3) months
        suspension of individual employee/blocktimer/ announcer, and three
        (3) months suspension of privileges for the station;

      • For the third offense, a fine of P10,000.00 and/or six (6) months
        suspension of individual employee/blocktimer/ announcer, and six (6)
        months suspension of privileges for the station; and

      • For the fourth offense, cancellation or revocation of accreditation of
        individual employee/ blocktimer/ announcer, and recommendation
        for expulsion from KBP membership and recommendation to the
        National Telecommunications Commission (NTC) for the
        cancellation of permit to operate the station.

• CASE SAMPLE

The case is about Former Poll Chairman Benjamin S. Abalos, Sr., who had
       been implicated his name on this current time because of the issue that
       had been done last 2007. The Commission on Elections (Comelec) filed
       an electoral sabotage case against its former chairman Benjamin Abalos
       in connection with the alleged irregularities in the 2007 midterm
       elections.
