2. Regulation Changes
• The following child care regulations have had
adopted amendments, March 2013:
• 922 KAR 2:090E, Child-care Center Licensure
• 922 KAR 2:100, Certification of Family Child-care Homes
• 922 KAR 2:110, Child-care Center Provider Requirements
• 922 KAR 2:120, Child-care Center Health and Safety
Requirements
• 922 KAR 2:160E, Child Care Assistance Program
• 922 KAR 2:180, Requirements for Registered Child Care
Providers in the Child Care Assistance Program (CCAP)
• 922 KAR 2:190, Civil Penalties
3. Highlights of Changes
• This tutorial will highlight the regulation
changes that will directly impact child care
providers in the child care assistance
program.

4. Finding of fraud
A “Finding of fraud” means a suspected intentional
program violation that is accepted for investigation and
substantiated by the cabinet’s Office of Inspector General.
• A provider subject to a finding of fraud will not be
allowed to change ownership of a license, apply for a
license for a new facility, and will have the provider’s
CCAP payments withheld if the provider participates in
CCAP.
•The cabinet will also direct Child Care Assistance
Program payment withheld per 922 KAR 2:160, Section 17
towards a child care providers claim.
5. Federal Poverty Level
Effective July 1, 2013, a child shall be
eligible for the CCAP if the family’s income
is less than or equal to:
•100 percent of the federal poverty level at
the initial application; or
•100 percent of the federal poverty level at
the redetermination or eligibility
recalculation .
6. Registered Provider
A child care provider registered shall not be
paid for more than:
•Three (3) children receiving CCAP per day
or six (6) children receiving CCAP per day, if
those children are a part of a sibling group
and related to the provider.
7. Child Care Daily Attendance Record
A universal attendance form is now required for all child care
providers participating in CCAP. The “Child Care Daily
Attendance Record” (DCC-94-E) form should be legible,
completed daily, detail the arrival and departure times of each
child in care and has to be signed by the parent.

•This form is a requirement for the Child Care Assistance
Program.
• The applicant for a child is to report if the applicant suspects
the child care provider is not complying with the new
attendance record requirement to use this form.
9. Cooperation and Verification
• There are improved cooperation and
verification requirements for a CCAP
recipient and participating child care
provider.
• The cooperation will facilitate quality
control and case review processes,
eligibility determination; and access to a
child care provider’s premises, records,
and children in the provider’s care during
hours of operation.
