The Supreme Court of India (Hindi: भारत का सर्वोच्च न्यायालय) is the highest judicial forum and final court of appeal of India established under Constitution of India, as per which Supreme Court is the highest constitutional court and acts as the guardian of Constitution. India follow the integrated and yet independent judiciary. Since independence, judiciary has been playing a very active role in dispensing the justice since A K Gopalan vs State of Madras case(1950) followed by Shankari Prasad case, etc. However, judiciary remained submissive till 1960s but its assertiveness started in 1973 when Allahabad High Court rejected the candidature of Indira Gandhi and introduction of PIL by Justice P N Bhagwati further expanded its scope. Subodh Markandeya well known Senior Advocate of Supreme court of India is famous Judicial activist ,who is famous for his notable Public Interest Litigation cases.

Abstract The denial of bail for an indefinite period impinges on fundament rights. The prisoner must not be punished before conviction. Granting of bail always rings for the conflicting interest between liberty of an individual and interest of the society. The Principle underlying release on bail is that an accused person is presumed in law to be innocent until his guild is proved beyond reasonable doubt and as a presumably innocent person; he is entitled to freedom and every opportunity to look after his case, provided his attendance is secured by proper security. The other object of the release of a person on bail is to secure the presence of the person charged with crime at his trial or at any other time when his presence may lawfully be required and to force him to submit to the jurisdiction and punishment imposed by the Court. The normal rule is bail and not jail. Again at various occasions, Hon’ble Supreme Court and several High Courts reiterated that ‘the grant of bail is a rule and refusal to bail is an exception. The significance and sweep of Article 21 make the deprivation of liberty a matter of concern and permissible only when the law authorizing it is reasonable, even-handed and geared to the goals of community good and State necessity spelt out in Article 19. Grant of bail by the Court is a discretionary order. However, this discretion shall be exercised in judicial manner and not as a matter of course. The order denying the bail shall provide cogent reasons of rejection. The nature of the offence is one of the basic considerations for the grant of bail - more heinous is a crime, the greater is the chance of rejection of the bail, though, however, dependent on the factual matrix of the matter.

Next, discuss whether the concurrent occurrence of these elements is more beneficial to the prosecution or the defense. Justify your response. · It is common knowledge that jurisdiction, the official power to make legal decisions and judgments, is vitally important to the adversarial legal system. Discuss the importance of having either subject matter jurisdiction or personal jurisdiction over the cause of action. Include one (1) example of the importance of the chosen jurisdiction to support your response. Week 2 Extra Credit Discussion- Long-Arm Jurisdiction Hi Class, Most weeks there will be an extra-credit discussion where you can earn up to 5 extra credit points. Believe me, these points can add up and sometimes make the difference in your final letter grade. Bottom of Form Please reply to the following students as well Nicholas Mayfield RE: Week 2 Discussion While actus rea is pretty much always required for there to have been a crime committed, in cases involving drugs, alcohol, or traffic crimes, mens rea is not necessary. The best example I can think of for this would be manslaughter due to reckless driving. When operating a motor vehicle, you accept the terms of strict liability, which is the main purpose of medications having a waring against operating vehicles and heavy machinery. When a drunk driver accidentally kills someone, they are likely to be found guilty of manslaughter. On the other hand, mens rea is required in cases not involving vehicles and/or mind altering substances. The only example that comes to mind for this is accepting stolen property. If you were to buy a bicycle from someone on craigslist, there is a good chance that you would not suspect the bike to be stolen property, in which case you would not be guilty. I feel like this concept would be most useful for the defense, as it allows you to maintain your innocence in the case of a crime you did not knowingly commit. Subject matter jurisdiction is more interesting to me, as personal jurisdiction mainly just relates to a person being in a place. Subject matter jurisdiction, on.

In the case of State of Rajasthan vs. Union of India (1977), the Supreme Court defined legal right as, “In a strict sense, legal rights are correlatives of legal duties and are defined as interests which the law protects by imposing corresponding duties on others. But in a generic sense, the word “right” is used to mean an immunity from the legal power of another, immunity is exemption from the power of another in the same way as liberty is exemption from the right of another.
