Patent Drafting and Filing
The scope of a patent application should be broad enough to provide maximum protection to the owner of the
patent, while being narrow enough to not infringe on any existing art.
Drafting a patent application is not just science and technology, it is an art, which comes with experience. We have a
collective experience of drafting nearly 200 patent applications in various domains. We have drafted patent
applications to be filed with EPO, USPTO and Indian Patent Office under the able guidance of well qualified attorneys
in Europe, US and India.
Further, we have international collaborations with experienced attorneys in most of the prominent countries to
assist our clients in their international filings and prosecution in the most cost-effective manner.

To promote IP in India, Department of Information and
Technology is running a scheme (SIP-EIT) in which
Government pays up to 50% of international patent
filing and drafting costs for selected cases.

Searching Services
Patentability Search
Patentability Searches are conducted to check if a particular invention is novel and non-obvious. These searches
involve identifying patent and non-patent literature disclosing the features of the particular invention.
Such searches are, generally, conducted before incurring any cost into drafting, filing and prosecution of a patent
encompassing any invention.
Freedom-To-Operate Search
Freedom-To-Operate searches help to identify whether a product may possibly be infringing on a patent. Before the
launch of a product in a specific jurisdiction (or worldwide), companies generally get a jurisdiction-specific (or
worldwide) Freedom-To-Operate search conducted for all the features of the product to avoid any legal hassles of
infringement.
In a Freedom-To-Operate search, the active patents (pertaining to the relevant technology domain) in jurisdictions
where the product is desired to be sold are searched and their claims analyzed to check if they might restrict the
Freedom-to-Operate of the product.
Validity Search
A validity search involves conducting a patent and non-patent literature search to identify prior art literature that
might affect the validity of a patent.

Claim Charts & Claim Construction
Claim Chart Preparation
Sagacious prepares claim charts to determine the extent of overlap between one or more claims of a patent with
overlapping products. For this purpose, Sagacious conducts searches to identify evidences highlighting the overlap
between a product and the claims of the patent.
Such projects are, generally, conducted after the client has acquired a patent and is preparing to send letters to the
infringers and/or preparing for the court case.
Claim Construction
Claims construction documents are prepared to draw a boundary based on the scope of the claims. This project
includes identifying the substantiating text corresponding to the claims from the full specifications and the file
history of the patent, to determine the scope of the claims.
Sagacious team has the IP and technical expertise to prepare the claim construction documents.

In our projects, we follow the following methodology:
– Developing an understanding of the client’s requirements
– Organizing a conference call with the client to discuss the understanding of the team
– Conducting preliminary searches/study to prepare a project proposal for client’s approval
– On approval by the client, Sagacious starts working on the project
– Delivering interim report ( interim deliverable) on ~40% completion of the project for client’s
feedback
– Incorporating client’s feedback on the interim deliverable, and accordingly completing the whole
project
– Delivering final report (final deliverable) on 100% completion of the project
