Introduzione
Una esplosione e/o un incendio è, spesso, un evento
fortemente distruttivo.
Per questa ragione, le compagnie di assicurazione
adducono spesso vari motivi per evitare di liquidare i
danni.
In molti casi, il risarcimento del danno rappresenta un
nodo cruciale richiesto nelle consulenze e, in simili
situazioni, assume fondamentale importanza il ruolo
dell’Ingegnere Investigatore, incaricato di esperire le
necessarie indagini e accertamenti sulle cause
dell’esplosione‐incendio.

comprovata esperienza in campo investigativo.

La pressione di primo picco (apertura delle serrande) può essere stimata
pari a circa a 10 mbar = 100 kg/m2.
Infatti ogni serranda delle dimensioni di 2,5×2,6 = 6,5 m2 è stata in tal modo
spinta all'esterno da una forza impulsiva di 650 Kg;
la pressione massima di secondo picco deve pertanto essere stimata pari a
circa 30 mbar = 3.000 Pa = 300 kg/m2 .
A conferma di ciò basta visionare gli oggetti espulsi anche a 10 metri di
distanza nel cortile
Se si fa riferimento al solaio di separazione con il primo piano esso che con
pressioni superiori a quelle calcolate sarebbe dovuto risultare spanciato
verso l'alto o comunque subire dei danni strutturali visibili dalle foto ed
evidenziate, per motivi di sicurezza dalla squadra dei VVF.

INCOLUMITA' PUBBLICA (REATI)
Per pacifica e consolidata giurisprudenza di questa Corte, occorre
distinguere tra "tra il concetto di fuoco e quello d'incendio, in
quanto si ha incendio solo quando il fuoco divampi in vaste
proporzioni, irrefrenabilmente, con fiamme divoratrici che si
propaghino con potenza distruttrice, così da porre in pericolo la
incolumità di un numero indeterminato di persone".
Pertanto, non ogni fuoco è di per sè qualificabile come incendio,
tale essendo quello in cui le fiamme, non controllate e non
facilmente controllabili, assumano i connotati predetti .

INCOLUMITA' PUBBLICA (REATI)
L'art. 434 cod. pen. si configura come norma di chiusura nel
quadro della categoria dei delitti di disastro, e pertanto
l'espressione "fuori dei casi preveduti dagli articoli precedenti"
rinvia solo a quelli che prevedono delitti di disastro e non anche
al delitto di incendio previsto dall'art. 423 cod. pen.
Quando entrambi i reati siano posti in essere mediante la stessa
condotta materiale ed arrechino un'identica offesa agli interessi
tutelati, sussiste tuttavia tra essi un rapporto di sussidiarietà o
di consunzione, nel senso che, se il reato di crollo viene
commesso cagionando un incendio, trova applicazione
soltanto la norma che incrimina il crollo doloso aggravato in
quanto reato più grave.

Tali condizioni nascono da decisioni che comportano indirettamente l’introduzione di
errori patogeni nella struttura che possono tradursi in condizioni critiche all'interno
del sistema strutturale e/o che comportano la nascita di punti deboli nella barriera

Contributory Factor
Sono fattori che influenzano le prestazioni causando un problema.
I fattori contributivi possono essere influenzanti cioè che hanno effetto sulla
comparsa di un incidente la cui rimozione non è sufficiente per prevenire il ripetersi
in futuro o di ragione che sono direttamente responsabile dell'incidente. La loro
rimozione riduce le probabilità che un incidente simile accada in futuro.

Si verificano quando le azioni intraprese causano effetti che possono
comportare conseguenze.
Essi possono essere cagionati per:
mancanza di esperienza/conoscenza;
scorretta applicazione delle norme e delle procedure;
• mancanza di competenze.
Tra essi si includono:
Slips: cioè errori in cui l'intenzione è corretta, ma il fallimento si verifica
durante l'esecuzione dell’attività.

Violazioni a volte sembrano essere errori umani, ma differiscono da loro
perché sono azioni volontarie.
Secondo le motivazioni, possono essere classificati :
di routine quando si seguono scorciatoie nello svolgimento di un compito;
ragionati quando i protocolli o procedure vengono saltati per vari motivo
(anche a scopo di lucro);

La causa principale è una causa profonda che in genere non si trova
all'interno delle circostanze immediate dell’evento. Il processo di
identificazione può essere complesso.

IntermediateCause
E’ un nodo intermedio della catena causale, che parte dalla radice di un
problema.
Apparent Cause
E’ la causa più probabile di un problema che coinvolge un deficit alle
prestazioni. La sua determinazione si basa sul giudizio e l'esperienza
del ricercatore. Essa di solito ha un minimo di potenziale ripetizione.
Triggering Cause
La causa scatenante è l'ultimo anello della catena. È sostenuta da
fattori remoti che hanno contribuito a creare le condizioni ideali per
l'origine della causa sottostante, durante il periodo di incubazione.

Il nesso eziologico è la relazione che lega un atto e l'evento che vi discende.
E’ il rapporto fra le due prospettive, studiato al fine di ricavare la riconducibilità di un
dato evento al fatto presupposto.
Quando un evento dannoso è riconducibile, sotto il profilo eziologico, alla
concomitanza della condotta e dalla pregressa situazione, il giudice, accerta, sul piano
della causalità materiale (intesa come relazione tra la condotta e l'evento)
l’efficienza eziologica della condotta rispetto all'evento.
Ascrivendo il danno all'autore della condotta, può poi procedere alla valutazione della
diversa efficienza delle varie concause sul piano della causalità giuridica (intesa come
relazione tra l'evento e le conseguenze dannose risarcibili).

ESEMPIO
Un tecnico nella progettazione dell’impianto elettrico, tralascia alcuni dettagli essenziali
per la sicurezza dell’impianto. La Ditta esecutrice realizza lo stesso utilizzando cavi di
dimensione ridotta rispetto a quanto previsto dal progetto. Il sovraccarico elettrico
produce un corto circuito, che innesca in prossimità di un divano in un incendio. La
diffusione del fuoco è facilitata dalla presenza di tende e in pochi minuti l'incendio
raggiunge il flash over facendo collassare la copertura in legno.

probatori tesi alla ricostruzione degli eventi, a
causa della violenza distruttiva dell’ fiamme,
spesso accompagnata dal cedimento di strutture.
Inoltre, le operazioni di spegnimento effettuate
dalle squadre dei VV.F. tendono a dilavare e

Non è affatto semplice raccogliere gli indizi sul luogo, quali potenziali elementi
probatori tesi alla ricostruzione degli eventi, a causa della violenza
distruttiva dell’esplosione e dell’incendio, spesso accompagnata dal
cedimento di solai o di strutture murarie.
Inoltre, le operazioni di spegnimento effettuate dalle squadre dei VV.F.
tendono a dilavare e disperdere le tracce utili.
Tuttavia, spesso le fiamme lasciano tracce del loro passaggio.

Possiamo affermare che in ambito investigativo la scena dell’incendio possiede
la seguente ventilazione somma di due coefficienti:
