1.1 Assessing a legislative framework for the Information Society Services
1.2 Relevant amendments on existing Laws concerning Electronic Communication and
     relevant sub-laws prepared (including rules, procedures and standards for the
     implementation)
1.3 Definition of manual for Inspection procedures - within the Ministry for Information Society
     and Telecommunications - in accordance with the existing legislation.
1.4 Training courses for Inspectors which ensures proper implementation of legislation
     (workshops, study trips, panel discussions) prepared and implemented

Component 1: approach and methodology

              In the dynamics of the Project, Component 1 will be required to provide an
              autonomous output, as well as to support other components, especially the
              Component 3

              Component 1 will provide a complete gap analysis of the legal framework
              based on the MIS Strategy (2009) compared to the EU acquis communitaire

              The gap analysis will be compared to the state of implementation in some
              major EU Countries, in order to apply some best practices in Electronic
              communications, information security, IS Management, electronic signature,
              electronic trade, etc.

              The results of the benchmark will be immediately shared to achieve a wide
              knowledge among the beneficiary institution staff

Component 1: approach and methodology

          The assessment of the legislative framework will be a precondition to select priorities
          in amending sub laws and procedures, according to the instructions of beneficiary
          staff.

          To choose the priorities may be useful to perform a light SWOT analysis

          The reformed regulatory framework (legislation, sub-laws and procedures) shall be
          subjected to a PDCA cycle in a sample of areas chosen by the beneficiary.

          Analysing the remaining gap between the implementation of the new framework and
          the “best expected” will provide some indicators to measure the work done by the
          Component

          The indicators will measure the new output in terms of effectiveness and efficiency
          improvement: the indicators will become an integral part of the manual for inspectors,
          who will be trained in accordance with the Contract

ACTIVITY 1.1

       Assessing legislative framework for the information
                          society services

  BENCHMARKS:
    Comprehensive report on Information Society Services (ISS) legal
    framework based on Strategy for Information Society Development in
    Montenegro 2009-2013 – issued by MIS in 2009 including gap analysis and
    comparative analysis with other Countries.

       Services articles produced

       Comprehensive report describing rules, procedures and standard definition
       in matter of information security, information system management,
       electronic signature, electronic trade, electronic document (based on the
       Official Journal of Montenegro No. 55/03i 31/05, No 80/04, No 49/07, No
       14/2000, No 5/08)

    Inspection procedure Manual-book describing Telecommunications
    inspections procedures in accordance with the existing legislation (based on
    the Official Journal of Montenegro number 50/08)

    Training courses for Inspectors which ensures proper
         implementation of legislation (workshops, study
      trips, panel discussions) prepared and implemented

  BENCHMARKS:

        Training on Inspection procedures addressed to Inspectors and Inspectors’
        trainers; at least 2 (two) Inspectors (representing 100% of the staff in charge
        of this task) trained



  IMPLEMENTATION: before the end of the 10th month.

         Location: Estonia (Tallinn)

         Focus: present the experience of Estonia in developing e-governance, ICT Policy and
         Legal Framework on Information Society and in building a digital territory including
         innovative services, with particular reference to:
           – Estonian e-governance and ICT Policy
           – ICT Strategic Planning and Management in Theory
           – The role of the national parliament in Information Society development
           – Legal Framework on Information Society
           – Publishing governmental data and legal databases: online Official Journal
           – Cyber security: policy development and implementation
           – Personal data protection: principles, legislative framework and implementation
           – e-Government in Justice
           – Practical cases

  Activity 2.1: Adoption of a list of indicators (MONSTAT) to measure the
development level (quantitative and qualitative) of Information Society Services
in Montenegro
  Activity 2.2: Definition of a methodology for evaluation and monitoring of
suggested indicators and preparation of a user manual
  Activity 2.3: Preparation of the plan for long term promotion of the Information
Society Services

importance of information society

Component 2: approach and methodology

       This component will contribute to achieve the objective of the project
       through the transfer of know-how to the beneficiary institution staff. In
       particular, the component will consist of two main blocks of activities
       described as follows:

       1) The experts will analyse all the indicators which will be provided
       through MONSTAT. Definition of the methodology for the evaluation and
       monitoring of suggested indicators. It will follow the preparation of user
       manuals in order to improve the selected indicators


       2) Promotion of the Information Society Services in Montenegro through
       the:
              Definition of the plan for medium-long term promotion
              Promotional pilot project to describe importance of information
              society
              Organization and implementation of training programs addressed to
              the Ministry Civil Servants involved in Information Society
              promotional activities

Activity 2.1: Adoption of a list of indicators (MONSTAT) to measure the
        development level (quantitative and qualitative) of Information
                       Society Services in Montenegro

Examination of the list of indicators useful for monitoring the process of ICT
     development in view of the following categories:
    Government Institutions
    Enterprises
    Citizens
In order to define:
    Data collection methodologies
    Data visualization and Data dissemination

BENCHMARKS:
Complete list of indicators (in accordance with the Official Report of MONSTAT) aimed
  at evaluating the Information Society development analyzed and adopted

Activity 2.2: Definition of a methodology for evaluation and monitoring
    of suggested indicators and preparation of a user manual

     We will work at the definition of a methodology through:
       Surveys
       Recovery and re-use of already existing databases

     We will define
       The time frame during which data will be collected and elaborated

BENCHMARKS:
Guidelines and user manual to define evaluation procedures through the adoption of
MONSTAT indicators

Activity 2.3: Preparation of the plan for long term promotion of the
                          Information Society Services


This component will lead to the drawing up of a plan aimed the identification
    Key stakeholders
    Activities to be implemented which can best reach the different target groups like
    for example:
        Associations of citizens (consumer associations, trade unions, professional
        skills associations)
        Disadvantaged groups
        Non-majority groups

Report describing an Information Society Promotion Plan

Activity 2.4: Organization of a promotional pilot project to describe the
                       importance of information society


The pilot project will be drawn up taking in mind:
        The European Commission Europe 2020 – Europe's growth strategy - in
        particular the flagship initiatives “Digital Agenda for Europe” and “Smart growth”
        IPA funding which prepares pre-accession countries to comply with the “Acquis
        Communautaire”
        To prepare Montenegro for the future use of Structural Funds (especially for the
        part related to the National tasks in the implementation of the “Digital Agenda for
        Europe”)

BENCHMARKS:
Report describing activities, timelines and expected results of the Pilot Project for the
promotion of information society.

Activity 2.5 Preparation and implementation of training programs with to
        increase the promotional skills for the public Servant dealing with the
              promotion in IS (workshops, study trips, panel discussions)

An interactive training will be delivered in order to prepare the beneficiary staff in
    drawing up and implement a communication and awareness campaign in order to
    underline the importance of e-government to the different target groups.



BENCHMARKS:
Training on Information Society Services awareness raising addressed to Civil
Servants, in order to increase their capacity of analysing and monitoring MONSTAT
indicators within Montenegro ISS framework.; at least 5 (five) Civil Servants
(representing 100% of the staff in charge of this task) trained

One study visit in Rome

    3.1 Preparation the measures aimed to promote research and development
        processes of ICT in public sector.
    3.2. Definition of the set of minimum standards for interoperability based on
        comparative experiences of other Countries.
    3.3 Identifying, monitoring and analyzing of the fields, functions and processes of
        eGovernment services.
    3.4 Prepare and implement training programmes targeted to the staff of department
        on Interoperability framework implementation and e -government services.
    3.5 Definition of standards and procedures for Montenegro eGovernment Portal:
        Assessment of existing portal including a feasibility study for further
        development.

Component 3: approach and methodology


          To propose number of measures to promote and support the R&D process of
          ICT
          To conduct a comparative analysis about experiences of interoperability
          framework based on the European ISA program- "Interoperability Solutions for
          European Public Administrations"
          To prepare the questionnaire to analyze the situation regarding eGovernment
          organization, regulations and technical environment.
          To identify and analyze fields, functions and processes of sample e-
          Government services (using user-centric approach).
          To formulate the training plan and implement the training based on the training
          needs assessment.
          To assess the existing e-government portal, including feasibility study for further
          development.

    Technical analysis on governmental electronic services and basic
    specification requirements aimed at defining ToR for Enterprise Service Bus
    performed.

Prepare and implement training programme targeted to the
    staff of department on Interoperability framework
      implementation and e -government services.


  BENCHMARKS:
    Training on the Interoperability Framework in all its aspects addressed to
    ICT specialist of MIS organized and implemented. At least 4 (four) public
    servants of the Ministry (representing 40% of the staff in charge to develop
    and maintain e-government services) trained.

4.1 Support to information system needs analysis of the Ministry and other different state
    institutions directly targeted by the Strategy for Information Society Development 2009 –
    2013
4.2 Optimization and planning for enlargement and maintenance of the Government
    information system and information society services;
4.3 Prepare and implement training programs for the staff for informatics infrastructure
4.4 Assessment of the existing infrastructure and definition of a set of policies and
    procedures for Disaster and Recovery Sites management

Component 4: approach and methodology


  Analysis of of the current situation of Montenegro in relation to the information society, in
  order to have a clear starting picture starting from “Strategy for Information Society
  Development 2009 - 2013” document


  MS and the BC experts will foresee consultations with market players (public and private
  bodies) and surveys on citizens, businesses and Public Administrations in order to
  understand the state of penetration of the use of ICT in Montenegro, in accordance with
  what has been achieved in activities 2.1 and 2.2


  Support the optimisation and plan for enlarging and maintaining the Government
  information system and Information Society services.


  Starting point of the approach is the output of activity 4.1 by using the defined
  methodologies of the activities 2.1 and 2.2.

Component 4: approach and methodology

  The training program should ensure that the MIS staff get exposed to various and efficient
  training methods.


  In order to optimise the infrastructure capacities for the implementation of the information
  society services of the MIS staff, the training program will be implemented during the
  study trips that are foreseen in activities 2.5 and 3.4. The digital divide is a complex
  phenomenon involving infrastructure and service alike; the network is fundamental to
  allow Public Administrations to supply services.


  Once a preliminary assessment of the Disaster Recovery infrastructure, and after a
  careful analysis of technical requirements, system features and user functionalities, have
  been carried out, the group of Experts involved in this activity will define, together with the
  Beneficiary’s responsible officer, all the relevant policies and procedures.


  These activities will be performed taking into account all most renowned principle of
  security and in accordance with the EU standards ensuring a smooth management of the
  infrastructure.

  Prepare and implement training programs for the staff of
         department for informatics infrastructure

BENCHMARKS:
Training on Information Society Services management and maintenance; at least 4
(four) Civil Servants (representing 10% of the staff in charge of managing the
technological infrastructure of information society services) trained within the end of
the Project

Component 4: study visit

        Location: Italy (Torino)
        Focus: The study visit focuses on presenting the experience of the Piedmont Public
        Administrations in developing the regional broadband strategy and in building a digital
        territory, including the implementation of innovative services.
        During the study visit the MS Twinning partnership will organize specific sessions for
        the staff of MIS Department for informatics infrastructure, in order to present several
        experiences such as:
          – WI-PIE Programme: the experience of broadband in the Piedmont area:
                      ICT Observatory
                      Network installations in urban (Turin) and rural areas
                      Installation in mountain huts of antennas and connections
                      B3-Regions project: broadband good practices and economic investment
                      models at EU level.
          – CSI-Piemonte:
                      Server Farm and Disaster Recovery Centre
                      ICT model for the public data management, re-use of Public Sector
                      Information (PSI) and software, Open Data policy

                      protection, agriculture management, services to citizens, services to
                      business and health)
                      Piedmont model of web-based applications and services: Regional
                      eGovernment portal (http://www.sistemapiemonte.it/), the user-centred
                      approach of the Turin Municipality for web services, eDemocracy services
                      of the Regional Council
                      Electronic document management system (dematerialization),
                      dematerialisation and Piedmont Regional Council web services
                      Unified Platform for the management and distribution of public financing to
                      applying SMEs, public administrations and citizens
                      Innovation clusters.

Component 1: Strengthening the Information Society Legal Framework in accordance with the EU Acquis 1.1 Assessing a legislative framework for the Information Society Services 1.2 Relevant amendments on existing Laws concerning Electronic Communication and relevant sub-laws prepared (including rules, procedures and standards for the implementation) 1.3 Definition of manual for Inspection procedures - within the Ministry for Information Society and Telecommunications - in accordance with the existing legislation. 1.4 Training courses for Inspectors which ensures proper implementation of legislation (workshops, study trips, panel discussions) prepared and implemented TEAM: CSI-Piemonte, eGovernance Accademy Podgorica, October 17 2012 Twinning Project– MN 10 IB OT 01 3

Component 1: approach and methodology In the dynamics of the Project, Component 1 will be required to provide an autonomous output, as well as to support other components, especially the Component 3 Component 1 will provide a complete gap analysis of the legal framework based on the MIS Strategy (2009) compared to the EU acquis communitaire The gap analysis will be compared to the state of implementation in some major EU Countries, in order to apply some best practices in Electronic communications, information security, IS Management, electronic signature, electronic trade, etc. The results of the benchmark will be immediately shared to achieve a wide knowledge among the beneficiary institution staff Podgorica, October 17 2012 Twinning Project– MN 10 IB OT 01

Component 1: approach and methodology The assessment of the legislative framework will be a precondition to select priorities in amending sub laws and procedures, according to the instructions of beneficiary staff. To choose the priorities may be useful to perform a light SWOT analysis The reformed regulatory framework (legislation, sub-laws and procedures) shall be subjected to a PDCA cycle in a sample of areas chosen by the beneficiary. Analysing the remaining gap between the implementation of the new framework and the “best expected” will provide some indicators to measure the work done by the Component The indicators will measure the new output in terms of effectiveness and efficiency improvement: the indicators will become an integral part of the manual for inspectors, who will be trained in accordance with the Contract Podgorica, October 17 2012 Twinning Project– MN 10 IB OT 01

ACTIVITY 1.4 Training courses for Inspectors which ensures proper implementation of legislation (workshops, study trips, panel discussions) prepared and implemented BENCHMARKS: Training on Inspection procedures addressed to Inspectors and Inspectors’ trainers; at least 2 (two) Inspectors (representing 100% of the staff in charge of this task) trained IMPLEMENTATION: before the end of the 10th month. Component 2: Raising the level of awareness about Information Society Services among the most relevant stakeholders Activity 2.1: Adoption of a list of indicators (MONSTAT) to measure the development level (quantitative and qualitative) of Information Society Services in Montenegro Activity 2.2: Definition of a methodology for evaluation and monitoring of suggested indicators and preparation of a user manual Activity 2.3: Preparation of the plan for long term promotion of the Information Society Services Activity 2.4: Organization of a promotional pilot project to describe the importance of information society Activity 2.5: Preparation and implementation of training programs with an emphasis on increasing promotional skills for the public Servant dealing with the promotion of Information Society (workshops, study trips, panel discussions) Podgorica, October 17 2012 Twinning Project– MN 10 IB OT 01 12
  • 13. Component 2: approach and methodology This component will contribute to achieve the objective of the project through the transfer of know-how to the beneficiary institution staff. In particular, the component will consist of two main blocks of activities described as follows: 1) The experts will analyse all the indicators which will be provided through MONSTAT. Definition of the methodology for the evaluation and monitoring of suggested indicators. It will follow the preparation of user manuals in order to improve the selected indicators 2) Promotion of the Information Society Services in Montenegro through the: Definition of the plan for medium-long term promotion Promotional pilot project to describe importance of information society Organization and implementation of training programs addressed to the Ministry Civil Servants involved in Information Society promotional activities Podgorica, October 17 2012 Twinning Project– MN 10 IB OT 01

Activity 2.4: Organization of a promotional pilot project to describe the importance of information society The pilot project will be drawn up taking in mind: The European Commission Europe 2020 – Europe's growth strategy - in particular the flagship initiatives “Digital Agenda for Europe” and “Smart growth” IPA funding which prepares pre-accession countries to comply with the “Acquis Communautaire” To prepare Montenegro for the future use of Structural Funds (especially for the part related to the National tasks in the implementation of the “Digital Agenda for Europe”) BENCHMARKS: Report describing activities, timelines and expected results of the Pilot Project for the promotion of information society. Activity 2.5 Preparation and implementation of training programs with to increase the promotional skills for the public Servant dealing with the promotion in IS (workshops, study trips, panel discussions) An interactive training will be delivered in order to prepare the beneficiary staff in drawing up and implement a communication and awareness campaign in order to underline the importance of e-government to the different target groups. Definition of the set of minimum standards for interoperability based on comparative experiences of other Countries. 3.3 Identifying, monitoring and analyzing of the fields, functions and processes of eGovernment services. 3.4 Prepare and implement training programmes targeted to the staff of department on Interoperability framework implementation and e -government services. 3.5 Definition of standards and procedures for Montenegro eGovernment Portal: Assessment of existing portal including a feasibility study for further development. Component 3: approach and methodology To propose number of measures to promote and support the R&D process of ICT To conduct a comparative analysis about experiences of interoperability framework based on the European ISA program- "Interoperability Solutions for European Public Administrations" To prepare the questionnaire to analyze the situation regarding eGovernment organization, regulations and technical environment. To identify and analyze fields, functions and processes of sample e- Government services (using user-centric approach). To formulate the training plan and implement the training based on the training needs assessment. To assess the existing e-government portal, including feasibility study for further development. At least 4 (four) public servants of the Ministry (representing 40% of the staff in charge to develop and maintain e-government services) trained. Component 4: approach and methodology Analysis of of the current situation of Montenegro in relation to the information society, in order to have a clear starting picture starting from “Strategy for Information Society Development 2009 - 2013” document MS and the BC experts will foresee consultations with market players (public and private bodies) and surveys on citizens, businesses and Public Administrations in order to understand the state of penetration of the use of ICT in Montenegro, in accordance with what has been achieved in activities 2.1 and 2.2 Support the optimisation and plan for enlarging and maintaining the Government information system and Information Society services.   • 30. Component 4: approach and methodology The training program should ensure that the MIS staff get exposed to various and efficient training methods. In order to optimise the infrastructure capacities for the implementation of the information society services of the MIS staff, the training program will be implemented during the study trips that are foreseen in activities 2.5 and 3.4. The digital divide is a complex phenomenon involving infrastructure and service alike; the network is fundamental to allow Public Administrations to supply services. Once a preliminary assessment of the Disaster Recovery infrastructure, and after a careful analysis of technical requirements, system features and user functionalities, have been carried out, the group of Experts involved in this activity will define, together with the Beneficiary’s responsible officer, all the relevant policies and procedures. These activities will be performed taking into account all most renowned principle of security and in accordance with the EU standards ensuring a smooth management of the infrastructure. Component 4: study visit Location: Italy (Torino) Focus: The study visit focuses on presenting the experience of the Piedmont Public Administrations in developing the regional broadband strategy and in building a digital territory, including the implementation of innovative services.
