Prison Rape in the United States
1. Prison Rape in the United States
A Report from Your Florida Sex Crime Attorney
Rape is a horrific crime. Whether the assailant is a stranger, friend, or intimate partner, millions
of people have been forced to endure the trauma, depression, and anxiety that comes with such an
intimate violation. Florida rape lawyers witness the destruction that date rapes and stranger rapes can
wreck upon a person’s psyche and can offer legal advice and support. However, there is one place
survivors do not get the support they need: prison.
More than 200,000 adults and children are sexually abused every year in the nation’s prison
system. The average Florida survivor of prison rape is abused repeatedly. Abusers tend to target lesbian,
gay or transgendered people and previous survivors of abuse, whom they see as more vulnerable. In some
cases, the abuser is the prison guard—the very person who is sworn to protect the inmates. Once the rapes
end, the survivor’s suffering does not stop; survivors of prison rape are at high risk for HIV and other
sexually transmitted diseases, depression, post traumatic stress disorder, drug addiction, and alcoholism.
Prison rape is preventable with sound practices, committed leaders, and good policies. However,
for far too many victims, prison rape is another part of the punishment. Some inmates joke about “not
dropping the soap” or other humor rooted in the pain of sexual abuse survivors. However, as every
Florida sex crime attorney knows, the Constitution forbids cruel and unusual punishment, and prison rape
is a form of cruel and unusual punishment. One should not allow a crime to be committed—Florida
sexual battery — to punish a crime.
Jokes and comments about prison rape demean the victim and make light of a very serious crime.
Millions of inmates are raped in prison. The normalization of prison rape diminishes the fact that our
justice system has created this epidemic, and reform is required to fix it. Therefore, think next time before
you joke about prison rape. Instead, choose to raise awareness of the suffering of rape survivors and the
pain that no one should have to endure.
