Hate crime (also known as a bias-motivated crime or bias crime)[1] is a prejudice-motivated crime which occurs when a perpetrator targets a victim because of their membership (or perceived membership) of a certain social group or racial demographic. Examples of such groups can include, and are almost exclusively limited to ethnicity, disability, language, nationality, physical appearance, religion, gender identity or sexual orientation.[2][3][4] Non-criminal actions that are motivated by these reasons are often called "bias incidents". "Hate crime" generally refers to criminal acts which are seen to have been motivated by bias against one or more of the social groups listed above, or by bias against their derivatives. Incidents may involve physical assault, homicide, damage to property, bullying, harassment, verbal abuse (which includes slurs) or insults, mate crime or offensive graffiti or letters (hate mail).[5] A hate crime law is a law intended to deter bias-motivated violence.[6] Hate crime laws are distinct from laws against hate speech: hate crime laws enhance the penalties associated with conduct which is already criminal under other laws, while hate speech laws criminalize a category of speech. (Matylda Pogorzelska, European Union Agency for Fundamental Rights (FRA)) FRA has researched practical aspects of access to justice for victims of hate crimes. In total, 263 interviews with police officers, public prosecutors and judges and practitioners working for victim support services were carried out in all 28 EU Member States. Racism and xenophobia, sexual orientation or gender identity and islamophobia seem to be the most prevalent grounds for attacks or threats of violence. Additionally, the findings show that over half of the respondents indicate that public incitement to racist or xenophobic, islamophobic, homophobic and transphobic hostilities constitutes a problem in respective member States. State’s indifference needs to acknowledged as it was pointed out that politicians and other important persons very often are those who start openly express discriminatory attitudes and then, without a serious reaction from the State, it only develops further. Another important aspect is a phenomenon of cyber hate which seems to be totally “out of control”. Several actions could prevent hateful speech in the public sphere, such as: no tolerance of discriminatory speech in political discourses; efforts to monitor hate speech on the Internet; criminalising Holocaust denial and ensuring a common language and understanding of hate crime among all practitioners.

Following US president Donald Trump’s ascension to power, the world has seen a sharp rise in hate crimes against Muslims and other minorities. A 2016 Georgetown University report documented the effects of Trump’s campaign rhetoric on his supporters. Whilst 2015 saw the sharpest increase in documented hate crimes (180 offences), new reports continue trickling into various watchdog sources. As Trump fights to keep his travel ban in place and various US officials begin dialogue with foreign nationals, many are keeping a watchful eye on events surrounding the Muslim world. The Charlie Hebdo, Bataclan, German Christmas Market, Orlando gay nightclub and other violent terrorist attacks have compounded societal divisions, spurring bitter resentment between various denominations of Western society, with secular and moderate Muslims caught in the crossfire. Many are unsure as to how to ameliorate the crisis. Sections of the Left have tried to accommodate refugees fleeing hostile war zones within the MENA region, whilst far-right factions have pushed for legislation to close the borders and stave off further terrorist attacks. Gendered Islamophobia: hate crime against Muslim women Barbara Perry* Faculty of Social Science and Humanities, University of Ontario Institute of Technology, Oshawa, ON, Canada (Received 12 June 2012; accepted 27 June 2013) Post 9/11, most western nations have seen dramatic increases in bias motivated violence against Muslims and those perceived to be Muslim. Predicated on the long- lived vilification of Muslims by the media and the state, such violence is a reactionary reminder of Muslims’ outsider status. Interestingly, little attention has been paid to the particular vulnerability of women and girls to anti-Muslim hate crime. This paper begins such a dialogue. Keywords: hate crime; Islamophobia; gendered violence To name only the ethnic hatred is to make gender hatred invisible. It names the gender violence as something different from hatred. It normalizes the violence against women by not naming it. This invisibility of violence toward women sustains it. (Zillah Eisenstein, 2006, p. 26) Generally, women are not particularly vulnerable to hate crime. Just as the majority of perpetrators are male, so too are the majority of victims. However, this is not the case within the Muslim community. There, women and girls appear to be extremely vulnerable to violence motivated by their status as Muslims, but especially as Muslim women. In part, this is due to the fact that those who are covered, in particular, are readily identifiable. Yet it also has to do with the controlling images of Muslims, women, and Muslim women that render the latter especially attractive and available targets. To understand the hate crime experienced by Muslim women, it is necessary to understand the multiple subject positions they occupy, with particular attention to their cultural identities and their gender. Thus, in what follows, I explore first, bias motivated violence against Muslims and those perceived to be Muslims, and secondly, gendered violence against women. This allows us, then, to move on to discuss the intersectionality of religion, race, and gender which makes women vulnerable to complex patterns of bias motivated violence. The patterns that are described here tend to be replicated across western nations, such as the UK, Australia, Canada and the US. While the emphasis here is largely on America, I also draw on emerging scholarship across other western nations as well. America is home to one of the most diverse Muslim inhabitants in the world. This includes people of nearly every cultural groups, country and school of thought. A significant proportion of Americans are of the opinion that Islam as a religion is incomparable with American values. Nathan Lean has stated that media plays a major role in the promotion of Islamophobia throughout the world. Reports have been observed where seven charitable foundations have spent 43 million dollars between 2001 to 2009 in order to support the spread of anti-Muslim rhetoric. Another factor was revealed which included 2010 Gallup poll win, which 43% of the Americans were, reported to feel a sense of prejudice against Muslims. Fox news has also been identified as the small component of Islamophobia in US media. Fox news has been found to retract false claims about Muslims. Various empirical evidences have been found to provide possible interactions between the latent Muslim feelings and media coverage. However, since 2011, Muslims in the United States have been showing significant concern regarding extremism in the name of Islam across the world. Concurrently, majority are of the opinion that there is minimal support of extremism with Muslim community even though the general public differs (Spring 1,5). This has led to a rise in discernment and fear against Muslims in America. Such a social aversion and prejudice against Muslims in America has been gradually facilitating and continuing by vehement and uncivilized stereotypes exhibited in diverse forms of American media organization and political domains which instigate high level of prejudice, discrimination and exclusion of the Muslims. While some Americans believe Islamic religion promotes terrorism, this misconception is due to ignorance caused by media, but this could be solved by mandatory education about Islam in colleges. The effect of media, chiefly mass news media as well as technology, in influencing Islamophobia has been increasing concern from the time of the 9/11 attacks. Several standpoints tend to problematize the way the media through numerous avenues related to news and film as well as nonfiction destructively depict, racialize and demonize Muslim-American identities. The impression of these edifices of Arabs and Muslims on unconstructive typecasts as well as events of marginalization amongst Muslim-American communities are apprehended in many academic domains. Considine in his study of Muslim portrayal in the United States during late 1980s and early 1990s have found that Muslims have been depicted negatively in news reporting since then.
