8. Cybersecurity Landscape Ahead
⢠It is predicted in 2022:
⢠Ransomware attacks will escalate, double extortion occurs when the attacker exfiltrates data
first, then encrypts it, and only then demands a ransom
⢠There will be a cybersecurity workforce shortage â this is now a college degree specialty in
compute science
⢠Healthcare will struggle with implementing stronger cybersecurity protections
⢠This is a national security issue what with war in late February/early March 2022 in eastern
Europe
⢠Healthcare entities are vulnerable â think of what all is in a medical record
⢠Example: dental patientâs root canal and prescribed (scheduled) drugs versus medical history 8
9. Possible Changes in HIPAA Law
⢠In early 2021, the U.S. Department of Health and Human Services (HHS) published
proposed changes to the HIPAA Privacy Rule. The key elements of those changes are:
⢠Strengthens the patient right to access their medical records
⢠Makes it easier for providers to disclosed protected health information (PHI) for care
coordination and social services
⢠Removes requirement of patient acknowledgement of receipt of Notice of Privacy
Practices (NPP)
⢠Revises NPP content requirement to clarify how patients may exercise their individual
rights
⢠Potential changes to the National Institute of Standards and Technology (NIST)
guidelines
The final rule date is unknown and the compliance date is not until 240 days after the
rule is made final

10. Preparing for Tomorrow
⢠Review and revise your HIPAA risk analysis
⢠Review policies and procedures to make sure they are up to date today, making future
changes less burdensome
⢠Emphasize to staff the importance of providing patients with access to their medical
records-(this has long been an OCR enforcement priority)
⢠Refresh workforce training in basic HIPAA compliance
⢠Example: Indiana state court hospital liability cases involving basic HIPAA compliance
10
11. Patient Access to Medical Records
⢠On December 13, 2016, President Obama signed the 21st Century Cures Act. The deadline for
compliance was April 5, 2021. The Act outlines eight mandatory categories of clinical notes to
be made available to patients. These include:
⢠Consultation notes
⢠Discharge summary notes
⢠History and physicals
⢠Imaging narratives
⢠Lab report narratives
⢠Pathology report narratives
⢠Procedure notes
⢠Progress notes
