1. Foreclosure Process - Mediated
• After defaulting on
mortgage payments,
the lender issues a
Notice of Default (NOD)
to the mortgage holder,
with the option to elect
mediation
• Homeowners have 30
days after being served
with a Notice of Default
to elect participation in
the mediation program
• Once a client elects
mediation, their file is
processed by a
foreclosure mediator
• After file processing,
the mediator is assigned
and contacts Cogburn
Law Offices
• Cogburn Law and the
mediator communicate
to gather the necessary
financial documents &
forms to set a
mediation date
• Once the mediation
date is set, the lender
provides a list of
required documents
and the homeowner
has 15 days to submit
• On the day of
mediation, the client
and Cogburn Law
attorney meet with the
lender and mediator to
reach an agreement on
the mortgage loan
terms
• If an agreement
cannot be reached with
the lender during
mediation, Cogburn
Law may file a petition
for judicial review (if
warranted)
• A judge will review the
case and make a
decision regarding
outcome
