ORDER
A Status Conference was held on November 13, 2014. Margery S.
Bronster and Kenneth S. Robbins appeared by phone on behalf of Robert Ito Farm,
Inc.; Hawaii Farm Bureau Federation, Maui County; Molokai Chamber of
Commerce; Monsanto Company; Agrigenetics, Inc., doing business as Mycogen
Seeds; Concerned Citizens of Molokai and Maui; Friendly Isle Auto Parts &
Supplies, Inc.; New Horizon Enterprises, Inc., doing business as Makoa Trucking
and Services; and Hikiola Cooperative. Patrick K. Wong and Moana Lutey
appeared by phone on behalf of Defendant County of Maui.
At the Status Conference, counsel advised the Court that the parties
have agreed to an extension of the effective date of the Maui County Ordinance,
regarding genetically engineered crops, approved by ballot initiative on November
4, 2014 (“Ordinance”). Counsel are in the process of preparing a Stipulation and

Proposed Order. The Stipulation and Proposed Order shall be submitted to the
Court on or before December 1, 2014, and shall detail the terms of the injunction,
including (1) the reasons why it is issued, (2) its terms specifically, and (3) shall
describe in reasonable detail the act or acts restrained or required. See Federal
Rules of Civil Procedure Rule 65.
In light of the parties’ agreement, and at the request of the parties, the
Court hereby enters an injunction, prohibiting the enactment and enforcement of
the Ordinance until such a time as the Court may review and consider the parties’
Stipulation and Proposed Order, but this injunction shall extend no later than
December 5, 2014, unless further ordered by the Court.
IT IS SO ORDERED.
