No     financial    impact    City  All costs associated with preparing the General Plan

RECOMMENDATION


Staff recommends that the             City Council adopt Resolution approving the initiation of a General
Plan and Eastern Dublin             Specific Plan Amendment Study to evaluate a proposal to change the
land   use    designation      of   7

DESCRIPTION


Background

The   proposed Study Area is         a   acre

Chancery Lane and Grafton Street and along the west side of the Grafton Street between
Central Parkway and Finnian Way Square As shown on the vicinity map below the

southerly boundary of the proposed Study Area abuts the Neighborhood Square and is adjacent
to neighborhoods developed as The Villas 289 units of High Density Residential to the
southwest and The Cottages 200 units of Medium residential west of the Study

The   concept for the Promenade is to create        a   Main Street within Dublin Ranch     The intent and

purpose   is to   provide   a       oriented
                                    pedestrian             and     serving
                                                                   neighborhood          commercial   center

including retail commercial and entertainment serving the daily needs of the surrounding
residentialneighborhoods and providing shopping service and entertainment opportunities for
a wider community base



The Promenade includes          a   SP
                                    P land   usedesignation which allows a variety of uses including
facilities owned by a public agency or non entity such as schools libraries or City office
                                          profit
buildings Additionally quasi uses such as child care centers youth centers senior
                           public
centers religious institutions or other facilities that provide cultural educational or other similar
services that benefit the community also are allowed

ANALYSIS


The General Plan Dublin
            Eastern                                         Specific       Plan land        use   designations for the Promenade                          were

approved by               the   City   Council       on    March       7   2000        As
                                                                                      part        of this
                                                                                               approval                         a   1

the Promenade                  was   given P land
                                           SP                     use      designation The approved project documents stated
that the        City Council            consider       an       application       to   change      the P land
                                                                                                       SP                       use       to   High

                                   SP                       use was  not established within 10 years The                                   year
                                                                                                                                           ten period
has since            passed        and    a     SP
                                                P           use   has not been established on the site                                     Therefore the
Applicant        and        property     owner are now                requesting        a   General Plan Dublin
                                                                                                    Eastern           Specific Plan
Amendment to                   change    the land          use   designation          of this site to          Medium Residential

as   well       as    to        change        the    land       use    designation          of    an   adjacent 2

The   proposed Medium Residential MHR land use designation would allow a

be developed within a range of 80 to 143 units It is anticipated that if the land use is changed
to MHR the development standards in terms of minimum lot size setbacks building height and

coverage requirements would be similar to those adopted previously for The Cottages the
existing residential neighborhood immediately west of the Study

It has been               past practice for the City Council to initiate all General Plan and Specific Plan
Amendment Studies                      prior    to   accepting         an    official    application           and    beginning           work    on   such   a

request Any development of the site still would require a Stage 1 and Stage 2 Planned
Development Rezone Tentative Subdivision Map and Site Development Review

If the    City Council            initiates    a    General Plan and Eastern Dublin                            Specific       Plan Amendment           Study

           1     Examine if the proposed land use designation and density are appropriate for the site
          2      Evaluate the proposal for consistency with the Housing Element
          3      Evaluate any associated environmental impacts from the land use change such as

                 traffic noise or view impacts and prepare the appropriate environmental documents
          4      Perform any additional studies that may be required
          5      Evaluate the proposed land plan and

6    Prepare           an   analysis for consideration by the Planning Commission and the City
              Council


When the         Study     is   complete        and if it results in        a    recommendation to amend the              existing   land

uses Staff would then present the Planning Commission with the proposed General Plan and
Specific Plan land use amendments for recommendation to the City Council The City Council
then     could take action             on      the    General Plan          andSpecific Plan Amendment                    Any related
application      materials would be              presented for        consideration concurrently


Staff has     prepared          draft resolutions
                                             approving Attachment 3 and denying Attachment 4 the
initiation of    a   General Plan and Eastern Dublin   Specific Plan Amendment Study to change the
land   use   designation            from   Semi

NOTICING REQUIREMENTS OUTREACH
         PUBLIC


Although     a   public notice is not required to review                     a request to initiate a General Plan or Specific
Plan Amendment              Study      the     City    mailed notices to all       property owners and tenants within 300
feet of the      proposed Study Area                 as   well   as   all residents and tenants of the Villas the Cottages
the   Courtyards      and the Terraces                all properties        in Area   G    A   public   notice also   was    published
in the   Valley Times and posted in the designated posting places                                      A copy of this Staff     Report
was    distributed to the           Project Proponent

ENVIRONMENTAL REVIEW


The General Plan and Eastern Dublin                              Specific    Plan Amendment         Study    initiation   request has
been reviewed in accordance with the                             provisions      of the California Environmental           Quality   Act

CEQA         and     was   found to be          Categorically Exempt              under Section     15306 Class 6 of the State
CEQA Guidelines Information                     Collection

If approved this land     use conversion will be a classic bait and switch scheme made possible by Dublin City Hall For ten

years   new     East Dublin residents in the tens of thousands have been told that the Promenade would be an upscale

shopping      destination to rival San Jose Santana Row Now that everyone has

around Dublin       Ranch                 based on that             the          of Dublin is
                               Villages                   promise         City                   trying to shoehorn more condos into an     area

already   saturated with       density

come at a worse  time Property values have cratered over the past few years Scrapping the Promenade in favor of
additional high condos beyond the 1 units already built as part ofthe Dublin Ranch Villages will further reduce

the value of my home Even worse the loss of a shopping     dining district within easy walking distance of thousands of
             seriously degrade the quality of life that all of us were seeking when we purchased in the Dublin Ranch

condemns Dublin Ranch Villages to be just another high residential neighborhood almost entirely dependent on

East Dublin schools are already overcrowded The Dublin Unified School District will likely use the impact fees generated

by the new homes to pay off funds borrowed to build Kolb Elementary School instead of creating additional long

capacity for new students As a result students in the already oversubscribed schools in East Dublin could be diverted to
a school    in West Dublin

Residents      living                       Cottages                       Villages     are so   desperate for parking that they have been

years     new   East Dublin residents in the tens of thousands have been told that the Promenade would be an upscale

shopping                         sSantana Row Now that everyone has already bought or rented homes in and
        destination to rival San Jose
around Dublin Ranch Villages based on that promise the City of Dublin is trying to shoehorn more condos into an area

already   saturated with       density
                               high housing

The prospect ofmore high condos instead of the upscale shopping center promised to residents could not have

come at a worse time Property values have cratered over the past few years Scrapping the Promenade in favor of
additional high condos beyond the 1 units already built as part of the Dublin Ranch Villages will further reduce

the value of my home Even worse the loss of a shopping                        dining    district within easy walking distance of thousands of

years new East Dublin residents in the tens of thousands have been told that the Promenade would be an upscale
shopping destination to rival San Jose Santana Row Now that everyone has already bought or rented homes in and

around Dublin Ranch              Villages based on that promise        the City of Dublin is       trying   to shoehorn more condos into an area

already saturated with            density
                                  high housing

The prospect of         high condos instead of the upscale shopping center promised to residents could not have
                          more
                        density
come at a worse          Property values have cratered over the past few years Scrapping the Promenade in favor of
                          time
additional high condos beyond the 1 units already built as part of the Dublin Ranch Villages will further reduce
           density                           400
the value of my home Even worse the loss of a shopping             dining district within easy walking distance of thousands of
residents will seriously degrade the quality of life that all of us were seeking when we purchased in the Dublin Ranch

Villages It also completely contradicts Dublin vision of creating mixed walkable villages within the city and instead

STAFF REPORT CITY CLERK CITY COUNCIL File 420 30 DATE September 20 2011 TO Honorable Mayor and City Councilmembers FROM Joni Pattillo City Manager SUBJECT Promenade KB Home Charter Properties General Plan and Eastern Dublin Specific Plan Amendment Study initiation request PLPA 00035 2011 Prepared by Mike Porto Consulting Planner EXECUTIVE SUMMARY The City Council will consider a request to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate proposal change a to the General Plan and Eastern Dublin Specific Plan land use designation of 5 acres Study Area from Public and 7 Semi Neighborhood Commercial to Medium Residential Density High The proposed land use amendment would allow a residential density of 14 to 25 dwelling units per acre The Study 1 0 Area is located on the south side of Central Parkway between Chancery Lane and Grafton Street and on the west side of Grafton Street north of Finnian Way and the Devaney Neighborhood Square within the area known as the Promenade FINANCIAL IMPACT No financial impact City All costs associated with preparing the General Plan to the Eastern Amendment Dublin Specific Plan Amendment Study if authorized by the City Council would be borne by the Project Proponent RECOMMENDATION Staff recommends that the City Council adopt Resolution approving the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of 7 5 acres on the south side of Central Parkway between Chancery Lane and Grafton Street from Semi Public and Neighborhood Commercial to Medium High Density Residential OR adopt a Resolution denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of 5 acres on the south side of Central Parkway between Chancery Lane and 7 Grafton Street from Public and Semi Neighborhood Commercial to Medium Density High Residential Submitted By Reviewed By Director of Community Development Assistant City Manager Page 1 of 4 ITEM NO 8 3

DESCRIPTION Background The proposed Study Area is a acre 7 5 area within the area commonly referred to as the Promenade The Study Area is located along the south side of Central Parkway between Chancery Lane and Grafton Street and along the west side of the Grafton Street between Central Parkway and Finnian Way Square As shown on the vicinity map below the Devaney southerly boundary of the proposed Study Area abuts the Neighborhood Square and is adjacent to neighborhoods developed as The Villas 289 units of High Density Residential to the southwest and The Cottages 200 units of Medium residential west of the Study Density High Area Properties north of the Study Area across Central Parkway are developed as Sorrento West a Medium Density residential community of 418 units The 5 Study Area includes acre 7 a 3 area currently designated Public P and a 2 area currently acre 1 Semi SP acre 6 designated Neighborhood Commercial NC The concept for the Promenade is to create a Main Street within Dublin Ranch The intent and purpose is to provide a oriented pedestrian and serving neighborhood commercial center including retail commercial and entertainment serving the daily needs of the surrounding residentialneighborhoods and providing shopping service and entertainment opportunities for a wider community base The Promenade includes a SP P land usedesignation which allows a variety of uses including facilities owned by a public agency or non entity such as schools libraries or City office profit buildings Additionally quasi uses such as child care centers youth centers senior public centers religious institutions or other facilities that provide cultural educational or other similar services that benefit the community also are allowed Page 2 of 4

The City received letters from Ray Panek of KB Home South Bay Inc and James Tong of Charter Properties Attachments 1 and 2 to consider of a General Plan and Specific Plan Amendment to change the land use designation for the 5 area from its existing land acre 7 uses to Density Residential High Medium f a r x I P o l 1 y d z j a W F 1 y k ANALYSIS The General Plan Dublin Eastern Specific Plan land use designations for the Promenade were approved by the City Council on March 7 2000 As part of this approval a 1 3 acre site within the Promenade was given P land SP use designation The approved project documents stated that the City Council consider an application to change the P land SP use to High Medium Density Residential if such P SP use was not established within 10 years The year ten period has since passed and a SP P use has not been established on the site Therefore the Applicant and property owner are now requesting a General Plan Dublin Eastern Specific Plan Amendment to change the land use designation of this site to Medium Residential Density High as well as to change the land use designation of an adjacent 2 6 acre Neighborhood Commercial site The proposed Medium Residential MHR land use designation would allow a Density High density of 14 to 25 dwelling units per acre Based on this density the 5 area could 1 0 acre 7 be developed within a range of 80 to 143 units It is anticipated that if the land use is changed to MHR the development standards in terms of minimum lot size setbacks building height and coverage requirements would be similar to those adopted previously for The Cottages the existing residential neighborhood immediately west of the Study It has been past practice for the City Council to initiate all General Plan and Specific Plan Amendment Studies prior to accepting an official application and beginning work on such a request Any development of the site still would require a Stage 1 and Stage 2 Planned Development Rezone Tentative Subdivision Map and Site Development Review If the City Council initiates a General Plan and Eastern Dublin Specific Plan Amendment Study Staff wi I I 1 Examine if the proposed land use designation and density are appropriate for the site 2 Evaluate the proposal for consistency with the Housing Element 3 Evaluate any associated environmental impacts from the land use change such as traffic noise or view impacts and prepare the appropriate environmental documents 4 Perform any additional studies that may be required 5 Evaluate the proposed land plan and Page 3 of 4

Dora Ramirez From Sent Monday September 12 2011 10 PM 47 To Tim Sbranti Kevin Hart Don Biddle Kasie Hildenbrand Eric Swalwell crosecgrp com arounddublin@gmail Subject Keep the Promenade Promise s Dear City Councilmember I do not support the request by KB Home and Charter Properties to convert half of the retail space at the Promenade to condos density high If approved this land use conversion will be a classic bait and switch scheme made possible by Dublin City Hall For ten years new East Dublin residents in the tens of thousands have been told that the Promenade would be an upscale shopping destination to rival San Jose Santana Row Now that everyone has s already bought or rented homes in and around Dublin Ranch based on that the of Dublin is Villages promise City trying to shoehorn more condos into an area already saturated with density high housing The prospect of more condos instead of the center promised to residents could not have density high upscale shopping come at a worse time Property values have cratered over the past few years Scrapping the Promenade in favor of additional high condos beyond the 1 units already built as part ofthe Dublin Ranch Villages will further reduce density 400 the value of my home Even worse the loss of a shopping dining district within easy walking distance of thousands of seriously degrade the quality of life that all of us were seeking when we purchased in the Dublin Ranch residents will Villages completely contradicts Dublin vision of creating mixed walkable villages within the city and instead It also s use condemns Dublin Ranch Villages to be just another high residential neighborhood almost entirely dependent on density cars and yet with seriously insufficient parking for those cars East Dublin schools are already overcrowded The Dublin Unified School District will likely use the impact fees generated by the new homes to pay off funds borrowed to build Kolb Elementary School instead of creating additional long term capacity for new students As a result students in the already oversubscribed schools in East Dublin could be diverted to a school in West Dublin in the Villas and at Dublin Ranch Residents living Cottages Villages are so desperate for parking that they have been the dirt KB Home wants to rezone for more condos Will there be enough parking once more residents parking on patch move into the new KB Home condos Dublin is a wonderful city to live in and I trust that you will do what is right for the community Please maintain along term vision for Dublin instead of falling prey to short planning based on temporary economic conditions Please vote sighted against the request by KB Home and Charter Properties to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate changing half of the Promenade to a Medium Residential Density High land use area I urge you to stop KB Home and Charter Properties from ruining our dream of the Promenade that has been promised for a decade Sincerely John Zukoski
