Health Care Reform Update: Week of October 7, 2013
Commentators have begun noting that the federal government shutdown could delay the release of
additional health care reform guidance, especially if the shutdown lasts a week or two. This could
affect the issuance of updated regulations on Pay or Play, which was originally expected in November
in order to help employers begin preparations for the 2015 implementation. Other important pending
health care reform guidance could be delayed as well, including regulations governing the 90-day
waiting period requirement and elimination of pre-existing conditions. In the absence of such
guidance, Willis recommends that employers begin examining their plans to determine how they are
going to comply based on the information provided in the statute or other guidance that is currently in
place.
