4. Law No. 1433-VQD on “Amendments into the Law on “Public Procurement” of the Republic of
Azerbaijan” was adopted on December 28, 2018. In accordance with Clause 50-1 of the
abovementioned law, the estimated procurement cost of the goods (works, services) in the equivalent
of manat of 3,0 million USD of the procured subject or the goods (works, services) lower than that
amount is carried out only through the participation micro, small and medium entrepreneurship
subjects by applying open tender method through electronic procurement ;
The decree of the President of the Republic of Azerbaijan "On approval of the Regulations on the Single
Internet Portal of Public Procurement" dated April 16, 2019;
The resolution of Cabinet of Ministers of the Republic of Azerbaijan on approval of “Methods of
calculating of estimated prices of goods (works and services)” was adopted on March 18, 2019;
The resolution of Cabinet of Ministers of the Republic of Azerbaijan on approval of the “Regulations of
evaluating the influence of the cases considered in Article 422 of the Civil Code of the Republic of
Azerbaijan to procurement contract”;
The resolution of Cabinet of Ministers of the Republic of Azerbaijan on approval of “The Code of
Conduct of Officers Involved in Government Procurement” was adopted on March 18, 2019.

places it in the united Internet portal.

9. Tender announcement and acceptance of bids
by the procuring entity
The bid issue on holding an open tender through the electronic procurement must be
published through the unified Internet portal of state procurements no later than 20
banking days before evaluating the bids;
Each supplier (contractor) registered to participate at electronic procurement should
be sent the notification of approval under real-time regime through the united
internet portal of the government procurement;
Mutual exchange of information and documentation between procuring entity and supplier
(contractor) is carried out through united internet portal;
Bidsandparticipation fees are presented through the united internet portal;
The meetings ofthetender commission areconducting virtual;
The procuring entity establishes a bid guarantee in the amount of 1 percent of the total
value of the bid and gets guarantee through the united internet portal.

Determiningthewinnerofthetenderandconcluding thecontract
Bids are submitted electronically through the portal;
The united internet portal automatically identifies bids according to their price sequences and sends
them to the tender commission inelectronic formformaking decisions;
The tender commission adopts a decision within 1 banking day and lodges the decision in united
Internet portal;
The procurement contract is concluded with the winner of tender electronically through a
united internet portal.

11. REFORMS İN PUBLİC PROCUREMENT
Considerationofcomplaintsofsuppliers(contractors)
If the complaint is not resolved on the mutual agreement between the Supplier
(Contractor) who filed it and the procuring entity, the procuring entity (or approving
body) makes decision on the considered complaint within 10 banking days.
