Cable TV (Operations) Regulations

Cable TV (Operations) Regulations
• It was enforced in 24 August 2002.
• Which includes every detail of its Licensing Criteria, Council of Complaints,
Offences, Penalties & Enforcement, Quality Standards of Programmes &
Equipments and License For Selling De-Scramblers, Decoders.
Licensing Criteria
License to Operate
• The Authority shall have the exclusive right to issue licenses for the establishment
and operation of all broadcast stations including cable TV networks.
• Every license shall be subject to such term and conditions as provided in the
Ordinance, the rules and these regulations.
• The Authority shall have the powers to charge fees as specified in the Schedule.
Licensing Criteria
Particulars of Application for Grant of a License
• The application shall be made on the prescribed Application Form.
• The applicant shall indicate the desired category of license.
• Every applicant for grant of license shall be accompanied by the application
processing fee (non-refundable).
• The Authority, in case of an MMDS Cable TV Station, may forward the application
to the Frequency Allocation Board (FAB) to ascertain whether the frequency
proposed to be utilized by the applicant is available.

Criteria for Evaluating License Application
Applications shall be short listed by using the following criteria:
• Technical Competence
• Financial Capability
• Credibility and Track Record
• Extent of Pakistani Share in Ownership
Licensing Criteria
Issuance of License
• The Authority shall process each application and on being satisfied that the applicant
fulfils the criteria and procedure as provided in the Ordinance, may issue license to the
applicant.
• In addition to General Terms and Conditions contained in the Schedule, the Authority
may impose on the licensee such other terms and conditions as appear to it necessary.
• If the authority finds that the issue of the license to a particular person is not in the public
interest then they can refuse to grant a license by giving reasons in writing and after giving
the applicant an opportunity of being heard.

Fees and Security Deposits
• Each successful applicant shall deposit the applicable license fee and make a
security deposit before the issue of the license. The security deposit shall be
refundable after the one year of operation of the station.
• The Authority shall have the power to revise and update the application fee and
the fee for the grant, renewal or extension of a license.
Licensing Criteria
Ineligibility for a License
• A person who is not a citizen of Pakistan or resident in Pakistan.
• A foreign company organized under the laws of any foreign government.
• A firm or company whose majority of shares are owned or controlled by foreign
nationals or whose management is controlled by foreign nationals or companies.
• A person whose license under the Ordinance has previously been cancelled
because of the contravention of the provisions of the Ordinance.

License Conditions
• The licenses shall be issued to the eligible applicants through an open bidding
process if the number of applicants is more than the number of license for a
particular area.
• The license shall be valid only for the area of coverage as specified in the
application form and the terms of the license.
• The successful bidders shall pay such applicable license fee, the Security Deposit
and later the Annual Fee.

• The license shall be valid for a period of 5 years and may be renewed.
• Late payment of the license fee shall incur a surcharge of 5% of the license fee per
month up to a maximum of 15%, failing which the license would be deemed to have
been cancelled.
• The licensee shall maintain a record and register of the programme channels and the
advertisements aired or distributed at least of thirty days.

• The licensee shall pay to the Authority 5 % of the gross revenue receipts for
airing or distributing the advertisements on his Cable Television System.
• The license shall be deemed to have been withdrawn and cancelled, if the
licensee fails to put into operation the Cable TV Network Station within a
period of one year from the date of its issuance.

Tariff Rates
• The licensee shall be allowed to charge a maximum subscription fee for the basic
service at the rates as approved by the Authority and reflected in the Schedule.
• The licensee shall not discriminate against any subscriber in offering service and
setting charges.

Internet over Cable
• A Licensed Internet Service Provider may offer Internet services over cable.
• He shall enter into interconnect agreement with the Licensed Cable Operator and
will be subject to the PTA Regulations in addition to the Ordinance, Rules and
Regulations of the Authority.

Provision for Live Broadcasting of Certain Events
• For the purpose of ensuring the widest availability of viewing in Pakistan of a national or
international event of general public interest, The Federal Government or The Authority
may notify in advance.
• The satellite channel operator or broadcaster having distribution rights of the national and
international events of general public interest, shall be obliged to offer such rights to the
national broadcasters to pick up and re-broadcast the events which are relevant to
Pakistani audience.

• The licensee shall be responsible copyright obligations.
• Neither the Authority nor any employee of the Authority shall be responsible for
any offence, damage or other injury which anyone may suffer because of the
negligence or violation of ordinance by the licensee.

Monitoring
• The licensed system shall be monitored with respect to quality of Transmitted
Signals, Content of the Broadcast, Routing of Cables, Installation Standards, Tariffs
and the Complaints of Subscribers.
• Quality of signal will be determined by Transmission Level, Noise, Modulation,
Frequency Drift, and Voltage Levels.
• In case improper installation of cable or other equipment is detected, the operator
shall correct the same within one week of detecting.

• The licensee shall prominently display the license at the business premises
• A cable operator who violates provisions of these Regulations or who gets frequent
complaints from subscribers regarding his service or programming content may be
called by the Council or the authorized officer of the Authority to explain the
reasons.
• The Authority may send a show cause notice to that licensee who violates any
provision of the regulations.

• If the Authority finds the explanation of the licensee is not justifiable then the
authority may cancel the license.
• The Councils of Complaints as established under the Ordinance shall monitor the
cable operations with a view to protecting the interest of the subscribers and to
ensuring ethical and quality cable television service operation.

Establishment of the Councils of Complaints
• There shall be established the Councils of Complaints at Islamabad, the Provincial
Capitals and at such required places for carrying out the functions under the
Ordinance.
• The Regional Councils shall work independently under the supervision of the
Authority and their functions will be coordinated by a Coordinating Officer,
stationed in Islamabad.
• The Regional Councils shall be fully competent to take action on the complaints.
Council of Complaints
Functions of the Councils
• The Councils shall receive and inquire into the complaints made by persons or
organizations from the general public against any aspects of programmes broadcast
or distributed by a Cable TV Network.
• The Councils may recommend to the Authority for appropriate action including the
suspension of a license or imposition of fine.
• The Councils shall monitor all aspects of broadcasts, including the Programmes'
Content, Quality of the Transmissions of the Cable TV Channels.
• The Councils shall keep the Authority informed about the public response to the
contents as well as quality and impact of the programmes and advertisements aired.
Council of Complaints
Duties of the Officers
• The officers work to execute the purposes of the Ordinance and to serve as the Secretarial
set up for the respective Regional Councils.
• The officer in charge of a Regional Office shall be the representative of the Authority and
shall perform such functions and duties as may be assigned to him, from time to time, by
the headquarters. He shall also act as Secretary to the respective Regional Council under
the supervision of the respective Commissioner of Complaints.
• The Authority shall appoint a Coordinating Officer at its headquarters in Islamabad to
coordinate with the Regional Offices of the Councils of Complaints.

Inspection and Enforcement
• In case of illegal operation or violation of the license conditions by a Cable
TV Operator, the Authority may authorize an officer to physically inspect the
place from where illegal operation is being carried out, and on confirmation,
take steps for its immediate closure.
• The Officer may also take appropriate steps for the seizure of the equipment
being used for illegal operation after the permission of the Authority.

Offences and Penalties
• Any CTV Operator who violates any of the provisions of the Ordinance shall be guilty of
an offence punishable with imprisonment for a term which may extend to Six Months, or
with fine which may extend to One Million Rupees, or with both.
• Where such CTV Operator repeats the violation, such person shall be guilty of an offence
punishable with imprisonment for a term which may extend to Three Years, or with fine
which may extend to Two Million Rupees, or with both.
• Where the violation of any provision of this Ordinance is made by a person who does not
hold a license, such violation shall be punishable with imprisonment for a term which may
extend to Four Years, or with fine, or with both, in addition to the seizure of the
equipments.

Offences by Companies
• Where any offence under this Ordinance has been committed by a person
who is in charge of the company and is responsible for the conduct of the
business of the company. So, the company itself shall be deemed to be guilty
of the offence and punished accordingly.

Prohibition of Broadcasts
• The Officer prohibit any cable TV operator to broadcast such particular programme or
the contents of the channel which are likely to create hatred among the people or is likely
to disturb peace or is against the Ideology of Pakistan or contains Pornographic or
Obscene Material or endangers National Security or is violating the terms and conditions
of the license.
• The officer, after making such an order, shall inform the Authority in writing within 24
hours, with his reasons for passing the orders and all relevant supporting material. The
Chairman shall decide whether the matter requires the convening of an emergent meeting
and if in his opinion it does not, the matter shall be put before the Authority in its next
regular meeting.

Proscription of a Foreign Broadcasting Service
• If the Authority considers that the content of any foreign broadcasting
service is unacceptable, it shall order proscription of that service.
• The Authority shall not consider a foreign broadcasting service to be
unacceptable, unless it is satisfied that the content of that service included
any matter which is not in the favour of National Security and Sovereignty
of Pakistan, Public Interest or is obscene or pornographic.

Suspension of the License
• The Authority may suspend the license of a Broadcaster or Cable TV Operator,
for maximum Three Weeks for one or more of the following reasons:
• The licensee has failed to pay the Annual License Renewal Fee.
• The licensee has contravened any Provision of the Ordinance.
• If the shareholders of the licensee transfer the majority of their shares.
• Provided that no license shall be suspended or cancelled unless the licensee has
been given reasonable notice to show cause or personal hearing.

• If a licensee contravenes any provision of the Ordinance or rules and
regulations which are made there under.
• Provided that no license shall be suspended or cancelled unless the licensee
has been given reasonable notice to show cause and personal hearing.

Seizure of Broadcasting or Distributing Equipment
• An authorized officer of the Authority may order the seizure of the broadcast or any
equipment which is used to broadcast a programme.
• The authorized officer may also take steps for closure of the premises where the illegal
operation is being carried out.
• The equipment so seized may be returned to the licensee after imposing punishment.
• The equipment seized for being used for illegal operation or without having a valid license
shall not be returned unless the concerned party files a formal application for grant of
license and also pays such fines as may be imposed by the Authority.

Power to Impose Fine
• The Authority shall have the power to impose fine up to Five Hundred Thousand
Rupees on a CTV Operator who contravenes the provisions of the Ordinance or
any term of the license or any such other instructions issued by the Authority from
time to time.
• The fine so imposed shall be recoverable as arrears of land revenue.

State Agencies to Assist Authority in Enforcement
• All the field officers of Local Administration, Police, Civil Armed Forces and
all officers involved in collection of land revenue shall assist the designated
officers of the Authority in the discharge of their functions, relating to the
enforcement, under the provisions of the Ordinance.

Appeals
• A person, aggrieved by an order of the Authority may appeal to the authority
within thirty days of issuance of the order. The Authority shall decide the
matter within forty five days of the submission of the appeal.
• A person aggrieved by any decision or order of the Authority may appeal to
the High Court within thirty days of the receipt of such decision or orders.
• Provided that no decision or order of the Authority shall be suspended or
revoked, unless the Authority is given an opportunity of being heard.

General Standards for Transmission Programmes
• The licensee shall avoid from receiving or transmitting ineligible channels and shall be
bound to distribute the compulsory programme & channels as notified by the
Government or by the Authority, from time to time.
• The licensee shall include the National TV Broadcast Channels, as the priority serial order
channels, at serial number 1 to 5.
• The licensee shall provide basic service transmission channels to the subscribers. The
channels shall include PTV-1, PTV World, a Quranic Channel and an Islamic Educational
Channel.

General Standards for Transmission Programmes (Continue)
• The licensee shall ensure that nothing is contained in any programme or
advertisement which is harmful to the Sovereignty and Integrity of Pakistan,
Ideology of Pakistan, National Security, friendly relations with Foreign States,
Public Order, Contempt of Court and Defamation or incitement to an offence.
• The licensee shall ensure emphasis on promotion of National Dignity, Values of
National Integration, Religious, Sectarian and Communal Harmony and a Visible
Deference to the Social, Cultural, Moral and Traditional Values of the Pakistani
Society.

General Standards for Transmission Programmes (Continue)
• The licensee shall install effective technical devices in his Cable TV System to block the
distribution of such programmes or advertisements which contains Pornographic,
Obscene Material or violating the Public Morality, Terms of the Code of Conduct or the
Provisions of the Ordinance.
• The licensee shall not use VCR, VCP, DVD or VCD etc. to run pre-recorded programmes
on his Cable TV System.
• The licensee may use the above mentioned devices to run such specific programmes on
Islam or such special subjects as the Authority may determine, with the prior written
permission of the Authority.

General Standards for Transmission Programmes (Continue)
• The licensee may run through the last discussed devices to fill the programme gaps
with the advertisements of his own choice, with the prior written permission of the
Authority.
• The licensee may demand reasonable compensation from such direct Live Channel
Operator to run on his own network system, in case the licensee allows the
advertisements included in the transmission of that channel.

General Conditions and Quality Standards for CTV Operator
• The licensed system shall be fully compatible with the equipment normally in use of the
subscribers in terms of the capability of quality reception of the signals.
• The licensee shall ensure that the installed system meets the criteria for Cable TV Systems as laid
down by local and international standard setting bodies with respect to the Network, Cables, Cable
Installation and Termination, Transmitters, Receivers, Transmitted Signals and other Equipments.
• The licensee shall install special equipment to suppress such advertisements as may be of foreign
origin or violating the pre-established Pakistani Norms and also to suppress Pornography,
Obscenity and other such programmes which may be undesirable or violating the Provisions of
Ordinance.
• The licensee shall respond rapidly to complaints from subscribers.

General Conditions and Quality Standards for CTV Operators (Continue)
• The licensee shall not interrupt service to the subscribers. In case the licensee
wishes to wind up the business, he shall seek approval in writing from the
Authority before sixty days of such action, and subsequently notify the subscribers.
• Licensee is not authorized to up-link or down-link services for which it is not
licensed.
• Licensee is not authorized to up-link or down-link services from Unlicensed
Satellite Operators.

Safety and Environmental Standards
• The licensee shall ensure that the system does not cause interference or harm to the
equipment of his subscribers.
• The licensee shall ensure that cables do not become a nuisance to the public and do
not pose a hazard to people, animals and the natural environment.
• The licensee shall ensure that line isolators are placed at junction points to prevent
electrical voltage from getting onto the system and causing danger to customer
equipment and people.

• The licensee shall obtain necessary permits from the municipal authorities and the
utility companies to lay the cables, where digging of road is required.
• Under no circumstances trees be cut down or removed for the purpose of laying
cables or installing antennas etc. In case such obstacles are present, an alternative
route must be devised even if it means added expenditure to the operator.
• Where cable is strung over utility poles, the operator will ensure that it is installed at
a sufficient height, out of the reach of people and is properly clamped to the poles.
License For Selling De-Scramblers, Decoders
Cable TV De-scramblers and Decoders
• Representatives, Agents, Vendors, Distributors of Satellite Cable TV Broadcasters shall be
licensed by the Authority for selling decoders only to the Licensed Cable TV Operators.
• Applicants shall apply for a license, to sell decoders, on the prescribed form.
• The license shall be valid for a period of 5 years on payment of annual license fee and
other charges.
• The licensee shall not discriminate against any customer in selling decoder units (decoder
box) and channel cards.
• The licensee shall keep a record of all decoders sold.
• The decoders shall not be sold to the house-owners.

• The licensee shall pay such license fee and annual charges to the Authority as
specified in the Schedule.
• The licensee shall submit audited annual accounts to the Authority within
120 days of closing of the Financial Year.

• The licensee shall be allowed to charge a fixed monthly subscription fee from
Customers, Licensed Cable TV Operators for decoders or set top boxes sold
to them.
• The licensee shall not charge more than the approved rates.

Pemra Cable TV (Operations) Regulations 2002

  • 1. PEMRA Cable TV (Operations) Regulations Muhammad Rawaha Saleem Department of Media & Communication Studies Faculty of Social Sciences International Islamic University Islamabad
  • 2. Cable TV (Operations) Regulations • It was enforced in 24 August 2002. • Which includes every detail of its Licensing Criteria, Council of Complaints, Offences, Penalties & Enforcement, Quality Standards of Programmes & Equipments and License For Selling De-Scramblers, Decoders.
  • 3. Licensing Criteria License to Operate • The Authority shall have the exclusive right to issue licenses for the establishment and operation of all broadcast stations including cable TV networks. • Every license shall be subject to such term and conditions as provided in the Ordinance, the rules and these regulations. • The Authority shall have the powers to charge fees as specified in the Schedule.
  • 4. Licensing Criteria Particulars of Application for Grant of a License • The application shall be made on the prescribed Application Form. • The applicant shall indicate the desired category of license. • Every applicant for grant of license shall be accompanied by the application processing fee (non-refundable). • The Authority, in case of an MMDS Cable TV Station, may forward the application to the Frequency Allocation Board (FAB) to ascertain whether the frequency proposed to be utilized by the applicant is available.
  • 5. Licensing Criteria Criteria for Evaluating License Application Applications shall be short listed by using the following criteria: • Technical Competence • Financial Capability • Credibility and Track Record • Extent of Pakistani Share in Ownership
  • 6. Licensing Criteria Issuance of License • The Authority shall process each application and on being satisfied that the applicant fulfils the criteria and procedure as provided in the Ordinance, may issue license to the applicant. • In addition to General Terms and Conditions contained in the Schedule, the Authority may impose on the licensee such other terms and conditions as appear to it necessary. • If the authority finds that the issue of the license to a particular person is not in the public interest then they can refuse to grant a license by giving reasons in writing and after giving the applicant an opportunity of being heard.
  • 7. Licensing Criteria Fees and Security Deposits • Each successful applicant shall deposit the applicable license fee and make a security deposit before the issue of the license. The security deposit shall be refundable after the one year of operation of the station. • The Authority shall have the power to revise and update the application fee and the fee for the grant, renewal or extension of a license.
  • 8. Licensing Criteria Ineligibility for a License • A person who is not a citizen of Pakistan or resident in Pakistan. • A foreign company organized under the laws of any foreign government. • A firm or company whose majority of shares are owned or controlled by foreign nationals or whose management is controlled by foreign nationals or companies. • A person whose license under the Ordinance has previously been cancelled because of the contravention of the provisions of the Ordinance.
  • 9. Licensing Criteria License Conditions • The licenses shall be issued to the eligible applicants through an open bidding process if the number of applicants is more than the number of license for a particular area. • The license shall be valid only for the area of coverage as specified in the application form and the terms of the license. • The successful bidders shall pay such applicable license fee, the Security Deposit and later the Annual Fee.
  • 10. Licensing Criteria License Conditions (Continue) • The license shall be valid for a period of 5 years and may be renewed. • Late payment of the license fee shall incur a surcharge of 5% of the license fee per month up to a maximum of 15%, failing which the license would be deemed to have been cancelled. • The licensee shall maintain a record and register of the programme channels and the advertisements aired or distributed at least of thirty days.
  • 11. Licensing Criteria License Conditions (Continue) • The licensee shall pay to the Authority 5 % of the gross revenue receipts for airing or distributing the advertisements on his Cable Television System. • The license shall be deemed to have been withdrawn and cancelled, if the licensee fails to put into operation the Cable TV Network Station within a period of one year from the date of its issuance.
  • 12. Licensing Criteria Tariff Rates • The licensee shall be allowed to charge a maximum subscription fee for the basic service at the rates as approved by the Authority and reflected in the Schedule. • The licensee shall not discriminate against any subscriber in offering service and setting charges.
  • 13. Licensing Criteria Internet over Cable • A Licensed Internet Service Provider may offer Internet services over cable. • He shall enter into interconnect agreement with the Licensed Cable Operator and will be subject to the PTA Regulations in addition to the Ordinance, Rules and Regulations of the Authority.
  • 14. Licensing Criteria Provision for Live Broadcasting of Certain Events • For the purpose of ensuring the widest availability of viewing in Pakistan of a national or international event of general public interest, The Federal Government or The Authority may notify in advance. • The satellite channel operator or broadcaster having distribution rights of the national and international events of general public interest, shall be obliged to offer such rights to the national broadcasters to pick up and re-broadcast the events which are relevant to Pakistani audience.
  • 15. Licensing Criteria Copyright • The licensee shall be responsible copyright obligations. • Neither the Authority nor any employee of the Authority shall be responsible for any offence, damage or other injury which anyone may suffer because of the negligence or violation of ordinance by the licensee.
  • 16. Licensing Criteria Monitoring • The licensed system shall be monitored with respect to quality of Transmitted Signals, Content of the Broadcast, Routing of Cables, Installation Standards, Tariffs and the Complaints of Subscribers. • Quality of signal will be determined by Transmission Level, Noise, Modulation, Frequency Drift, and Voltage Levels. • In case improper installation of cable or other equipment is detected, the operator shall correct the same within one week of detecting.
  • 17. Licensing Criteria Monitoring (Continue) • The licensee shall prominently display the license at the business premises • A cable operator who violates provisions of these Regulations or who gets frequent complaints from subscribers regarding his service or programming content may be called by the Council or the authorized officer of the Authority to explain the reasons. • The Authority may send a show cause notice to that licensee who violates any provision of the regulations.
  • 18. Licensing Criteria Monitoring (Continue) • If the Authority finds the explanation of the licensee is not justifiable then the authority may cancel the license. • The Councils of Complaints as established under the Ordinance shall monitor the cable operations with a view to protecting the interest of the subscribers and to ensuring ethical and quality cable television service operation.
  • 19. Council of Complaints Establishment of the Councils of Complaints • There shall be established the Councils of Complaints at Islamabad, the Provincial Capitals and at such required places for carrying out the functions under the Ordinance. • The Regional Councils shall work independently under the supervision of the Authority and their functions will be coordinated by a Coordinating Officer, stationed in Islamabad. • The Regional Councils shall be fully competent to take action on the complaints.
  • 20. Council of Complaints Functions of the Councils • The Councils shall receive and inquire into the complaints made by persons or organizations from the general public against any aspects of programmes broadcast or distributed by a Cable TV Network. • The Councils may recommend to the Authority for appropriate action including the suspension of a license or imposition of fine. • The Councils shall monitor all aspects of broadcasts, including the Programmes' Content, Quality of the Transmissions of the Cable TV Channels. • The Councils shall keep the Authority informed about the public response to the contents as well as quality and impact of the programmes and advertisements aired.
  • 21. Council of Complaints Duties of the Officers • The officers work to execute the purposes of the Ordinance and to serve as the Secretarial set up for the respective Regional Councils. • The officer in charge of a Regional Office shall be the representative of the Authority and shall perform such functions and duties as may be assigned to him, from time to time, by the headquarters. He shall also act as Secretary to the respective Regional Council under the supervision of the respective Commissioner of Complaints. • The Authority shall appoint a Coordinating Officer at its headquarters in Islamabad to coordinate with the Regional Offices of the Councils of Complaints.
  • 22. Offences, Penalties & Enforcement Inspection and Enforcement • In case of illegal operation or violation of the license conditions by a Cable TV Operator, the Authority may authorize an officer to physically inspect the place from where illegal operation is being carried out, and on confirmation, take steps for its immediate closure. • The Officer may also take appropriate steps for the seizure of the equipment being used for illegal operation after the permission of the Authority.
  • 23. Offences, Penalties & Enforcement Offences and Penalties • Any CTV Operator who violates any of the provisions of the Ordinance shall be guilty of an offence punishable with imprisonment for a term which may extend to Six Months, or with fine which may extend to One Million Rupees, or with both. • Where such CTV Operator repeats the violation, such person shall be guilty of an offence punishable with imprisonment for a term which may extend to Three Years, or with fine which may extend to Two Million Rupees, or with both. • Where the violation of any provision of this Ordinance is made by a person who does not hold a license, such violation shall be punishable with imprisonment for a term which may extend to Four Years, or with fine, or with both, in addition to the seizure of the equipments.
  • 24. Offences, Penalties & Enforcement Offences by Companies • Where any offence under this Ordinance has been committed by a person who is in charge of the company and is responsible for the conduct of the business of the company. So, the company itself shall be deemed to be guilty of the offence and punished accordingly.
  • 25. Offences, Penalties & Enforcement Prohibition of Broadcasts • The Officer prohibit any cable TV operator to broadcast such particular programme or the contents of the channel which are likely to create hatred among the people or is likely to disturb peace or is against the Ideology of Pakistan or contains Pornographic or Obscene Material or endangers National Security or is violating the terms and conditions of the license. • The officer, after making such an order, shall inform the Authority in writing within 24 hours, with his reasons for passing the orders and all relevant supporting material. The Chairman shall decide whether the matter requires the convening of an emergent meeting and if in his opinion it does not, the matter shall be put before the Authority in its next regular meeting.
  • 26. Offences, Penalties & Enforcement Proscription of a Foreign Broadcasting Service • If the Authority considers that the content of any foreign broadcasting service is unacceptable, it shall order proscription of that service. • The Authority shall not consider a foreign broadcasting service to be unacceptable, unless it is satisfied that the content of that service included any matter which is not in the favour of National Security and Sovereignty of Pakistan, Public Interest or is obscene or pornographic.
  • 27. Offences, Penalties & Enforcement Suspension of the License • The Authority may suspend the license of a Broadcaster or Cable TV Operator, for maximum Three Weeks for one or more of the following reasons: • The licensee has failed to pay the Annual License Renewal Fee. • The licensee has contravened any Provision of the Ordinance. • If the shareholders of the licensee transfer the majority of their shares. • Provided that no license shall be suspended or cancelled unless the licensee has been given reasonable notice to show cause or personal hearing.
  • 28. Offences, Penalties & Enforcement Cancellation of License • If a licensee contravenes any provision of the Ordinance or rules and regulations which are made there under. • Provided that no license shall be suspended or cancelled unless the licensee has been given reasonable notice to show cause and personal hearing.
  • 29. Offences, Penalties & Enforcement Seizure of Broadcasting or Distributing Equipment • An authorized officer of the Authority may order the seizure of the broadcast or any equipment which is used to broadcast a programme. • The authorized officer may also take steps for closure of the premises where the illegal operation is being carried out. • The equipment so seized may be returned to the licensee after imposing punishment. • The equipment seized for being used for illegal operation or without having a valid license shall not be returned unless the concerned party files a formal application for grant of license and also pays such fines as may be imposed by the Authority.
  • 30. Offences, Penalties & Enforcement Power to Impose Fine • The Authority shall have the power to impose fine up to Five Hundred Thousand Rupees on a CTV Operator who contravenes the provisions of the Ordinance or any term of the license or any such other instructions issued by the Authority from time to time. • The fine so imposed shall be recoverable as arrears of land revenue.
  • 31. Offences, Penalties & Enforcement State Agencies to Assist Authority in Enforcement • All the field officers of Local Administration, Police, Civil Armed Forces and all officers involved in collection of land revenue shall assist the designated officers of the Authority in the discharge of their functions, relating to the enforcement, under the provisions of the Ordinance.
  • 32. Offences, Penalties & Enforcement Appeals • A person, aggrieved by an order of the Authority may appeal to the authority within thirty days of issuance of the order. The Authority shall decide the matter within forty five days of the submission of the appeal. • A person aggrieved by any decision or order of the Authority may appeal to the High Court within thirty days of the receipt of such decision or orders. • Provided that no decision or order of the Authority shall be suspended or revoked, unless the Authority is given an opportunity of being heard.

Quality Standards of Programmes & Equipments General Standards for Transmission Programmes • The licensee shall avoid from receiving or transmitting ineligible channels and shall be bound to distribute the compulsory programme & channels as notified by the Government or by the Authority, from time to time. • The licensee shall include the National TV Broadcast Channels, as the priority serial order channels, at serial number 1 to 5. • The licensee shall provide basic service transmission channels to the subscribers. The channels shall include PTV-1, PTV World, a Quranic Channel and an Islamic Educational Channel.
  • 34. Quality Standards of Programmes & Equipments General Standards for Transmission Programmes (Continue) • The licensee shall ensure that nothing is contained in any programme or advertisement which is harmful to the Sovereignty and Integrity of Pakistan, Ideology of Pakistan, National Security, friendly relations with Foreign States, Public Order, Contempt of Court and Defamation or incitement to an offence. • The licensee shall ensure emphasis on promotion of National Dignity, Values of National Integration, Religious, Sectarian and Communal Harmony and a Visible Deference to the Social, Cultural, Moral and Traditional Values of the Pakistani Society.
  • 35. Quality Standards of Programmes & Equipments General Standards for Transmission Programmes (Continue) • The licensee shall install effective technical devices in his Cable TV System to block the distribution of such programmes or advertisements which contains Pornographic, Obscene Material or violating the Public Morality, Terms of the Code of Conduct or the Provisions of the Ordinance. • The licensee shall not use VCR, VCP, DVD or VCD etc. to run pre-recorded programmes on his Cable TV System. • The licensee may use the above mentioned devices to run such specific programmes on Islam or such special subjects as the Authority may determine, with the prior written permission of the Authority.
  • 36. Quality Standards of Programmes & Equipments General Standards for Transmission Programmes (Continue) • The licensee may run through the last discussed devices to fill the programme gaps with the advertisements of his own choice, with the prior written permission of the Authority. • The licensee may demand reasonable compensation from such direct Live Channel Operator to run on his own network system, in case the licensee allows the advertisements included in the transmission of that channel.
  • 37. Quality Standards of Programmes & Equipments General Conditions and Quality Standards for CTV Operator • The licensed system shall be fully compatible with the equipment normally in use of the subscribers in terms of the capability of quality reception of the signals. • The licensee shall ensure that the installed system meets the criteria for Cable TV Systems as laid down by local and international standard setting bodies with respect to the Network, Cables, Cable Installation and Termination, Transmitters, Receivers, Transmitted Signals and other Equipments. • The licensee shall install special equipment to suppress such advertisements as may be of foreign origin or violating the pre-established Pakistani Norms and also to suppress Pornography, Obscenity and other such programmes which may be undesirable or violating the Provisions of Ordinance. • The licensee shall respond rapidly to complaints from subscribers.
  • 38. Quality Standards of Programmes & Equipments General Conditions and Quality Standards for CTV Operators (Continue) • The licensee shall not interrupt service to the subscribers. In case the licensee wishes to wind up the business, he shall seek approval in writing from the Authority before sixty days of such action, and subsequently notify the subscribers. • Licensee is not authorized to up-link or down-link services for which it is not licensed. • Licensee is not authorized to up-link or down-link services from Unlicensed Satellite Operators.
  • 39. Quality Standards of Programmes & Equipments Safety and Environmental Standards • The licensee shall ensure that the system does not cause interference or harm to the equipment of his subscribers. • The licensee shall ensure that cables do not become a nuisance to the public and do not pose a hazard to people, animals and the natural environment. • The licensee shall ensure that line isolators are placed at junction points to prevent electrical voltage from getting onto the system and causing danger to customer equipment and people.
  • 40. Quality Standards of Programmes & Equipments Safety and Environmental Standards (Continue) • The licensee shall obtain necessary permits from the municipal authorities and the utility companies to lay the cables, where digging of road is required. • Under no circumstances trees be cut down or removed for the purpose of laying cables or installing antennas etc. In case such obstacles are present, an alternative route must be devised even if it means added expenditure to the operator. • Where cable is strung over utility poles, the operator will ensure that it is installed at a sufficient height, out of the reach of people and is properly clamped to the poles.
  • 41. License For Selling De-Scramblers, Decoders Cable TV De-scramblers and Decoders • Representatives, Agents, Vendors, Distributors of Satellite Cable TV Broadcasters shall be licensed by the Authority for selling decoders only to the Licensed Cable TV Operators. • Applicants shall apply for a license, to sell decoders, on the prescribed form. • The license shall be valid for a period of 5 years on payment of annual license fee and other charges. • The licensee shall not discriminate against any customer in selling decoder units (decoder box) and channel cards. • The licensee shall keep a record of all decoders sold. • The decoders shall not be sold to the house-owners.
  • 42. License For Selling De-Scramblers, Decoders Decoder Selling License Fee • The licensee shall pay such license fee and annual charges to the Authority as specified in the Schedule. • The licensee shall submit audited annual accounts to the Authority within 120 days of closing of the Financial Year.
  • 43. License For Selling De-Scramblers, Decoders Decoder Tariff • The licensee shall be allowed to charge a fixed monthly subscription fee from Customers, Licensed Cable TV Operators for decoders or set top boxes sold to them. • The licensee shall not charge more than the approved rates.
