accc.gov.au ACCC use of surveys in merger analysis • Have occasionally used consumer surveys for local-market retail matters, particularly supermarket mergers. • Used to test geographic market range • Where do you shop • What other options do you have • Used to test the competitiveness of the target store(s), particularly in relation to quality/range
accc.gov.au Surveys as evidence in court • Survey evidence not generally used in court • Never used in a merger matter in court • Australian Court has a guideline on surveys, which encourages parties to reach agreement on survey design before survey conducted. But even if parties agree, no guarantee the Court will give survey much weight.
accc.gov.au Other data gathering techniques used sometimes • Credit card transaction data • Loyalty scheme data • Petrol data – special case in Australia Data gathering techniques used often • Win/loss • Tender data • Sales, price & volume data (sometimes above data extracted from all market participants (i.e. all competitors or all customers)) • Market inquiry calls

  • 2. accc.gov.au ACCC use of surveys in merger analysis • Have occasionally used consumer surveys for local-market retail matters, particularly supermarket mergers. • Used to test geographic market range • Where do you shop • What other options do you have • Used to test the competitiveness of the target store(s), particularly in relation to quality/range
  • 3. accc.gov.au Surveys as evidence in court • Survey evidence not generally used in court • Never used in a merger matter in court • Australian Court has a guideline on surveys, which encourages parties to reach agreement on survey design before survey conducted. But even if parties agree, no guarantee the Court will give survey much weight.
