PCT APPLICATION ENTRY INTO
VIETNAM’S NATIONAL PHASE
Introduction
Vietnam has been a member of Patent Co-
Operation Treaty (PCT) since 10 March
1993.
Patent will be granted for inventions that
meet all protection criteria on novelty,
industrial applicability and inventiveness.
Time limitation
Under Vietnam’s Patent Law, the deadline
for filing a patent application for entry into the
National phase under PCT will be within 31
months from the earliest priority date or from
the international filing date of the application
and this limitation can be extended up to 6
months with a payment of extra-fee for the
delay.
Documents required
 Power of Attorney (POA) which
should be only signed by the
applicant, the original POA should be
submitted within 34 months from the
priority date of the application;
 The description of the application
including specification, set of claims
and amendment in national phase (if
any).
The Vietnamese version of the
description should be submitted at
the filing time.
Procedure & Time frame
For grant of patent, the application will be
processed through the following steps.
 Filing Receipt:
 Formal examination: this
examination step will be carried out
to determine whether or not the
application for patent is filed in due
form. This step will take 01 month
from the filing date on which, all
necessary documents are duly
submitted or from the 34th month
from the priority date of the
application;
 Publication: After being accepted as
filed in due form at the end of the
formality examination, the
application for patent shall be
published in the National Industrial
Property Gazette within 02 months
from the date on which the Notice of
official acceptance of application is
filed in due form is issued.

The period for opposition by any third party
is commenced from the publication date until
before the granting date. It means that the
period for opposition is not fixed. It is
effective as far as the application for patent
is not granted.
 Substantive examination: to
determine the patentability of the
application. This examination will be
carried out on request of the
applicant which can be file at the time
of filing or within forty-two (42)
months counted from the priority
date of the application.
This step will be performed in 18 - 24
months from the publication date if
the request for substantive
examination is filed prior to the
publication date of application or
from the date on which the request is
filed after the publication date of
application;

CERTIFICATION TRADE MARKS IN
VIETNAM
Background
A certification trade mark is acceptable and
registrable under two forms according to the
origin or quality of the mark in Vietnam
pursuant to the Article 105 of Law on
Intellectual Property of Vietnam. Hitherto,
there are twenty-four (24) certification trade
mark registrations in Vietnam and these
numbers could be more increased in future.
The below table gives more detailed
information about these certification trade
mark registrations:
Registration
In general, registration for a trademark will
be about twelve (12) months; however, in
fact, the period of the process may be
prolonged 3-6 months than usual depending
on NOIP’s workload.
Required documents
The applicant should prepare all the
statutory required documents before
registering:
i. Trademark Application made in
prescribed form; receipt of fees;
trademark samples, information
identifying the mark as provided
(usually prepared by the trademark
agent);
ii. Regulation on use of certification
trade marks (consists of the principal
contents: (i) the organization or
individual being the mark owner; (ii)
conditions for using the mark; (iii)
characteristics of goods or services
certified by the mark; (iv) methods of
evaluating characteristics of goods
or services and methods of
controlling the use of the mark; (v)
expenses to be paid by the mark
user for the certification and
protection of the mark, if any)
iii. The Power of Attorney is also
needed if the application is filed by
an IP agent/attorney;
iv. The priority documents are also
needed if priority right is claimed.
If the needed documents are presented in a
foreign language (not in Vietnamese), they
should be translated into Vietnamese before
submission.
Comment
The registration process of certification trade
marks in Vietnam is almost similar to the
registration process of marks.
The owner of the certification trade mark
should further be noted that in the process of

using certification trade mark, if he/she
violates the regulation on use of certification
trade mark or fails to supervise or
ineffectively supervises the implementation
of such regulation, the validity of a protected
title shall be terminated.
