4. General Terms and Conditions for “Celebration of Life” Slideshow.
1. Order acceptance
Orders are only accepted and processed in accordance with the following conditions. Signing the acceptance of these
conditions and contract from MH Photography means that the implicitly accepts these terms & conditions.
2. Copyright
The customer is responsible for the content of the provided file (digital or printed media). MH Photography accepts no
liability for the content of the file and assumes that the client holds all copyrights for the file. The customer is exclusively
responsible for any consequences of the illegal use of protected data. In addition, the customer must strictly comply with
the legal regulations of the concerned country when placing the order and distributing the printed material.
3. Liability
MH Photography will make every effort to ensure the safety and condition of any articles provided as we fully understand
that such items are precious and of significant personal value. Therefore we do not recommend employing standard
postal services.
MH Photography does not accept any liability for damage or loss of photo media or digital files. MH Photography liability
remains limited to avoidable production errors. MH Photography will contact the client if extensive repair to photo media is
required, no work will be undertaken on affected media before the clients consent, agreement and payment for the repair.
4. Delivery time
MH Photography understands that timescales may be limited and will make every effort to deliver the products within the
required period; the standard time for delivery is 3 days. For timescales less than 3 days must be agreed in advance.
All standard orders will be produced within five (3) days of receipt of the payment. Under no circumstances may any delay
of required media such as photos or documents necessary for video production justify cancellation of the order or any
right to compensation.
Any additional information or photos presented after the initial order date will be classed as non-standard. It is the
responsibility of the client to ensure delivery of this additional material to MH Photography by the end of day 2.
Non-standard products may not be accepted at the discretion of management.
5. Returns and cancellations
When placing orders for goods and services on the Internet or by mail order you would generally have the right to cancel
your order, free of charge, by giving notice within 7 days of the order. However, this does not apply where the service
ordered is commenced immediately. You hereby consent to MH Photography commencing immediately and as such you
will not have a right to cancel your orders. We will, naturally, do our best to stop producing an order if you contact us
quickly. Due to the personalised nature of photo products we are unable to offer refunds on these items, save where we
are required to do so by law. Refunds may be given at the discretion of the management; should you have any questions
please email us. Your statutory rights are not affected by this clause.
6. Guarantee
Notification of all claims, insofar as they concern a clear deficiency, must be provided within two weeks after delivery of
the customer's order. In the case of a valid complaint, restitution will be limited to producing the order again.
7. Illegal use
You warrant that you will not use any of the services for any fraudulent or illegal purpose and that you will not submit any
image that:
(a) is unlawful, pornographic, indecent, defamatory, offensive, obscene, otherwise objectionable or harmful to
(or which depicts harming) children in any way; or

5. (b) would constitute, assist or encourage a criminal offence, violate the rights of any party, or that would
otherwise create liability or violate any local, state, national, or international law; or
(c) infringes any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;
or
(d) Use the service to transmit or invite access to any images described in paragraphs (a) through (c) above
and you accept and undertake that you will be liable for any action taken against Pictured Memories in
relation to such activities and will fully indemnify Pictured Memories against all actions, claims, demands or
costs which may arise as a result.
(e) Your attention is also drawn to the Performing Rights Society (PRS) Limited Manufacturing License; this is
supplied to comply with the PRS copyright laws on music. The Limited Manufacturing License allows the
client to play the DVD in a public place; the license is valid for one year only from date of issue. After the
expiry date, MH Photography passes the responsibility of the production to the client.
(f) The slideshow does not come with a license from the PRS for displaying online. The client if they wish to
upload this to a website or social media is fully responsible for purchasing this license from the PRS. MH
Photography takes no responsibility for the action.
8. Age
You warrant and undertake that you are at least 18 years of age and the authorised owner of the details which you supply
to MH Photography.
9. Price/specification
Postage and packaging where appropriate will be listed separately. MH Photography shall not be liable for any other
taxes or duties that may be imposed upon you and for which you will remain fully responsible.
Prices and specifications are subject to change without notice in any circumstances other than where an order has been
accepted by MH Photography.
The purchase price is payable in advance before work commences. The 3 day production time starts from receipt of the
payment. The finished slideshow will be stored on a USB in a fire proof box and an iCloud server. The show will be kept
for three years to enable further copies to be ordered if the client wishes.
