The goal of competency remediation is to teach
people what we can about the juvenile justice sys-tem
as well as improve the juvenile’s adaptive skill
deficits that may have contributed to competency
concerns being raised. The Behavioral Specialist’s
role is to teach each juvenile to the best of their
ability toward the goal of competency.

ENDING SERVICES
Competency remediation services come to an
end for the following reasons:
The Judge determines that the juvenile is
either competent or not competent and
not likely to become competent within
the statutory timeframe that remains.
The commitment for competency reme-diation
has reached the end of the statu-tory
timeframe.
The juvenile’s behavior is consistently
inappropriate and the juvenile is not
responsive to redirection.
Strategies which may be used to facili-tate
competency restoration include:
Role playing
Video/Audio
Educational games
Didactic training
Stress management
Continued communication with the
juvenile’s community support
network (e.g. social worker, case
manager)

COMPETENCY RESTORATION SERVICES
WHAT THE JUVENILE
FORENSIC PROGRAM IS
The Juvenile Forensic
Program is one of several
services offered through
Behavioral Consultants,
Inc. Juvenile competency
services include court-ordered evaluations (i.e.
competency to stand trial, NGI, etc) as well as
competency remediation services. Court-ordered
evaluations are completed by licensed
psychologists. Competency remediation is con-ducted
by Master’s level clinicians referred to as
“Behavioral Specialists,” who are responsible for
coordinating appointments, providing direct
remediation services, and preparing treatment
summaries to the Court. Currently, the Juve-nile
Forensic Program considers referrals
statewide on a case-by-case basis.
REFERRING
If the court orders a juvenile to obtain compe-tency
remediation services, BCI should be con-tacted
directly. At the time of the referral,
documentation needed includes:
the delinquency petition(s)
recent competency evaluation(s)
pertinent records
the appropriate court order, and contact
information.
LEGAL BASIS
Wisconsin State Statute 938.30(5)(e) states “A juvenile
who is not competent to proceed, as described in
s. 971.13 (1) and (2), but who is likely to become
competent to proceed within 12 months or within the
time period of the maximum sentence that may be
imposed on an adult for the most serious delinquent
act with which the juvenile is charged, whichever is
less . . . shall be periodically reexamined with written
reports of those reexaminations to be submitted to the
court every 3 months and within 30 days before the
expiration of the juvenile's commitment or disposition-al
order.
COMPETENCY EVALUATION
A court order is required for each competency evalua-tion
to take place. Arrangements for each competency
evaluation are managed by the Probation Officer,
officer of the Court, or another community support
(i.e. Wraparound, etc). Each competency evaluation
will opine whether the juvenile is
Competent, thus ending remediation services and
reinstating Court proceedings
Not competent and still likely to become compe-tent
within the statutory timeframe, thus remedi-ation
would continue
Not competent and not likely to become compe-tent
within the statutory timeframe, thus ending
remediation services while Court proceedings
remain suspended
