1) Ann Forrester was struck by a delivery van driven by Richard Hart, an employee of Mercury Parcel Services, Inc., while walking on a icy road.
2) As a result of the accident, Ann Forrester suffered multiple fractures, paralysis confining her to a wheelchair, depression and other injuries causing her pain and suffering.
3) Ann and her husband William Forrester are suing Richard Hart and Mercury Parcel Services for negligence seeking $750,000 in damages for Ann's injuries and $20,000 for William's loss of consortium with his wife.

residesat1223 PennyLane,Cincinnati,Ohio.
5. DefendantMercuryParcel Service,Inc.,isincorporatedinthe state of Delaware withits
principal place of businesslocatedat603 StokerSt.,Cincinnati,Ohio.
6. On February26, 2014, at approximately7:30A.M., Plaintiff AnnForresterwaswalkingacrossa
hillyand partially icysectionof Highway328 inthe Cityof Legalville,Countyof Capital,inthe
State of Columbia.
7. At that time,DefendantHartwasdrivinga van onbehalf of hisemployerandthe ownerof the
van,DefendantMercuryParcel Service,Inc.
8. DefendantHartoperatedthe vannegligentlyby:
a. Drivingthe vehicle atanexcessiverate of speedunderthe circumstances;
b. Failingtoexercise aproperlookout;
c. Failingtoexercise adequate control of saidvehicle;and
d. Otherwise failingtoexercisedue andadequate care underthe circumstances.
9. As a directconsequence of the Defendants’negligence,the Plaintiffwasstruckdownbythe
Defendants’vanandseriouslyinjured.
10. Because of saidnegligence,the Plaintiff sufferedfracturesof the left leftandhip;damage tothe
lowerspine; tornmuscles,tendons,tissue,andnerves;insomnia;paralysisthatconfineshertoa
wheelchair;depression;andothermaladies, causingherintensepainandgreatsufferingand
considerable inconvenience whichwill continue inthe future.
11. As a consequence of the Defendants’negligence andthe aforesaidinjuries,the Plaintiffhas
incurredandwill incursubstantial monetarylossesforhospital andmedical care,lossof income
and benefits,domesticservices,and propertydamagestohercoatand clothing.

WHEREFORE the Plaintiff demandsjudgmentinthe amountof severhundredandfiftythousanddollars
($750,000), togetherwiththe costsanddisbursementsof thisactionandfor suchotherrelief asthis
