PUBLIC STATEMENT
In my legal capacity, acting as attorney-at-law of M. Petro POROSHENKO,
I, Maître Grégory THUAN DIT DIEUDONNÉ, state the following.
I am a former senior lawyer at the European Court of Human Rights and I
am a recognised expert in the field of European Human Rights Law. Today,
I have the honour of being one of the lawyers for M. Petro POROSHENKO,
former reformist President of the Ukrainian Republic and one of the leaders
of the opposition.
After an initial examination of the elements of his case and of the exorbitant
and inconsistent charges brought against him, I can affirm, beyond
reasonable doubt, that the impugned proceedings initiated resemble to be
fundamentally motivated by political considerations.
The troubled political context existing in Ukraine since May 2019, the lack of
independence of the Prosecutor General's Office vis-à-vis the current
Presidency, the lack of fairness in the hasty implementation of the
proceedings against M. POROSHENKO and the revelation of the telephone
tapping of november 2019, lead me to that conclusion.
There are therefore a priori in this case many solid elements incriminating the
authorities in power in Ukraine, as raising multiple violations of the European
Convention on Human Rights, and in particular the violation of Article 18 of
the ECHR prohibiting the use of political motives to restrict freedoms,
Article 6 § 2 (presumption of innocence), and Article 5 (the right to liberty).
As an experienced Human Rights lawyer, I am concerned by this state of
affairs in Ukraine and call for a democratic leap forward to fully and
effectively respect the principles of the rule of law.
