This presentation (in English and French) was delivered during an IIED webinar on Wednesday, 21 September, which discussed the topic of special economic zones and the broader questions they raise, particularly in Senegal and Madagascar.
This presentation was delivered by Dr Perrine Burnod and Heriniaina Rakotomalala, respectively researcher at CIRAD; and land expert and PhD candidate at the Institut d’Agro from Montpellier and Antananarivo University.

2. A Madagascar In Madagascar
Au-delà des ZES, une attention portée à
toutes les zones dédiées à l’investissement
*Afrique du Sud, Kenya,
Ethiopie, Sénégal,
Madagascar, Bangladesh,
Myanmar, Thaïlande,
République dominicaine, et
Costa Rica
* South Africa, Kenya,
Ethiopia, Senegal,
Madagascar, Bangladesh,
Myanmar, Thailand,
Dominican Republic, and
Costa Rica
Beyond SEZs, a focus on all investment
zones
3. Contexte des zones d’investissements
Depuis la fin des années 1980, des zones
dédiées à l’investissement prônées :
par les gouvernements successifs
dans différents secteurs : services,
industrie, agriculture
sous 5 labels différents
objectif similaire : offrir un accès au
foncier sécurisé légalement et dépourvu
de tout conflit.
Context of the investment zones
Since the end of the 1980s, investment
zones have been promoted :
by successive governments
in different sectors: services, industry,
agriculture
under 5 different labels
similar objective: to offer legally
secured and conflict-free access to
land.

6. Des cadres juridiques multiples
pour ces différentes zones,
mais pour la majorité inachevés
Secteur des industries et des services : une
multiplication de lois sans décrets d’application
(sauf pour les ZEF, régime qui prévaut)
Secteur agricole : une absence de loi
Secteur foncier : une loi fortement attendue sur
les « statuts spécifiques » (qui inclut les zones
d’investissements mais aussi, entre autres, les
aires protégées ou les domaines communautaires)
et sources de controverses
Multiple legal frameworks for zones, but
mostly uncomplete
Industry and services sector: a multiplication of
laws without implementing decrees (except for
the FZE, which is the prevailing regime)
Agricultural sector: no law
Land sector: a long-awaited law on "specific
status" (which includes investment zones but
also, among others, protected areas or
community domains) and sources of controversy

9. Industries et services :
aucune zone fonctionnelle

zones (no FZ in 30 years,
no IIZ or SEZ in 7 years)
Only free enterprises
Socio-economic

2000's: growth in terms of

At the end of the 2000’s:

Agriculture: zones struggling to materialise
En 2021, Région
Vakinankaratra, en 15 ans,
moins de 500 hectares de
ZIA
Terrains titrés à l’Etat =
répétition d’une même
séquence depuis 1920 :
installation et échec des
entreprises, colonisation
informelle et expulsion des
paysans
paysans
In 2021, Vakinankaratra
Region, after 15 years, less
than 500 hectares of IAZ
Land titled to the State =
repetition of the same
sequence since 1920:
setting up and failure of
companies, informal
installation and eviction of
farmers
11. Agriculture : des ZIA paysannes avec de
meilleurs résultats économiques que les
ZIA entrepreneuriales
En 2015, paysans expulsés ou reconnus comme
opérateurs (en association)
En 2021, résultats socio-économiques :
Mêmes cultures et rendements similaires
Entreprises – 25 ha en moyenne - ne valorisent
que 40% des 450 ha cédés,
Associations paysannes – 0,15 ha par paysan -
cultivent 98% des 50 ha cédés
Agriculture: farmer AIZs with better
economic results than entrepreneurial ZIAs
In 2015, farmers evicted or recognised as
operators (in association)
In 2021, socio-economic results :
Same crops and similar yields
Companies - 25 ha on average - cultivate only
40% of the 450 ha transferred,
Farmers' associations - 0.15 ha per farmer -
cultivate 98% of the 50 ha ceded

restitution

13. Un fort besoin d’accès au foncier
- pour toutes les catégories d’acteurs
(entreprises, ONG, associations ou exploitations
familiales)
- à penser de façon conjointe et articulée
A strong need for access to land
- - for all categories of actors (companies NGOs,
associations or family farms)
- - to be thought through in a joint and articulated
manner
entreprises agricoles, paysans)
- en négociant / achetant des terres auprès
de possesseurs fonciers locaux
The state struggles to identify and title land in its
name
In the end, national operators access land mainly
- outside the zones (free enterprises, agricultural
companies, farmers)
- by negotiating / buying land from local
landowners
16. Eviter les expropriations
Reconnaitre légalement les droits
des possesseurs fonciers locaux :
- loi existante sur les terres
individuelles (réforme de 2005),
- loi à élaborer sur les domaines
communautaires
Avoiding expropriation
Legally recognise the rights of local tenure
holders:
- existing law on individual lands since
2005 reform,
- law to be developed on community
domains
projets d’investissement doivent
appartenir à l’Etat
Construire un projet collectif, avec
l’ensemble des propriétaires, à l’échelle
d’un territoire
2 visions
« Etat propriétaire et organisateur » VERSUS
« acteurs locaux (individuels ou collectifs)
reconnus propriétaires et libres de devenir
opérateurs ou de céder leurs terres aux
opérateurs (contrats accompagnés par l’Etat) »
To facilitate access to land
Move away from a vision in terms of strictly
demarcated zones
Move away from a vision where land for investment
projects must be owned by the state
Build a collective project, with all landowners, on
a territorial scale
2 visions
"State as owner and organiser" VERSUS
« local actors (individual or collective) recognised as
owners and free to become operators or to hand over
their land to operators (contracts supported by the
State) »
communautaires
A study that provides food for thought and debate
on the forthcoming law on "land with special status”
=> investment zones et, en amont, land subject to community rights
