Bombay HC commutes
death penalty of 3 to life
Will revisit `8 L annual income
criteria for EWS, Centre tells SC
Mumbai: The Bombay
HighCourtonThursday
commutedtolifeimpris-
onment the death pen-
alty awarded to three
convicts in the 2013 gang
rape case of a 22-year-
old photojournalist in-
side the defunct Shakti
Mills compound in cen-
tral Mumbai, saying
that they “deserve im-
prisonment for life to
repent the offence com-
mitted by them”.
A division bench of
Justices Sadhana Jad-
hav and Prithviraj
Chavan refused to con-
firm the death penalty
awarded to Vijay Jad-
hav, Mohammad Qasim
Shaikh and Mohammad
Ansari, and commuted
their sentence to life im-
prisonment for the re-
mainder of their lives.
The bench, while pro-
nouncing its order said
that it cannot ignore the
fact that the offence has
shocked the collective
conscience of the soci-
ety and rape is a viola-
tion of human rights,
but the sentence of
death is irrevocable.
New Delhi: The Centre
on Thursday told the Su-
preme Court that it will
revisit the Rs 8 lakh an-
nual income criteria for
Economically Weaker
Sections (EWS) to be eli-
gible for reservation
benefits.
Solicitor General
Tushar Mehta, appear-
ing for the Centre, con-
veyed this to a bench
headed by Justice D Y
Chandrachud and
sought four weeks’ time
for the same.
The question of the
EWS criteria had arisen
in the context of its in-
troduction in the NEET
(All India Quota), coun-
selling for which had
been put on hold earlier,
pending a final decision
on a petition challeng-
ing the quota rules.
On Thursday, the SG
assured the bench, also
comprising Justices
Surya Kant and Vikram
Nath, that the counsel-
ling will be deferred by
four weeks.
Hearing the plea ear-
lier, the SC had asked
the Centre to explain
what exercise it had un-
dertaken to arrive at the
Rs 8 lakh annual income
criteria to identify EWS

ervation in medical

J
t was BJP’s slo-
gan to make India
Congress-mukt
(free) but it has
struggled to make
that happen. Now other lead-
ers have quietly started
working towards that objec-
tive. The first set of these
leaders are members of the
Congress Party itself. One
saw 10 of the 15 Congress leg-
islators in Goa joining the
BJP in 2019. It’s senior leader
and former Goa Chief Minis-
ter Luizinho Faleiro recently
chose to quit the party to join
Trinamool Congress. In the
latest setback, 12 of the 17
Congress MLAs in Megha-
laya joined the TMC. The de-
fectors include ex-CM Mukul
Sangma who was unhappy
with the party’s choice of
Vincent H. Pala as president
of the state unit. Congress
had earlier suffered a jolt in
2018 when despite emerging
as the largest single party
with 21 seats it could not
form a government as it was
out-manoeuvred by the BJP.
Earlier it was Tripura
where seven Congress lead-
ers, including former minis-
ter Prakash Chandra Das,
switched over to the TMC in
July 2021. Some more Tripu-
ra Congress leaders joined
the TMC a month later.
TwoCongressleaders---Kir-
ti Azad and Ashok Tanwar---

Banerjee when she was on a
visit to Delhi a few days ago.
It is not important to know
who is a bigger threat to Con-
gress, BJP or the TMC. What
is important for the party’s
leadership is to find out why
its state leaders and workers
are so disenchanted that they
leave the party not in ones or
twos but literally in droves.
The helpless leadership is
unable to reverse the trend.

SPIRITUAL SPEAK
‘To the illumined man
or woman, a clod of
dirt, a stone, and gold
are the same.’
—Bhagavad Gita
he Constitution is not just
legislation. This is Indian cul-
ture because in a way, it ex-
plains the philosophy associ-
ated with Indian culture and
the lofty life traditions that
we have. I believe that a na-
tion is not just a land or ter-
rain; it is a thought in itself.
The meaning of seeing the
country in the noun of
thought is a nation in which
there is no distinction of any
kind on the basis of caste and
religion, where experience
and knowledge are partners.
The meaning of Bharat is
that great tradition of knowl-
edge and philosophy in which
the essence comes from the
Vedic hymns to the Advaita
philosophy of Adi Shanka-
racharya. Our nation has
given the message of consid-
ering the whole world as our
family with the sutra of ‘Vas-
udhaiva Kutumbakam’. Our
Constitution is a kind of writ-
ten form of this lofty idea.
The origin of the Constitu-
tion is that great tradition of
ours, in which it is said ‘Lok-
ah Samastah Sukhino
Bhavantu’. Everyone’s happi-
ness lies in public welfare.
This is the basic premise of
the Constitution. That’s why
I designate the Constitution
with Indian culture. India is
a union of states. When the
country got Independence,
the biggest challenge before
us was how to make the Con-
stitution of this huge country
in a short time. But it is very
important that taking this
challenge in hand, the work
of making a constitution was
started. Due to the tireless ef-
forts of the assembly formed
for constitution making, the
Constitution of the country
came before the people of In-
dia in a refined form after
continuous hard work for 2
years 11 months 18 days.
Dr.BhimraoAmbedkarwas
appointed as the chairman of
the drafting committee. After
examining all the constitu-
tions of the world closely
, our
Constitution was prepared
and implemented keeping in
mind the social culture and
diversity of the country
.
It is very important that the
original draft of the Constitu-
tioncontainsanartisticdepic-
tion of Indian culture. On the
request of the Chairman of
the Constituent Assembly
, Dr
Rajendra Prasad, the Kalagu-
ru of Shantiniketan, Nandlal

tution draft.
Maharishi Aurobindo’s
spiritual nationalism, the
Sanatan Indian tradition
from the Vedic period to the
20th Century, great tradi-
tions from Ramayana, Ma-
habharata and Indian cul-
ture with the understanding
of the basic structure of In-
dian civilization have been
specially depicted in the
draft of the Constitution.
IalsobelievethattheIndian
Constitution is the best inter-
pretation of democracies
around the world. Every time
I have studied the Constitu-
tion, I have found that it is an
accumulated reflection of the
ideals,objectivesandvaluesof
the country
. In a way
, our Con-
stitution is a global document
of human rights and duties.
In this context, I always re-
member Mahatma Gandhi’s
saying that the Ganges of
rights flows from the Himala-
yas of duties.
The Constitution teaches
us to balance rights and du-
ties. The best Preamble of
the whole world belongs to
the Constitution of our coun-
try. In the Preamble of the
Constitution, its power is di-
rectly vested in the people.
The ideal of democracy is
self-evident from the words
‘We the people of India’ in the
Preamble of the Constitu-
tion. I believe that ‘We the
people of India’ is not just a
sentence. This is a way of life
philosophy of our great In-
dian culture.
After becoming the Gover-
nor of Rajasthan, my first
priority was to build Consti-
tution parks in universities.
The objective behind this has
been that the new generation
of the country, the youth and
the public, should develop
faith in the Constitution and
the youth studying in univer-
sities could directly connect
with our culture of the Con-
stitution. I am happy that my
intention of setting up Con-
stitution Park in almost all
the universities of Rajasthan
is being fulfilled. I want eve-
ry citizen of India to have
this faith. That is why it re-
mains my endeavor in all the
public programmes in the
state, where I participate,
that the Preamble of the Con-
stitution and Fundamental
Duties should be read.
Giving a democratic form
to the Constitution and the
basic working system of gov-
ernance, we have declared
our country a Republic in the
true sense. Republic refers to
a system of government
whose constitutional head is
elected by the people. India
has the parliamentary sys-
tem therefore the President
is the supreme hero of the
Indian Republic and his posi-
tion is that of the Head of the
State, duly elected by the ma-
jority of all the elected MPs
and MLAs.
The journey of the Repub-
lic of India, which began on
January 26, 1950, has been
full of ups and downs, yet In-
dia has earned a reputation
as the strongest democracy
in the world. The big reason
for this is that our Constitu-
tion is directly related to the
public mind. Through the
Constitution, we have real-
ized the best form of a wel-
fare state. That is why practi-
cal fundamental rights, du-
ties and directive principles
of state policy have been
given in the Constitution.
Indian culture is Karma
oriented culture. Accepting
all the changes that take
place with the course of time,
there is an emphasis in it on
the motivation to move for-
ward continuously
. The Con-
stitution gives us constant
inspiration for this.
Indian Constitution is such
a system based on equality in
which emphasis has been
given on living a life of high
ideals while living fearlessly
.
Come,onConstitutionDay
,let
us bow down to all the great
Constitution makers and be-
come a participant in the all-
round development of the na-
tion with the works of public
welfare and public worship.

Chandigarh: A lot is
about to change now af-
ter the announcement
of the withdrawal of
the controversial agri-
cultural laws. Preneet
Kaur, a Congress MP
from Punjab’s Patiala
constituency and a for-
mer Union Minister,
had been hesitant to
join her husband Cap-
tain Amarinder Singh’s
party till now, but after
the announcement of
withdrawal of all three
farm laws, she is now
ready to go to Captain’s
Punjab Lok Congress.
She recently said
while talking to the me-
dia that she is with her
family. She never men-
tioned this before past
Thursday. On the con-
trary, whenever Cap-
tain was asked whether
Preneet Kaur would
leave the Congress and
join his party, he used
to reprimand the jour-
nalists.
Until the withdrawal
of farm laws, he was
not sure that if a by-
election was held on the
seat of Preneet Kaur,
she would be able to en-
sure her victory. But
now the husband and
wife are feeling that
they can win in the by-
election. In fact, Cap-
tain has announced an
alliance with the BJP
and after the withdraw-
al of the three laws, he
is campaigning in Pun-
jab spreading the claim
that he is also a contrib-
utor towards the return
of these laws. By this
he is creating a harmo-
ny with the farmers. If
Preneet Kaur quits the
Congress and joins his
party, she will also re-
sign from the Patiala
Lok Sabha seat and
there will be a by-elec-
tion along with the
Punjab Assembly elec-
tions to be held in Feb-
ruary-March next year.
Captain has an-
nounced that he him-
self will contest from
the Patiala assembly
seat. In such a situa-
tion, he is hoping to win
both the seats with the
support of the BJP. If
Preneet Kaur resigns,
her seat will also be-
come a seat of prestige
for state Congress pres-
ident Navjot Singh Sid-
hu. However, in the first
round, Sidhu has won
as Captain has refused
to contest against him
on Amritsar East seat.

Modi to start campaigning for U’khand
polls in December first week: Minister
Dehradun: Ahead of
the Uttarakhand As-
sembly elections, Union
Minister and State BJP
in-charge Pralhad Joshi
on Thursday said that
Prime Minister Naren-
dra Modi is likely to
start campaigning for
the polls in the first
week of December.
However, Mr Joshi
said that the dates are
yet to be finalised.
Speaking to media
during a two-day con-
vention in Dehradun
starting today, Union
Minister and BJP Utta-
rakhand in-charge
Prahlad Joshi said,
“Prime Minister Naren-
dra Modi may start the
election campaigning
in the first week of De-
cember. The dates are
yet to be finalised and it
will be confirmed after
the meeting.”
He further said, “We
are fully prepared for

Despite prohibition,
Bihar struggles to
control illicit liquor
Sharat K Verma
Patna: In recent
times, dozens of peo-
ple have died after
consuming spurious
liquor in Bihar, with
the majority of the
deaths occurring
around festivals. Re-
gardless, alcohol is
sold on every street
corner in Bihar.
Surprisingly, five
years after the deci-
sion to prohibit liq-
uor, the ground situ-
ation in Bihar is that
it is the easiest and
biggest source of em-
ployment for the
youth, as the majori-
ty of the population
is engaged in smug-
gling of liquor.
There are factories
of illicit liquor all
around, and with the
help of the police and
administration, this
business is flourish-
ing.
Chief Minister Ni-
tish Kumar is also
aware of this, just as
Prime Minister Nar-
endra Modi is aware
of the effect of de-
monetisation. But
Nitish is adamant on
his insistence that
the prohibition will
remain in force.
Recently, after the
incident of poison-
ous liquor, the Chief
Ministertalkedabout
reviewing the policy
of prohibition, and it
seemed that perhaps
he would withdraw
this decision. But he
gave the responsibil-
ity of implementing
the prohibition to an
officer like KK
Pathak and ordered
more strictness. Or-
dering more strin-
gent measures means
increasing the recov-
ery. After the deci-
sion of more strict-
ness, the earnings of
the police and admin-
istration have also
increased.

‘State should function within

New Delhi: Lok Sabha

POSTAL REG NO. JPC/010/2019-21
Rajendra Chhabra
Jaipur: The GAD is one
of the key depts of any
govt and in Rajasthan,
from the very begin-
ning, senior and experi-
enced IAS officers have
been holding reins of
this dept. However, over
the course of the past
few years, situation in
the dept has gone from
bad to worse as the govt
itself is being lackadai-
sical towards the de-
partment as a result of
this, the dept is in a
‘topsy-turvy’ situation.
In fact, it was the pre-
vious govt that started
the trend of damaging
the direction and situa-
tion of GAD by giving
the Secy of a different
dept, additional charge
of GAD. Then, under
current dispensation,
the state of affairs has
gone several notches
down and the frequency
withwhichofficershave
come and gone from
dept, making an all time
record,hasalso‘destabi-
lised’ dept. It is surpris-
ing to know that in past
3 years, 9 officers have
come and gone. They
are: T Ravikant, Rajesh
Sharma, Bhawani De-
tha, Pritam B Yashwant,
Hemant Gera, Dinesh
Kumar Yadav, Gayatri
Rathore, Roli Singh and
only last week Jitendra
Kumar Upadhyay has
taken the charge.
It is important to note
that the reins of this
‘most important depart-
ment’ of the state govt,
which have been hand-
ed to ACS, Principal
Secy or senior Secy lev-
el officers, that respon-
sibility has now been
entrusted to considera-
bly new and junior Sec-
retaries like Rajesh
Sharma, Pritam B.
Yashwant and Dinesh
Kumar Yadav.
Officers like Bhawani
Detha and Gayatri
Rathore, were entrusted
withworkof otherdepts
as well, and therefore
they were unable to give
proper attention to
GAD. As a result every-
thing is in a mess in the
GAD and rules and reg-
ulations are being flout-
ed at every moment.
A total of 5 IAS are post-
ed in GAD i.e. Roli Sin-
gh, Jitendra Upadhyay,
Shelly Kishnani, Rajen-
dra Shekhawat and
Ramawatar Meena and
it is for the first time
that an ‘army’ of IAS of-
ficers is working in
GAD.Butbetweenthem,
the rules of business are
being violated over the
distribution of work
and responsibilities.
Shelly Kishnani has
been posted in GAD as
Special Secy but she is
handling the works and
affairs of Estates. Har-
sahai is also appointed
as JS in GAD but he is
handling affairs of Mo-
tor Garage and Civil
Aviation. Even though
he is an RAS, Meena is
the boss of Director of
Civil Aviation - IAS Ra-
jendra Shekhawat - and
Controller of Motor Ga-
rage - IAS RA Meena.
Roli Singh, who is
long a long leave, contin-
ues to hold the charge of
Chief of Protocol and
DG, Civil Aviation and
new Secretary Jitendra
Upadhyay has not been
giventhisresponsibility
.
Why it is so, is beyond
comprehension.
The works of Cabinet
Secretariat is of sensi-
tivenatureandsecretive
but this work has been
handed to retired offic-
ers Kailash Gupta and
Chanda Lal Meena, who
have been appointed as
advisors. Both of them
sign the cabinet files
without any authority
to do so and cabinet no-
tices, agenda and mem-
os are released after
their signatures. Not
only is this highly ir-
regular and wrong, but
dangerous as well since
private individuals do
not have any accounta-
bility or are responsible
for secrecy
. Therefore, it
also needs to be investi-
gatedastowhoputthese
two on the posts even
after their retirement
and for what purpose.
THE ABYSMAL SITUATION OF GENERAL ADMINISTRATION DEPARTMENT!
RHB TAKES POSSESSION OF
LAND WORTH OVER `250 CR
Major action by Rajasthan Housing Board overseen by Commissioner Pawan Arora to
remove encroachment from RHB’s land in Pratap Nagar with total area of 24,000 sq mt
Shivendra Parmar
Jaipur: RHB took a ma-
jor action against tres-
passers by removing
possession of about 9
bigha and 5 biswa land
located at prime loca-
tion in Pratap Nagar
Yojna and got it en-
croachment free on
Thursday. It is worth
mentioning that the
market price of this
land is being estimated
at over Rs 250 to 300 cr.
RHB Commissioner
Pawan Arora informed
that for Pratap Nagar,
Sanganer Yojna
(Phase-5) of RHB, a to-
tal of 20,176 bighas of
land was acquired by
RHB in 1990.
He said that as soon
as copy of decision of
court was received, ac-
tion was taken to make
the above 9 bigha and
five biswa land en-
croachment-free. “Here
agriculture was being
done by the cultivators,
marriage gardens were
maintained, permanent
and temporary con-
structions were made
for keeping and rearing
animals,” he said.
An explanation was
given by the commis-
sioner to remove pos-
session from the culti-
vators. On the advice of
Arora, an affidavit was
given by cultivators
that they themselves
are ready to comply
with the court and will
not go to court in this
matter. Although in this
case, RHB has already
filed a caveat in the dou-
ble bench in HC.
“Whatever compen-
sation can be given to
the cultivators, will be
provided. They will get
land as compensation,
so we will demolish the
entire encroachment
excepttheareainwhich
their residence is situ-
ated,” Arora said, fur-
ther adding, “This land
is located at the prime
location on the corner
of Mahal Road and Hal-
di Ghati Road.”
Meanwhile, the RHB
Commissioner also ex-
pressed his gratitude to
Deputy Commissioner
of Police (East) Prahlad
Krishniya, Pratap Na-
gar police SHO Balveer
Singh along with other
policemen for getting
this land encroach-
ment-free.

Surat: A day after
courting controversy
by making sexist state-
ments, MoS Rajendra
Gudha has been re-
minded by CM Gehlot to
be watchful and mod-
est. Chief Minister
Ashok Gehlot has ob-
jected to the statement
of MoS Rajendra Gud-
ha, who talked about
making the roads of his
constituency like Kat-
rina Kaif's cheeks. CM
Gehlot has advised the
MoS to be modest. On
Wednesday, MoS Gudha
had told in a program in
his area, Hema Malini
has become old now,
now roads should be
made like Katrina Kaif's
cheeks. The CM has
raised serious objec-
tions to this statement.
Gehlot said that con-
text in which Gudha
made such statement is
not known to him. We
will find out in what
context he said this and
why. Sometimes the
context changes, the
purpose of saying
something is different
and something else goes
on. I can say is that eve-
ry person should have
dignity and ministers
and CM should be more
dignified, Gehlot said.

TRAFFIC PARKS
IN 17 DISTRICTS
APPROVED
Jaipur: Chief Minis-
ter Ashok Gehlot has
sanctioned Rs 3 crore 74
lakh 64 thousand for the
establishment of traffic
parks in 17 districts of
the state. Through these
traffic parks, the general
public can be made aware
of traffic rules via models,
signals, simulators etc. of
mini electric vehicles or
golf carts. It is notewor-
thy that the Chief Minister
Ashok Gehlot had made a
budget announcement of
setting up traffic parks in
each district of the state
and spending Rs16 crore
50 lakh for this work to
make students and the
general public aware
about road safety. In view
of the compliance of this
budget announcement,
Chief Minister Ashok
Gehlot has given this ap-
proval of traffic parks.
In 1994 award of this land was
done in favor of RHB RHB had
deposited compensation in civil
court in 2009. The rest of the land was tak-
en over by Board, but various writ petitions
were presented in court by cultivators of
about 9 bigha and 5 biswa land on basis of
false claims. After over 7 years, on Novem-
ber 17, 2021, writ was rejected by HC, court
said that paper possession of this land has
already been taken by RHB, so Board can
take possession of this land.

limbs to specially abled at Piraman Village near Anklesvar.
In actuality, 3 other departments that have been
clubbed with GAD - Civil Aviation, Estate and
Motor Garage, have their own existence and today
the ministers of these departments are also
different. The work allotted to IAS, RAS and
officers of Secretariat services can be done only
through DoP but the officials in GAD are
following their own whims and fancies
From Pg 1...
From Surat, Gehlot
travelled to Bharuch,
at the head of a large
congregation of Con-
gress leaders, where
he took part in the pro-
gram and held a two-
minute silence for the
departed soul and of-
fered floral tributes.
During the program,
Patel’s daughter
Mumtaz Patel ad-
dressed the gathering
as Gehlot took part in
the ‘Divyang Sahayata
Shivir’ organized on
the occasion.
Addressing the me-
dia, Gehlot said, “This
camp has been organ-
ized in memory of
Ahmed Bhai wherein
aid equipment are be-
ing provided to the
specially abled indi-
viduals. This camp
will be successful with
everyone’s coopera-
tion. It is sad that
Ahmed Bhai is not
with us. He was doing
AICC work even when
he was undergoing
treatment. In 1977,
when Congress lost
across the nation,
Ahmed Bhai won from
here. He used to treat
all leaders equally.
Ahmed Bhai was an
exceptional and
skilled organizational
man.”
Meanwhile, firing
salvos at BJP, Gehlot
claimed that the Vijay
Rupani-led govt’s ‘fail-
ure’ to handle 2nd
wave of corona in Gu-
jarat led to its ouster.
“It shows that Modi
and Shah are afraid of
people’s mood, be-
cause there was mis-
management in tack-
ling coronavirus
here,” he said.
