4. About RTE Act
• The Right to Education Act is an act of the Parliament of India enacted
on 4th August 2009, which describes the modalities of the importance
of free and compulsory education for children between 6 to 14 in
India under Article 21a of the Indian Constitution.
• India became one of the 135 countries to make education a
fundamental right of every child when the Act came into force on 1st
April 2010.
5. Key Points to remember-
• The act makes education a fundamental right of every child between the
age of 6 to 14 and specifies minimum norms in elementary schools.
• It requires all private schools to reserve 25% of the seats to children.
• Kids are admitted in to private schools based on economic status or caste
based reservations.
• It makes provisions for no donation
• It also makes provision for no interview of the child or parent at the time of
admission.
• There is also a provision for special training of school drop- outs to bring
them up to par with students of the same age.
6. Key features of RTE-
• The act requires surveys that will monitor all neighbourhoods,
identify children requiring education, and set up facilities for
providing it.
• No child shall be held back, expelled or required to pass a board
examination until the completion of elementary education.
7. Key features of RTE-
• If a child above 6 years of age has not been admitted in any school or could
not complete his or her elementary education, then he or she shall be
admitted in a class appropriate to his or her age, then, in order to be at par
with others, her or she shall have a right to receive special training within
such time limits as may be prescribed. Provided further that a child so
admitted to elementary education shall be entitled to free education till
the completion of elementary education even after 14 years.
8. Key features of RTE-
• School teachers will need adequate professional degree within five
years or else will lose job.
• School infrastructure need to be improved in every 3 years, else
recognition will be cancelled.
• Financial burden will be shared between the state and the central
government.
9. What is ‘Free and Compulsory Elementary
Education’
• All children between the ages of 6 and 14 shall have the right to free
and compulsory elementary education.
• There is no direct (School fees) or indirect cost (uniforms, textbooks,
mid day meals, transportation) to be borne by the child or the
parents to obtain elementary education.
• The government will provide schooling free- of – cost until a child’s
elementary education is completed.
10. RTE promotes Child- Friendly Schools?
• All schools must comply with infrastructure and teacher norms for an
effective learning environment. Two trained teachers will be provided
for every sixty students at the primary level.
• Teachers are required to attend school regularly and compete
curriculum instructions, access learning abilities and hold regular
parent- teacher meetings.
11. Quality Norms for all schools
• The act lays out some basic norms for all schools (government and
private)
1. Pupil- teacher ratio (1:30)
2. Minimum days of school functioning in a year (200 and 250 for
primary and Upper Primary respectively)
3. Minimum hours of instructions in school (4 and 5 hours a day for
primary and UP)
4. Minimum working hours for the teacher (45 hours a week)
5. Separate and functional toilets, clean and adequate drinking water
6. Playground, library and kitchen.
12. Qualifications for teachers
• Para teachers banned
• All teachers must subscribe to minimum qualifications and training
norms laid out by Academic Authority within 5 years.
• Teacher education and Teacher training institutes to be upgraded to
enable fulfilment of quality and qualifications norms for teachers.
