使用 CC 音樂於公播授權的處理
– 許多電視或廣播頻道,在製播與播放相關影帶時,皆要求
背景音樂必須出具公播授權書,那如果是使用創用 CC 授
權的音樂,此公播授權書要向誰申請,或應該如何出具

公播授權書的需求,原則上就使用創用 CC 授權音樂上,並不必然
需要,因為採用創用 CC 授權( Creative Commons Licenses )提
供作品的作者,透過該授權條款提供給使用者的使用權利,包括改
作、改用至影片中( adaptation )的權利,其授權範圍為全球性
( worldwide ),並且明示其授權原則上不受「著作權集體管理團
體( Copyright Collective Management Organizations )」機制之
影響,以下舉創用 CC 姓名標示 3.0 條款之節錄為例示,其明確述

授權人 棄由個人,或當授權人是著作權集體管理團體(或稱為拋
「著作權仲介團體」)的會員的情況下,透過該集體管理團體,向
收取權利金的權利。(您 Voluntary License Schemes. The

or, in the event that the Licensor is a member of a collecting society
that administers voluntary licensing schemes, via that society, from

故於網路播出,下載創用 CC 授權的音樂進行使用時,毋須洽原作
者或著作權集體管理團體來取得額外的書面證明,包括國內 STBA
的另行授權原則上也是不需要的,若相關行政流程要求必須出具書
面佐證文件時,以 http://incompetech.com/ 網站上 "Hypnothis" by
Kevin MacLeod 這首曲子為例,可採行的證明文件製作方式,得列
印以下兩個網址,作為證明文件:
