Divorce
In Singapore, in order to get a divorce, the
parties have to be married for a t least
three years and must satisfy the
jurisdiction issues before filing for a writ of
divorce. The court will grant a divorce only if there is proof that the marriage has irretrievably
broken down.
The grounds of divorce are:
• Adultery
• Unreasonable behaviour
• Desertion
• 3 years of separation with consent or 4 years of separation
Annulment
Like divorce, annulment is a court procedure that terminates a marriage. The difference is that an
annulment treats the marriage as though it never happened. The legal process and the grounds
of annulment are also different. Unlike divorce, the parties do not have to be married for three
years and may apply to court to annul the marriage by presenting a ‘Writ for Nullity’ within a
reasonable time.

3. The common grounds of annulment are:
• One of the parties was already married when the marriage took place
• Spouse wilful refusal to consummate a Marriage.
• Duress / No valid consent to the Marriage
• Spouse already married at the time of the Marriage
• Spouse suffering from a communicable sexually transmitted disease at the time of Marriage
• Spouse pregnant with someone else’s child at the time of Marriage
