This is an introduction of the Dispute Resolution Center established by Circle of Voice Trust to provide Alternative Dispute Resolution Mechanisms including Mediation, Conciliation and Arbitration.

About
• Circle of Voice Trust is a not for profit civil society organization and
has been working since 2004 in Pakistan, serving humanity without
any distinction and discrimination.
• Circle of Voice Trust has witnessed that conflicts and disputes
amongst the members of the society and non-availability of timely
justice has tarnished the moral, social and economic growth of
Pakistan.
• Circle of Voice Trust has developed a program to provide solution to
conflicts and dispute resolution through its Law Division.

The Law Division
The objective of the Law Division is to facilitate the general public in
solving their conflicts and disputes.
The Law Division of Circle of Voice Trust comprises of three Sub-
Divisions:

The Dispute Resolution Council
The Dispute Resolution Council is focused towards providing solutions
to conflicts and disputes through Alternative Dispute Resolution
Mechanisms.

The Legal Aid Council
The objective of Legal Aid Council is to provide facilitation to general
public for Action and Defense in the Courts of Law at all levels.
The membership of Legal Aid Council shall include of practicing
lawyers/advocates.

The Law Forum
The objective of Law Forum is to provide a platform where general
public can have replies to their general legal queries and ask for
guidance.
The Law Forum shall not solicit or provide solicitation services for
practicing lawyers/advocates for legal business. However, a list of
practicing lawyers/advocates can be maintained which the seeker can
use and decide at his or her own will.

COVT Dispute Resolution Center (CVDRC)
• The COVT Dispute Resolution Center (CVDRC) shall be managed and
operated by the Dispute Resolution Council of Circle of Voice Trust.
• The objective of establishing CVDRC is to provide a Platform for Dispute
Resolution:
For cases already pending in the Courts of law
For people not willing to go to the court, or not in a position to afford the cost of the
legal procedures
• This Alternative Platform of CVDRC is focused on providing the following
benefits to the society:

The dispute resolution mechanisms available with CVDRC are:
• Mediation
• Conciliation
• Arbitration

What is Mediation?
• A neutral person called a “Mediator" helps the parties try to reach a
mutually acceptable resolution of the dispute. The Mediator does
not decide the case, but helps the parties communicate so they can
try to settle the dispute themselves.

What is Conciliation?
• Conciliation can be similar to mediation, although the conciliator’s
role may be more directive and advisory.
• A neutral person called a “Conciliator" helps the parties try to reach a
mutually acceptable resolution of the dispute. The Conciliator does
not decide the case, but helps the parties communicate and advise
them so they can try to settle the dispute themselves.

What is Arbitration?
• It is an adjudicatory dispute resolution process in which one or more
arbitrators issues a judgment on the merits (which may be binding or
non-binding) after an expedited, adversarial hearing, in which each
party has the opportunity to present proofs and arguments.
• Arbitration is procedurally less formal than court adjudication;
procedural rules and substantive law may be set by the parties.
15. CVDRCCircle of Voice Trust
What is the process?
The normal course of dispute resolution would be as under:
• Phase-1: Mediation (with a maximum of three meetings)
• Phase-2: Conciliation (with a maximum of three meetings)
• Phase-3: Arbitration (with a maximum of two hearings) or referral to
the court of law
In case of commercial/business dispute the parties may directly opt for
Arbitration in accordance with the terms of their agreements.

What is the cost?
• There will be a minimum fee plus cost of the session
• The cost depends on the nature and value of dispute and number of
sessions required for dispute resolution.
• Special consideration will be given to financially weak and destitute.
