4. The importance of IPR in Digital Media
Intellectual property rights are a key competitive asset for SMEs. In fact, the knowledge and
information-driven economy has increased demand for creative content, which has given
intellectual property an increasingly important role in commercial life.
Thanks to technological advances and globalisation, digital media companies have now more
opportunities to maximise the value of their IP in international markets. However, the same
technological advances have also made it even more important to protect the company’s assets
since it has become easier for others to copy and distribute a company’s work, ideas and
concepts as theirs.
Digital media companies need to make sure that their creative efforts are rewarded and
protected. Moreover, they also need to be aware that by properly managing their IP, they can:
(I) gain a competitive advantage by establishing a strong position for their brand, products and
services and prevent competitors from copying them; (II) increase the company’s market value
(with some patents and/or registered trade marks, it will be easier to access venture capital);
(III) create a strong brand and corporate identity to attract customers and (IV) avoid expensive
litigation from those rights that a company may have infringed had they not fully understood IP.

5. General Information on the event
Project ImMediaTe – Improving the Value of Digital Media and Creative Industries through
Innovative business models and Services is aimed at providing tools and services to assist the
growth of digital media SMEs operating in the Creative Industries sector.
This event (ImMediaTe event in Amsterdam September 23-24, 2010) is the second in a series
of ImMediaTe cluster events followed by the event in Barcelona between June 17-18, 2010.
ImMediaTe event in Amsterdam will focus on IPR. The event will be aimed at strengthening the
market position of digital media SMEs acting in CI by controlling IPR.
The morning session will bring together perspectives from senior EC Officers, leading European
SMEs on digital media, Clusters, and Cluster Networks, ImMediate project participants, legal
advisers, senior academic researchers and leading industry representatives on IPR to support
the SMEs to strengthen their market position by controlling IPR.
In the afternoon the companies (SMEs) will have the opportunity to get interactive coaching
sessions from the leading specialists/coaches from two different and complimentary areas on
the IPR: legal/theoretical and business.
As the ImMediaTe event will take place in conjunction with PICNIC 2010 event, which aims at
bringing together creativity and innovation, the ImMediaTe Amsterdam event participants can
have the opportunity to participate in all the interesting sessions and be involved in the
organised activities scheduled on the 24th September. The companies which will have coaching
sessions, they will also have the same opportunity for the rest of the time outside of their
coaching time.

This expert panel will give a good insight on valorisation and protection
of IPR in ICT and digital media, and stress the importance of the IPR
for creative talents from multidisciplinary experts’ perspective. The
panel will address the following topics: (1) Valorisation of IPR, (2 )
Controlling IPR in the current market, (3) Applying IPR to individual ICT
and media company needs (4) Patent and licensing issues (5) Cases.
The variety of the speakers will bring valuable insight from their
experience perspective. The large corporate will provide their
perspective on controlling IPR and bring a case on open IPRs with
SMEs. The SME representative from interactive TV will share their
experience on patenting. The legal and practical ICT and media
experts will address issues on the protection of IPR from their
perspective. There is contribution from general Creative Industries IPR
expertise and academic world. Creative Commons international is
another important asset on this panel, as it is largely discussed
licensing scheme in CI. The audience will have the chance to provide
their feedback and contribute to the discussion. The discussion on this
panel will allow the selected SMEs to go for coaching sessions with a
good insight on IPR in ICT and media and they only need to focus on
their particular case/issues.

Mr. Geleyn Meijer; director IIP Create
Geleyn Roelof Meijer (1960) received his PhD in Robotics and Computer
Science in 1991. He is partner of Logica and strategy director of Logica
Management Consulting Netherlands. Since 2003 he pioneered Logica‟s
innovation policy and R&D project involvement. In 2005 he became the
Group Innovation Director for Logica, setting-up the activities across the
group and assuring Logica‟s active participation in strategic business
developments with clients and alliance partners.
Geleyn is also associate professor at the University of Amsterdam and
guest lecturer at TU Delft and Erasmus University. He publishes regularly and is speaker on various
conferences and in expert panels. Geleyn Meijer is an inspirational leader with a proven track record on
innovation leadership and a wide international network. As Strategy & Innovation Director of Logica he is
driven by the creative potential of our economy and society. He acts as as thought leader in services
innovation and masterminded embedded innovation as innovation process for ICT services companies. He
represents Logica in various national and international eco-systems on the future of the IT services
industry and is expert in the Open Innovation Strategy and Policy Group, a EU-wide think-tank. He is
advisor to the Dutch ICT innovation council, stimulating the creativity in services development among
businesses and academia. Together with leading Dutch media companies, SME‟s and universities he
launched the ICT Innovation Platform for the Creative industry (IIP Create).

Dr. Reinhard Buscher is a Head of Unit at the Directorate-General for
Enterprise and Industry. He holds a Bachelor's Degree and a PhD, in
Economics. Before joining the European Commission in 1989, he worked
for nine years at the Ministry of Economic Affairs in Germany. In the
European Commission, he has worked in a number of different areas - as a Member of Commissioner
Bangemann's Cabinet, as special Adviser for Industrial Aspects of the Information Society, as Head of
Unit for Standardisation, Head of Unit for Industrial Aspects of Electronic Commerce and Head of Unit for
E-Business, ICT industries and services. Since January 2008, he has been Head of Unit 'Support for
Innovation.

Ms. Michela Michilli, Coordinator ImMediaTe project, head of “EU
programmes & international initiatives” unit in Filas
Michela Michilli is an expert in economics, finance and international
markets, and has acquired a long experience in market analysis for the ICT
and media, the creative industries and the cultural heritage sectors,
collaborating to or leading international projects since 1996. At the moment
she is the coordinator of the European project ImMediaTe (Improving the
value of Digital Media and Creative Industries through Innovative Business
Models and Services), a EU CIP co-funded project in support of the digital media and creative industries
in Italy, Spain, France, The Netherlands and Malta. Within ImMediaTe, Mrs Michilli has been designing
and implementing innovative consultancy, coaching and business services to support European
companies in their investment readiness and access to finance and to international markets (Europe and
South-East Asia) The first events for SMEs, the Mobile Application Forum, was held in June 2010 in
Barcelona with major success in terms of participation and appraisal. Next appointments have been
already scheduled in Amsterdam, Malta, Rome and Paris. Ms. Michilli is also in charge of the regional
clusters of creative industries, aerospace and bioscience in Lazio Region and its relationships with Europe
and South East countries. Finally, she is chairperson of the Enterprise Europe Network Creative industry
Sector Group and member of the Think Tank for Creative industry and EBAN.

Mr. Jens van den Brink, partner at Kennedy Van der Laan
Jens Van den Brink started practicing law in January 2000, after
studying in Amsterdam, London, New York and Nice. He joined
Kennedy Van der Laan in 2001. He is part of both intellectual
property and media practice groups. Jens specializes in intellectual
property law, with a focus on the advice and litigation for media
companies. Aside from issues involving the more classical IP rights
such as trademark and copyright law, Jens is specialized in the freedom
of speech (defamation), gaming law, internet law and media law. Jens regularly lectures on media, IP,
internet and freedom of speech subjects. He provides workshops in Intellectual Property law at the Media
Academy in Hilversum, is guest lecturer in Media Law at the Postacademische Dagbladopleiding
Journalistiek of Erasmus University and School for Journalism in Utrecht and guest lecturer in Internet
Law (post academic education) at the VU University in Amsterdam. He is co-author of the International
Libel & Privacy Handbook (Bloomberg, 2009) and editor-in-chief of media law blog Media Report.

Netherlands
Paul Keller is senior copyright policy advisor at Knowledgeland, an
Amsterdam based think-tank focussed on innovation in the knowledge
economy. He is public project lead for Creative Commons in the
Netherlands and serves as Collecting Societies Liaison for Creative
Commons International. Paul is an expert on open content licensing with a
special focus on the cultural heritage organizations, the music industry and the creative industries. Next
to his work for Creative Commons he is currently coordinating the copyright related aspects of Images for
the Future one of the biggest digitization projects for audio-visual heritage in Europe and he is one of the
architects of the licensing framework for Europeana, the European Union funded online aggregator of
Europe's cultural heritage. Paul frequently advises organizations on the implementation of open content
licensing strategies. Prior to joining Knowledgeland in 2007, Paul was head of the Public Research
programme of the Amsterdam based media Lab Waag Society.

Design
Simon Bolton has worked nationally and internationally promoting the role
and use of design with organisations such as the Design Council, Industrial
Design Society of America, Korean International Design Promotion and the
Hong Kong Design Centre. Simon specialises in helping companies improve
and develop their design capabilities and business performance.
He has extensive experience of working in Europe, North America, South
America and Asia for local and global brands. Simon has extensive IPR experience through his work in
the retail packaging, sports and fitness industries, involving patenting, licensing, brand protection and IPR
disputes. He maintains an up to date understanding of IPR through his involvement in sports and fitness
manufacturing businesses in China. His experience and subsequent expertise is from the perspective on
integrating IPR into Creative Practice from a none IPR specialist perspective - decoding processes and
giving practical advise on how you deal with IPR from a non-specialist perspective -
language/process/etc.
Ms. Annelies Kaptein; Owner & CEO of StoneRoos Interactive
TV
Annelies Kaptein graduated in Business Administration and
Psychology. She has build up a brief experience in TV and Media and
worked for several Dutch Broadcasters in different areas: as a
manager, project leader ( NOB / Dutch view), consultant and in the
board of directors responsible for new media and marketing. In 2002 Annelies started a new media
company Stoneroos with a focus on interactive television. Since the start, Stoneroos has won several
international prizes for iTV enhanced TV applications. Annelies has experience in patenting a service via
innovation method: Stoneroos used Innovation Voucher for the application of the IPR.

16. Mr. Velli- Pekka Niitamo; User driven Innovation director
at Nokia
Velli- Pekka Niitamo holds the academic positions; Visiting
professor at the University of Ulster in Innovation management and
Executive researcher at Aaalto University. Mr. Niitamo has also
been chairing two national Innovation stratregies where LivingLabs
and open user driven innovation is highlighted in the Netherlands
and Finland. In Netherlands under the leadership of its Prime
Minister, Innovation strategy is implemented by the agency called „Innovation Platform‟. One of the ten
programmes in this strategy is to create Netherlands as an interesting and attractive place for
investments for user centric innovation as a lead market for new services and product development in
selected focused areas. Mr. Niitamo also is seating a similar position in Finland. He chaired the European
Network of LivingLabs portfolio from 2006-2010 (130 Innovation sites globally) and now leading its
energy efficiency business cluster for open innovation. Currently Mr. Niitamo is focusing his attention to
two domains in user driven open innovation; A.Energy and environment (partner in Process Vision for
Smart Grid services) B. Future learning Services. Currently Mr. Niitamo is most active in developing an
open innovation business ecosystem for Future Learning Finland under FINRPO. Mr. Niitamo reports to
Nokia CIO and is bringing best practices to Nokia from the leading researchers and Industries of
innovative collaboration. One of the important aspects that Velli- Pekka contributes to innovation business
ecosystems is the IPR in ICT & Digital Media. He has considerable experience both from large corporate
and SME- perspective. Recently Velli-Pekka, on behalf of Nokia, started a pilot on open IPR‟s to creative
SME‟s which attracts a lot of attention in the creative industries and innovation businesses.

Gohar Sargsyan is a senior business consultant at Logica in charge of
EU innovation programmes and she is doing coordination of EU
projects at IIP CREATE. Gohar is an experienced programme manager
and business management consultant in international multidisciplinary
environments both in public as well as private sectors. She has a
background in ICT. She holds an MBA degree and an MS degree in
Computer Information Sciences from the University of California, Los Angeles (UCLA), she also
accopmlished her PhD in informatics.
After her banking experience Gohar provided consulting services to World Bank, USAID,
PricewaterHouseCoopers, etc. She was entrepreneur of an ICT company between 2000 and 2005. Started
from 2002 Gohar is an appointed expert for EU programmes. She carried out consulting, coordination,
technical, managerial activities at various EU programmes. The last few years she was a programme
director of the EU innovation projects, in some of these projects having coordination role. She likes
traveling and extreme entertainment.

TNO, and specializes in innovation management. He and his co-workers

processes. Marc sees IPR as an important tool to help people and
organizations to cooperate. Recently, Marc and colleagues from TNO
conducted a study on cooperation and IPR in the creative industry, commissioned by IIP CREATE (Ways

In 1999 Carlo Donzella founded Terra Incognita, a UK consultancy specialising in business modeling and
analyses in the digital economy. He was involved in activities concerning ICT and International
Cooperation with the European Commission and the G8. Within EC‟s FP5, FP6, FP7 and CIP he was
Project Manager of several projects in different programmes. He teaches “Innovation & Business
Planning” and “Comparative Local Development in Area Studies: India” at the Master in Development,
Innovation and Change (MiDIC) of the University of Bologna. He is consulting on European and
International Affairs to FILAS, the financing development agency of Lazio region, for which he has
negotiated several Memorandums of Understanding on Media with partners in Europe and in Asia. He
represents FILAS in CINEREGIO, the network of European Audiovisual Funds and he animates the

Initially founded in 1980 as Studio 23, this historical recording studio has recently undergone a
major refurbishment and is now known as Sound Art 23. In tune with the needs and
requirements of the international film market, Sound Art 23 has expanded its premises and
invested in the latest technologies, becoming one of the most technologically advanced and
qualified post-production facilities in Italy. It boasts a long list of major film and television
projects, both from Italy and the international market. Sound Art 23 offers a complete sound
post-production service of the highest calibre for both cinema and television. The company
looks after all aspects, from the initial translation of the script, to the mix and the final
screening. Sound Art 23 also holds a unique position within the Italian dubbing community,
