OH Court Decision Striking Down Municipal Home Rule for Oil & Gas DrillingMarcellus Drilling News
The court decision from the Ohio Ninth Appeallate District Court in the case of Munroe Falls v Beck Energy in which the appeallate court says that local zoning regulations are preempted by the state's regulations when it comes to oil and gas drilling. Municipalities cannot prevent drilling based on their own zoning regulations. Certain local zoning laws still apply (road use, rights-of-way, etc.). This decision has major implications for Utica Shale drillers and for local municipalities.
A statewide poll of New York's registered voters taken by Siena College in January. While the poll shows a majority of New Yorkers believe Gov. Cuomo's decision to ban fracking was the right decision, the state is still very divided on the issue. Some 43% either oppose that decision or don't have enough information to have an opinion on the ban. Very troubling for Cuomo is that 40% of his own voters either have an "unfavorable" or "no" opinion of him. The simple truth is, he's not all that popular in his own state, a fact which means he'll have a difficult time running for president.
An update on the effort in New York State to get shale drilling legalized--issued by the Joint Landowners Coalition of New York (JLCNY). This June 2013 newsletter provides a quick legislative update, a review of a recent seminar held in Albany, FrackNation screening update, and most importantly, an update on the lawsuit being undertaken by the JLCNY to force New York to compensate landowners if they will not allow drilling--a legal concept called "takings".
NY Court of Appeals Decision in Walter R Beardslee v Inflection EnergyMarcellus Drilling News
The decision in a case before New York's highest court, the Court of Appeals, that finds the concept of force majeure does not grant energy companies the right to extend oil and gas leases beyond the initial term even if a state government moratorium or ban is placed on shale drilling. In essence, it guts the force majeure clause in state contracts, rendering such a clause useless and screwing contract law in New York State. A very poor decision.

EPA "Final" Permit to Windfall Oil and Gas to Drill Injection Well in PAMarcellus Drilling News
The so-called "final" permit issued by the federal EPA in February 2014 to Windfall Oil and Gas that allows them to drill a 7,300 feet deep Class II saltwater injection well near Dubois (Clearfield County), PA. After encountering resistance from anti-drillers, the EPA took the "unusual step" of yanking the permit back for further consideration. Don't hold your breath on when a decision will be made.

USGS Report on Water Withdrawals from 3 Reservoirs in Eastern Ohio for FrackingMarcellus Drilling News
A report issued in August 2013 (originally due in December 2012) titled "An analysis of potential water availability from the Atwood, Leesville, and Tappan Lakes in the Muskingum River Watershed, Ohio." The report/study was commissioned by the Muskingum Watershed Conservancy District to aid them in their decisions about whether, and how much, water to sell to drillers who want to use the water in Utica and Marcellus Shale drilling and fracking.
The results of an annual survey of members of the Marcellus Shale Coalition and their hiring history and future expectations. The latest survey shows that the Marcellus continues to be a huge jobs-creating engine in PA and beyond.

A back door bill, AO 6558, signed by Gov. Andrew Cuomo on Sept 22, 2014 that requires the state Dept. of Environment Conservation to create and enforce nebulous guidelines with respect to shale drilling that require drillers to provide proof that their drilling won't somehow cause or impact mythical global warming. It is a shameless back door way of stopping shale drilling in the state.

A so-called report by the World Resources Institute that purports to show that adopting alternative energy sources and drastically reducing carbon emissions from sources like coal and reducing methane emissions from natural gas will lead to not only a better environment but a better economy--instead of financial hardship and misery. A fariy tale, essentially.
