Key Findings
1. Epidemic of bad laws is fueling the spread
of HIV, resulting in human rights violations
and costing lives
2. Epidemic of bad laws is limiting
effectiveness and efficiency of HIV and
health investments
3. Good laws and practices that protect
human rights and build on public health
evidence already exist - they strengthen
the global AIDS response, and they must
be replicated

• Remove all legal barriers that impede access
to HIV and health commodities and services
for Key Populations
• Respect, give force to domestic and
international human rights obligations to
protect and promote equality of all people
within their borders
• Repeal laws criminalizing consensual sex
between adults of the same sex and
transgender identity
• Respect existing civil and religious laws and
guarantees related to privacy

  1. Communities can play extremely important roles in informing and mobilizing the government and the public for greater access to lifesaving medicines. In India and Thailand, for example, community organizations filed and won many court cases over the validity of certain patents, which led to availability of affordable medicines. Communities can also work hand in hand with the government to review and amend domestic laws to include more TRIPS flexibilities, assess the potential impact of free trade agreements on access to medicines, or request the government to use them if access to lifesaving medicines is highly restricted. The voice from the community is extremely important as it can articulate how laws and policies can actually impact the very lives of vulnerable people on the ground that they are supposed to protect in the first place. In collaboration with the government and other partners such as APN+ and UNAIDS, UNDP has been supporting community empowerment and engagement on intellectual property rights and access to affordable medicines. We have, for example, supported national consultations on this issue specifically for the community in Cambodia, Indonesia, and Myanmar. We have supported community activists from Myanmar to be trained in field by community activists in India who have experience in policy advocacy for access to affordable medicines.

As I mentioned earlier, all the best practices generated from this region and we hope countries in AP will develop strong concept notes, addressing human rights barriers, including a comprehensive package of interventions for strategic investment and to achieve the greatest impact possible. As PR for the MSA GF HIV Prog. and TA for the ISEAN/HIVOS Grant, UNDP has been using all these tools to support SRs and CBOs implementing strategic interventions addressing human rights barriers to access services for KAPs. I will be happy to present them more in details in session 5. As the lead agency on human rights & HIV, UNDP is available to support you throughout the development of your concept note, to ensure barriers to access are identified and strategic interventions are proposed to help your country design a human rights-based approach to health.   3. Based on the activities presented earlier, please keep in mind that in the new funding model, applicants are strongly encouraged to incorporate human rights programming in their concept notes. Therefore, CCMs are required to submit concept notes which address human rights barriers to reach out to key populations, and this work start with the country dialogue by meaningfully engaging KAPs throughout the process of the NFM. Here is a check list for inclusion of KAPs into the NFM process to ensure the development of a comprehensive concept note. It is strongly recommended that applicants: 1. Identify who is at risk of HIV, TB or malaria, who has the disease, and what activities are needed to address human rights barriers and effectively reach those populations. 2. Design all disease programs using a human rights-based approach. 3. Invest in a package of services to remove human rights barriers to access, including community system strengthening.
