In March of this year the European Commission adopted a
Green Paper on “A 2030 framework for climate and energy
policies”, which addresses the future EU policies regarding
climate and energy that would be in put place over the
next decade.
The Green Paper details important policies that would
form the backbone of the 2030 framework that will focus
on providing more certainty for investors, increasing
economic competition, securing the energy system and
establishing the EU’s new ambitious targets for the
reduction of greenhouse gas emissions. The 2030
framework will leverage the successes and failures of the
2020 framework and also incorporate a longer-term
planning in order to address the transformation to a low
carbon economy in 2050.
The publication of the Green Paper simultaneously
launched a public consultation that seeks opinions and
views regarding the policies and 2030 framework, not only
from Member States and other EU institutions, but also
from public and private stakeholders. This consultation,
which is now in its final stages, will provide crucial input to
the EU Commission for its ongoing discussions regarding
the drafting of the 2030 framework that will be submitted
by the end of this year.
One important and controversial issue at the heart of the
Green Paper and addressed through the consultation, is
whether or not the new 2030 energy efficiency targets will
be legally binding. The energy and climate targets for 2020,
which sought to reduce greenhouse gas emissions and
increase the use of renewable energies, were binding.
However, it is unclear at the current time whether the
Commission will seek to pass binding or non-binding
targets for 2030. As far back as 2011, the EU Commissioner

Die EU-Kommission hat Ende März ein Grünbuch mit dem
Titel „Ein Rahmen für die Klima- und die Energiepolitik bis
2030“ vorgestellt. Mit dem Diskussionspapier wurde eine
öffentliche Debatte darüber eingeleitet, welche Ziele für
das kommende Jahrzehnt realistisch sind.
Diese europaweite Konsultation geht nun am 2. Juli zu En-
de. Bis dahin haben Mitgliedstaaten, EU-Institutionen und
Stakeholder noch die Gelegenheit, zu der Ausgestaltung
der europäischen Energie- und Klimapolitik nach 2020
Stellung zu nehmen. Die Erklärungen werden im Anschluss
an die Debatte ausgewertet und münden voraussichtlich
schon Ende des Jahres in konkreten Vorschlägen der Kom-
mission für die Klima- und Energiepolitik bis 2030.
Der Rahmen für die Klima- und Energiepolitik soll mehr
Planungssicherheit für Investoren schaffen. Es sollen die
Möglichkeiten für eine wettbewerbsfähige Wirtschaft und
ein sicheres Energiesystem verbessert und das Ziel der EU
für die Reduzierung des Treibhausgasausstoßes bis 2030
festgelegt werden. Zudem soll dem „Fahrplan für den
Übergang zu einer wettbewerbsfähigen C02-armen Wirt-
schaft bis 2050“ Rechnung getragen werden. Die positiven
und negativen Erfahrungen, die mit dem Rahmen für die
Zeit bis 2020 gewonnen werden, helfen dabei.
Ein wichtiger und kontrovers diskutierter Punkt des Grün-
buchs ist, ob die Energieeffizienzziele bis 2030 verbindlich
sein sollen. Auf die Klima- und Energieziele bis 2020, die
die Treibhausgasemissionen verringern und den Gebrauch
von erneuerbaren Energien steigern sollen, trifft dies zu.
Die Ergebnisse der Konsultation werden einen großen Ein-
fluss auf diese Debatte haben.
Bereits 2011 hatte EU-Energiekommissar Günther
Oettinger verbindliche Ziele bis 2030 gefordert.

The German Company Vaillant, well-known for their
internet-connected heating systems, recently
acknowledged a critical vulnerability within their ecoPower
1.0 system that allows hackers access to passwords and
the ability to turn the combined heat and power family
systems completely off.
The ecoPower 1.0 is a small one family home unit that uses
natural gas to provide both heat and power. The system is
connected to the internet and allows home owners to
remotely access and control the heating and power in their
house both through a web interface as well as an iPad app.
Customers can remotely control the entire heating of the
house or individual components, such as turning hot water
on and off or setting temperatures.
This convenience, the ability to remotely control the
heating and power systems through the internet, however,
has created the potential for significant security breaches –
exactly what has now happened to the ecoPower 1.0
system. Vaillant officially stated that the security flaw
could allow outside attackers not only to gain access to

homeowner controls, but also to service administrator
controls. Within a message to all customers, the company
recommended that all systems be physically disconnected
from the network until they could be fixed on-site.
With the increase of energy-efficient IT and smart home
technologies, the importance of strong data protection
and security will become only more crucial within the
sector in the future. This case with Valliant can be
considered the tip of the iceberg. As it is still very common
within the building services industry to use the same
default passwords for service access, something as simple
as abandoning default passwords would be a big step in
the right direction. In the coming years, companies will
need to develop safer solutions, such as encrypted data
transfers, and make security the highest priority.

Das deutsche Unternehmen Vaillant hat vor kurzem be-
kannt gegeben, dass ein unberechtigter Fremdzugriff über
das Internet auf den Systemregler des ecoPower 1.0 mög-
lich ist. Es gebe eine Schwachstelle, die es Hackern ermög-
lichte, Passwörter auszuspionieren und in das System ein-
zudringen.
Die für Ein- und Zweifamilienhäuser ausgelegten eco-
Power-Anlagen produzieren aus Gas Wärme und Strom.
Die Steuerung des ecoPower 1.0 verfügt über einen LAN-
Anschluss, der das Bedienen des Gerätes über ein Web-
interface oder einen IPad ermöglicht. Die gesamte Heizung
oder nur einzelne Komponenten, wie die Warmwasser-
bereitung, können so aus der Ferne bedient werden.
Dieser Komfort führt jedoch zu erheblichen Sicherheits-
lücken. Vaillant zufolge ist ein Zugriff auf das Gerät sowohl
auf der Kunden- als auch auf der Entwicklerebene möglich.
Der Hersteller rät seinen Kunden daher, die Anlagen phy-
sisch vom Netzwerk zu trennen und auf den Besuch eines
Servicetechnikers zu warten.
Mit der Zunahme von energieeffizienten IT- und Smart-
Home-Technologien wird die Bedeutung eines starken Da-
tenschutzes in diesem Sektor immer deutlicher. Das Bei-
spiel Vaillant ist womöglich nur die Spitze des Eisbergs. Ein
großer Schritt in die richtige Richtung könnte deshalb
schon das Abschaffen von nach wie vor weit verbreiteten
Standardpasswörtern für Servicezugänge in der Haustech-
nikindustrie sein. Unternehmen werden in den kommen-
den Jahren sichere Lösungen wie verschlüsselte Daten-
übertragungen entwickeln und Sicherheit zur Priorität er-
klären müssen.

STUDY: GREAT DEFICIENCIES IN GERMAN
COMPANIES’ DATA PROTECTION POLICIES.
ONE THIRD OF GERMAN COMPANIES UNPREPARED FOR
DATA BREACHES.

A new privacy study released by TÜV SÜD and Ludwig-
Maximilians-University in Munich, reports not only a
staggering amount of gaps in the data protection policies
of German companies, but also a lack of contingent plans
in the case of breaches. While customers expect their data
to be secure and protected, the study revealed that about
a third of German companies surveyed have no systematic
approach to deal with a data or privacy breach.
Companies surveyed were primarily German small and
medium sized companies (SMEs) with up to 499
employees. About sixty percent were drawn from the
German states of Bavaria, North Rhine-Westphalia and
Baden-Württemberg.
The study also found that employees are more often than
not provided with insufficient information to understand
crucial privacy issues. Even within the companies where

legal requirements were met, the importance and
awareness of data protection was still not taught to
employees. Although some external service providers,
such as TÜV SÜD, provide data protection courses and
training for employees, very few companies participating
in the study force employees working with personal data
to attend regular data protection training courses in order
to maintain up-to-date knowledge on privacy issues.
Furthermore, regarding information provided to
customers, the study revealed that almost a quarter of the
companies surveyed did not inform customers about the
possible uses of their data, although not doing so is illegal.
In addition, while regularly monitoring the data protection
standards of third parties that come in contact with
customer data is vital for sufficient data protection, the
study found that in sixty percent of cases companies do
not ensure that third parties sufficiently protect the
private data of their customers.

Der Schutz personenbezogener Daten wird in vielen
deutschen Unternehmen nur unzureichend umgesetzt. Das
ist das Ergebnis einer Studie des TÜV SÜD und der Ludwig-
Maximilians-Universität München. Demnach gibt es bei
über einem Drittel der Betriebe kein systematisches Vorge-
hen bei Datenschutzverletzungen.
Mitarbeiter werden zudem häufig nicht ausreichend über
das Thema Datenschutz informiert. Selbst in Unterneh-
men, in denen gesetzliche Regelungen eingehalten wer-
den, wird der Stellenwert des Datenschutzes nicht vermit-
telt. Und obwohl einige externe Dienstleister Schulungen
zu diesem Thema anbieten, animieren die befragten Un-
ternehmen ihre Mitarbeiter nicht zur regelmäßigen Teil-
nahme.
Fast ein Viertel der Unternehmen informiert seine Kunden
zudem nicht darüber, wie ihre Daten verwendet werden
können. Dies verstößt gegen geltendes Recht. Kritisch sei
ebenfalls, dass in 60 Prozent der Fälle Dritte, die mit per-
sonenbezogenen Daten des Unternehmens in Berührung
kommen, nicht regelmäßig überprüft werden. Daten-
schutzlücken eines Partners, wie zum Beispiel externer Ser-
vicecenter, können jedoch auf das eigene Unternehmen
zurückfallen.
Für die Studie wurden vor allem kleine und mittlere Un-
ternehmen (KMU) mit bis zu 499 Mitarbeitern befragt. 60
Prozent der Teilnehmer kamen dabei aus Bayern, Nord-
rhein-Westfalen und Baden-Württemberg.

EU RAILWAY PACKAGE: MINISTERS OF
TRANSPORTATION IN FAVOUR OF NATION-
AL LICENSING.
EU COMMISSION’S PROPOSAL FOR AN EU-WIDE AGENCY
FOR THE LICENSING OF TRAINS AND RAIL EQUIPMENT HAS
BEEN HEAVILY DILUTED BY THE COUNCIL OF MINISTERS.

For train operating companies (TOCs) and manufacturers
of rail vehicles, the certification of new locomotives,
wagons and other rail equipment is an often costly and
tedious process. Europe-wide there is a labyrinth of about
11,000 rules and regulations employed by the national
authorities, such as the Federal Railway Authority in
Germany (EBA). The granting of a license can take several
years. Furthermore, since the requirements can change
during the process, applicants constantly have to reckon
with having to make adjustments to the equipment. This
situation constitutes a barrier to the expansion of rail
traffic, especially with regard to cross-border connections.
Therefore, through its fourth railway package presented in
January, the European Commission wants to align the
regulations for safety and compatibility required from
providers of rolling stock. In the future, according to these
plans, there should be one single European authority
responsible for licensing processes in the railway sector.
On 10 June, however, the Council of Transportation
Ministers rejected the Commission’s ideas. Rather, the
ministers agreed on a “joint concept” for the technical part
of the rail package, which suggests that national
authorities, such as the EBA, would continue to have the
right to grant licenses to rail vehicles that operate in one
EU member state only.

reducing bureaucracy. Michael Cramer, MEP for the Green
Party, calls the concept of the Transport Ministers
“myopic” and adds: “The proposed differentiation
between nationally and internationally operating trains (…)
prevents the growing of a joint market with lower prices
and broader supply.”
While the national bureaucracies are interested in keeping
the status quo, TOCs, such as Deutsche Bahn, and
manufacturers of rail vehicles, such as Siemens,
Bombardier and Alstom, would welcome harmonised
processes. This would allow them to offer their products
and services across Europe in an easier way.
Currently, the European Parliament is also examining the
proposal of the Commission and it is expected that the
Transport Committee will consult in November 2013 about
a joint position. After that, it must come to a settlement
within the Council.

EU-EISENBAHNPAKET: VERKEHRSMINISTER FÜR NATIO-
NALE GENEHMIGUNGEN.

VON ZÜGEN UND EISENBAHNGERÄT DEUTLICH.

Die Zulassung von neuen Lokomotiven, Waggons und an-
derem Eisenbahngerät ist ein für Eisenbahnverkehrsunter-
nehmen (EVU) und Schienenfahrzeughersteller oft kost-
spieliger und langwieriger Prozess. Europaweit gibt es
bisher ein Labyrinth von etwa 11.000 Vorschriften, die von
den nationalen Behörden wie dem Eisenbahnbundesamt
(EBA) angewandt werden. Eine Genehmigung kann meh-
rere Jahre in Anspruch nehmen. Da sich zudem die Anfor-
derungen in der Zwischenzeit ändern können, muss stän-
dig mit der Notwendigkeit von Anpassungen am Gerät
gerechnet werden. Diese Situation stellt ein Hemmnis für
eine Ausweitung des Schienenverkehrs dar, insbesondere
im Hinblick auf grenzüberschreitende Verbindungen.
Mit ihrem im Januar vorgestellten vierten Eisenbahnpaket
will die Europäische Kommission daher die Anforderungen
an die Sicherheit und Kompatibilität, die an rollendes Ma-
terial gestellt werden, angleichen. Nach diesen Plänen soll
zukünftig eine Europäische Eisenbahnagentur EU-weit zur
einzigen Anlaufstelle für gültige Zulassungen und Sicher-
heitszertifikate für Eisenbahnen werden.
Am 10. Juni hat der Rat der Verkehrsminister diesen Vor-
stellungen der Kommission aber erst einmal eine Absage
erteilt. Zwar haben sich die Minister auf ein „gemeinsames
Konzept“ für den technischen Teil des neuen Eisenbahn-
pakets geeinigt. Dieses Konzept sieht jedoch vor, dass
nationale Sicherheitsbehörden wie das EBA auch weiterhin
die Möglichkeit haben sollen, Genehmigungen für Eisen-
bahnfahrzeuge zu erteilen, die in nur einem EU-Mitglied-
staat eingesetzt werden.
EU-Verkehrskommissar Siim Kallas sieht darin eine Verwäs-
serung des Kommissionsvorschlags: „Ein Mitgliedsstaat
nach dem anderen ist gekommen und hat erklärt, er wolle
der Europäischen Eisenbahnagentur bestenfalls eine koor-
dinierende Rolle zugestehen. Die nationalen Behörden
wollen die Macht in ihren Händen halten. Und dann wer-
fen sie der Kommission vor, dass wir zusätzliche Bürokratie
schaffen.“ Dabei würde eine Europäische Eisenbahnagen-
tur erheblich zum Bürokratieabbau beitragen. Der Grünen-
Europapolitiker Michael Cramer nennt das Konzept der

Verkehrsminister „kurzsichtig“ und ergänzt: „Die vorge-
schlagene Unterscheidung zwischen national und inter-
national verkehrenden Zügen (…) verhindert das Entstehen
eines gemeinsamen Marktes mit niedrigeren Preisen und
einem breiteren Angebot.“
Während die nationalen Bürokratien also am Status quo
festhalten wollen, würden EVU wie die Deutsche Bahn und
Schienenfahrzeughersteller wie Siemens, Bombardier und
Alstom vereinheitlichte Verfahren begrüßen. Diese würden
es ihnen erlauben, ihre Produkte und Services einfacher
europaweit anzubieten.
Derzeit prüft auch das Europäische Parlament den Vor-
schlag der Kommission. Der Verkehrsausschuss wird vor-
aussichtlich im November 2013 über eine gemeinsame
Position abstimmen. Danach muss es dann zu einer Ver-
ständigung mit dem Rat kommen.

LL BRAKE BLOCKS OFFER NEW SOLUTION TO
TRAIN-NOISE POLLUTION IN THE EU.
DEUTSCHE BAHN AND GERMAN MINISTRY OF TRANSPORT
OFFER INCENTIVES FOR INSTALLING NEW NOISELESS
BRAKES.

Traffic volume in Germany and Europe has constantly risen
over the last years and will continue to do so, according to
all forecasts. This carries the potential for conflicts
between those who live near the traffic infrastructure and
those who operate it – particularly because of the noise
that comes with increased traffic. The EU Commission had
planned to present an update of its 2002 Environmental
Noise Directive this spring, listing goals and procedures to
reduce noise, however, this has not yet happened.
Currently, there is some activity regarding the topic
especially in the railway sector. On the one hand, transport
policy in Germany and Europe advocates shifting more
traffic to rail. On the other hand, though, more trains also
mean more noise. The majority of this noise comes from
freight trains whose wagons are often still equipped with
noisy so-called cast-iron brake blocks. Additionally, freight
trains mostly run at night, which literally causes sleepless
nights to many who live near the tracks. Worst is the
situation along some of the main European through-ways
of freight transportation, such as the route through the
Rhine Valley, one of the most crucial connections between
North/West Germany and the Netherlands through
Switzerland and further to Italy. More than 500 trains cross
the Rhine Valley per day.
Possible options to reduce the noise would include more
effective sound protection walls along the tracks, or the
installation of sound protection windows in buildings that
are particularly affected. The priority, however, is to
eliminate the noise at its source, meaning on the vehicle
itself. At the end of May, after two years of testing, the
International Union of Railways UIC approved the use of
the low-noise LL brake block (Low noise, Low friction). Its
advantage is that it can also be installed into already
operating wagons, thus substituting old cast-iron blocks. In
contrast, another low-noise technique, the so-called
composite brake block (K block), operating for ten years
now, can economically only be assembled to new wagons.
This has prevented a comprehensive refitting so far. All in
all, a consistent application of modern brakes would cut
the noise level by half.
The LL brake also marked the starting point for the new
system of noise dependent track access charges,
introduced by the German Federal Ministry of Transport
and DB Netz. The system started on 1 June and is the
political instrument that will support a quick and wide-
ranging introduction of low-noise brakes in the market. It
offers train operating companies a financial incentive to
run their traffic with low-noise freight wagons.

It is questionable, though, whether this incentive is enough
to refit the larger part of the 150,000 freight wagons in
Germany and 400,000 in Europe within only a few years.
The total costs would be around 200 million EUR.
Therefore, Switzerland – one of the most important transit
countries in European freight traffic – decided to ban all
wagons with cast-iron brakes as of 2020. This Swiss policy
could place pressure on the EU to adopt a similar scheme,
as was made clear at the recent event “Freight
transportation in silent shoes”, jointly organized by the
Swiss embassy in Germany and the federal state of North
Rhine-Westphalia.

EISENBAHNLÄRMS.

Das Verkehrsaufkommen in Deutschland und Europa ist in
den vergangenen Jahren stetig angestiegen und wird den
Prognosen zufolge auch weiterhin zunehmen. Hieraus
können sich Konflikte zwischen den Anwohnern der Ver-
kehrswege und deren Betreibern ergeben – insbesondere
durch den entstehenden Lärm. Die EU-Kommission hatte
ursprünglich geplant, im Frühjahr 2013 eine Neufassung
der Umgebungslärmrichtlinie von 2002 vorzustellen, die
Ziele und Verfahren zur Lärmreduktion benennt. Dies ist
bis jetzt jedoch nicht geschehen.
Bewegung beim Thema Lärm gibt es derzeit vor allem im
Eisenbahnsektor. Die Verkehrspolitik in Deutschland und
Europa setzt sich zwar für eine Verkehrsverlagerung auf
die Schiene ein. Mehr Züge bedeuten jedoch auch mehr
Lärm. Der Großteil entsteht durch Güterzüge, deren
Waggons häufig noch mit lauten sogenannten Grauguss-
Bremssohlen ausgestattet sind. Zudem werden Güter
meistens nachts transportiert, was die Anwohner von
Güterverkehrsstrecken buchstäblich um ihren Schlaf
bringt. Besonders betroffen sind einige Hauptadern des
europäischen Güterverkehrs wie beispielsweise die Rhein-
talstrecke, eine der wichtigsten Verbindungen von Nord-/
Westdeutschland und den Niederlanden durch die Schweiz
nach Italien. Das Rheintal wird täglich von rund 500 Zügen
durchfahren.
Möglichkeiten zur Lärmminderung wären effektivere
Schallschutzwände entlang der Strecke oder der Einbau
von Schallschutzfenstern bei besonders betroffenen Ge-
bäuden. Priorität ist es jedoch, den Lärm an der Quelle,
also am Fahrzeug selbst, zu beseitigen. Ende Mai hat der
internationale Eisenbahnverband UIC nach zweijährigen
Tests den Einsatz der besonders leisen LL-Sohle (Low noise,
Low friction) freigegeben. Ihr Vorteil besteht darin, dass sie
im Austausch mit der Grauguss-Bremse auch in bereits im
Betrieb befindliche Waggons eingebaut werden kann. Die
seit zehn Jahren zugelassene ebenfalls geräuscharme Kom-
posit-Sohle (K-Sohle) kann dagegen mit vertretbaren
Kosten nur bei neuen Waggons montiert werden, was eine
flächendeckende Umrüstung bisher verhinderte. Insge-
samt würde ein durchgängiger Einsatz moderner Bremsen
den Lärmpegel halbieren.
Mit der neuen LL-Sohle kann das vom Bundesverkehrs-
ministerium und DB Netz eingeführte lärmabhängige Tras-
senpreissystem greifen. Es startete am 1. Juni und ist das
politische Instrument, das einen raschen und breiten Ein-
satz lärmarmer Bremssohlen im Markt fördern soll. Es
bietet Eisenbahnverkehrsunternehmen finanzielle Anreize,
ihre Verkehre mit leisen Güterwagen zu bestreiten.
Ob dieser Anreiz reicht, innerhalb weniger Jahre einen
Großteil der etwa 150.000 Güterwaggons in Deutschland
und 400.000 Wagen in Europa umzurüsten, was insgesamt
rund 200 Millionen EUR kosten würde, ist allerdings frag-
lich. Daher hat die Schweiz, eines der wichtigsten Tran-
sitländer im europäischen Güterverkehr, beschlossen, ab
2020 keine Waggons mit Grauguss-Bremse mehr durchs
Land fahren zu lassen. Dies könnte Handlungsdruck auf die
EU ausüben, wie auf einem gemeinsam von der Schweizer
Botschaft und dem Land NRW im Juni veranstalteten
Abend mit dem Titel „Güterverkehr auf leisen Sohlen“
deutlich wurde.
