SOCIAL LEGISLATION
THE SCHEDULE CASTE AND SCHEDULE
TRIBE(POA)ACT,1989

ORIGIN OF THE LAW :
 There are some caste and tribe in our country who are
weak socially and economically.
 The government has made a list of these castes and
tribes so that some special measures can be taken to
them.
 This list is called a ‘schedule’.The caste mentione in the
list are called SC/ST.
 Sometimes horrible and inhuman treatment is meted out
of the members of the SC/ST.
 A law has been made to give special protection to the sc/st
from being exploited or ill treated by the non schedule
caste.
 This law is called SC/ST(prevention of atrocities)act,1989.
AIMS AND OBJECTIVES :
 This law was enacted to prevent atrocities against the
members of the schedule caste and schedule tribes to
establish special courts to try offence commited against
them and to provide relief and rehabilitations for the
victims of atrocities.
OFFENCES OF ATROCITIES :
This law says that the following acts are atrocities against
SC/ST’s
 Making them eat or drink something that is foul or that
cannot be eaten.
 Throwing excreta,carcass or filth in their compound.
.
 Stripping them of their clothing,painting their faces or
body and parading them naked in a public place.
 Forcing taking their land away and cultivating it.
 Forcing them into doing ‘beggar’ or work without pay
or any kind of bonded labour.
 Stopping them to voting or forcing them to vote for a
particular candidate
 Harassing or assaulting an sc/st woman or using a
powerful position to sexually exploit her.
 Making false and malicious criminal cases and suits
against them.
.
 Forcing them to leave their villages or residence .
 Stopping them from using a temple or public places etc.
These are the offenses of atrocity against
schedule castes and schedule tribes.
PUNISHMENTS :
 If any of the above atrocities are committed on a
member of sc/st.He or she must immediately report to
the police.
 The police will register a case,if he found guilty,he will
be punished by being sent to jail for minimum six
months and maximum five years and a fine levied
against him.
PUNISHMENT FOR FALSE
EVIDENCE :
 If a non schedule caste person intentionally gives
false evidence against any sc/st person, he or she
can be punished with imprisonment for life and
with fine.
SPECIAL COURTS :
 The government has set up a special court to try
such cases.These special courts exist in most
districts in india.The special court are usually in
the district session court campus.
COMPENSATION :
 The victims of the above atrocities are entitled to
monetary compensation.The amount of money will
depend on the extent of loss suffered.This
compensation will also given by the courts.
DUTY OF GOVERNMENTS FOR
EFFECTIVE IMPLEMENTATION :
The state government is to take necessary measures for
the effective implementation of the act.They are,
Giving legal aid to the victims of the atrocities.
Meeting the travelling and maintanence expenses
of the witness and the victims during the investigation.
.
 Providing facilities for the social and economic
rehabilitations for the victims of atrocities.
 Appointing officers to supervise and conduct prosecution
for commiting offences under this act.
 Setting up committees to assist the government in
formulating and implementing measures to prevent
atrocities.
