4. 3. ADVOCATE GENERAL : He is a legal advisor to the state
government and appears on its behalf in the High Court to
support the governmental actions. Since, his or her advice to
the Goverment is in the public domain, one can judge its
objectivity or absence of it. By way of public interest litigation,
one can intervene, if s/he dilutes or withdraws a case in the
course of proceedings under instructions from the Government

Under a Supreme Court definition, “public servant” means not
only the government officers, it includes private individuals also:
sarpanches, corporators, MLAs, M.P.s, rationshop dealers,
contractors undertaking public works, managers of religious and
chaitable trusts, managers of academies and sports complexes
that have received lands for giving training, ambulance services,
managers of public utility blood and eye banks, corporate
hospitals that have received exemptions and financial support
from the government, It carries out, all enquiries instructed by
the state government, Vigilance Commission and Lokayuktha.
However, it works under the authority of the General

It can make sudden raids. Somebody having dis-proportionate
assets (to the known sources of income) can be raided. They
can arrange to trap any state official with your cooperation. At
least, just inform them even anonymously details about the
disproportionate assets of a corrupt officer or provide tips so
that they can make sudden raids. You can, further, obtain
information about all Chief Vigilance Officers of major State
Departments and Corporations. Guilty persons can be tried in
the Court or be subjected to disciplinary action based on
A.P.C.S.(CCA) Rules, 1991. There are special courts to try.

iv. Banking Ombudsman :
If any bank rejects the complaint, or the complainant does
not receive any reply within a month or the complainant is
not satisfied with the reply given by the bank. One can use
a plain white paper or do it one-line. One can complain
against all commercial banks, regional rural banks and
scheduled primary cooperative banks. S/He works through
a process of conciliation, mediation and arbitration. All the
banks have to observe “Banking Codes and standards Board
of India”which are framed by RBI. If the bank is found guilty,
he can fine upto Rs. 10 lakhs and upto one lakh in case of
mental agony suffered. The following deficiencies:
• non-payment or inordinate delay in the payment or
collection of cheques, drafts, bills etc.;
• non-acceptance, without sufficient cause, of small
denomination notes tendered for any purpose, and for
charging of commission in respect thereof;

tendered and for charging of commission in respect
thereof;
• non-payment or delay in payment of inward remittances;
• failure to issue or delay in issue of drafts, pay orders or
bankers’ cheques;
• non-adherence to prescribed working hours ;failure to
provide or delay in providing a banking facility (other than
loans and advances) promised in writing by a bank or its
direct selling agents;
• Delays, non-credit of proceeds to parties accounts, non-
payment of deposit or non-observance of the Reserve
Bank directives, if any, applicable to rate of interest on
deposits in any savings,current or other account
maintained with a bank ;
• complaints from Non-Resident Indians having accounts
in India in relation to their remittances from abroad,
deposits and other bank-related matters;
• refusal to open deposit accounts without any valid reason
for refusal;
• levying of charges without adequate prior notice to the
customer;
• non-adherence by the bank or its subsidiaries to the
instructions of Reserve Bank on ATM/Debit card
operations or credit card operations;
• non-disbursement or delay in disbursement of pension
(to the extent the grievance can be attributed to the action
on the part of the bank concerned, but not with regard to
its employees);
• refusal to accept or delay in accepting payment towards
taxes, as required by Reserve Bank/Government;
• refusal to issue or delay in issuing, or failure to service or
delay in servicing or redemption of Government
securities;

31. • forced closure of deposit accounts without due notice or
without sufficient reason;
• refusal to close or delay in closing the accounts;
• non-adherence to the fair practices code as adopted by
the bank or non-adherence to the provisions of the Code
of Bank s Commitments to Customers issued by Banking
Codes and Standards Board of India and as adopted by
the bank ;
• non-observance of Reserve Bank guidelines on
engagement of recovery agents by banks; and
• any other matter relating to the violation of the directives
issued by the Reserve Bank in relation to banking or other
services.
• A customer can also lodge a complaint on the following
grounds of deficiency in service with respect to loans and
advances:
• non-observance of Reserve Bank Directives on interest
rates;
• delays in sanction, disbursement or non-observance of
prescribed time schedule for disposal of loan applications;
• non-acceptance of application for loans without furnishing
valid reasons to the applicant; and
• non-adherence to the provisions of the fair practices code
for lenders as adopted by the bank or Code of Bank’s
Commitment to Customers, as the case may be;
• non-observance of any other direction or instruction of
the Reserve Bank as may be specified by the Reserve
Bank for this purpose from time to time.

It takes care of all irregularities under the Indian Penal Code.
Against all Central Government employees, public servants in
authority, politicians and Chairmen of boards and corporations,
civil servants, etc. Complaints against all Chief Vigilance Officers
of any department or corporation also should go to them with a
copy to the Secretary of the Ministry concerned. However, under
the infamous rule of the ‘ Single Directive’ in order to enquire

departments have declared Citizens Charters which guarantee
their minimum norms of delay, quality and style of functioning. If
you consult them and find that a department has not conformed
to those norms in your case, you can complain to Nodal officers
